SUMMARY:
This Land Use Code interpretation clarifies the meaning of Sections 26.415.030,
26.415.060, and 26.415.080. The interpretation request was filed by Attorney Leonard
Oates on behalf of JW Ventures LLC, owner of property located at 308 E. Hopkins
Avenue, Aspen, Colorado, formerly occupied by La Cocina Restaurant.
BACKGROUND: On January 23, 2006, an application for Major Development
(Conceptual), Demolition, Commercial Design Review, and View Plane Review was
submitted for consideration by the Aspen Historic Preservation Commission (HPC).
HPC approved the project with conditions, including the condition that the applicant
return for Final review within one year. An application has not been submitted for Final,
but presumably will be once the applicant completes their other review step, Growth
Management Review.
To staff's recollection, the applicant visited the Building Department on December 13tn,
2006 to inquire about submitting for a demolition permit of the La Cocina building. The
Historic Preservation Officer indicated to Claude Salter of the Building Department that
the applicant had not completed the reviews necessary to submit for demolition permit.
Demolition of the building at 308 E. Hopkins would not be prevented by the moratorium
passed by Council in April 2006, Ordinance #19, Series of 2006 attached by reference,
because the proposed work does would not increase FAR and would therefore be exempt.
However, the Historic Preservation Officer found that no permit applications could be
made because the project was still in a review process and no Development Order (final
authorization to proceed) had been granted.

That evening, City Council passed an Emergency Ordinance, Ordinance #51, Series of
2006, attached by reference, prohibiting building permits in the Commercial Core. Even
if 308 E. Hopkins Avenue had received a Development Order prior to that evening, the
fact that the applicant did not submit for a building permit before the Ordinance became
effective on December 14t' means that they are now prohibited from pursing the permit.
The applicant apparently wanted to submit their application before the moratorium went
into effect, but did not do so because staff indicated that they were not eligible until a
Development Order is issued.
The applicant has submitted a request for interpretation of several sections of the historic
preservation regulations.
The areas of interpretation requested by the owner of 308 E. Hopkins are that:
1. The property is not on the "Inventory of Historic Sites and Structures" within the
City of Aspen; and
2. The provisions of Section 26.415.060 therefore do not apply to the demolition of
the existing improvements on the property; and
3. The provisions of 26.415.080 are inapplicable to the request for a building permit
for demolition of 308 E. Hopkins and a permit should issue.
DISCUSSION
1. The property is not on the "Inventory of Historic Sites and Structures" within
the City of Aspen.
Ordinance #5, Series of 1972 (attached by reference) established the City's first historic
preservation regulations, including the procedure for designation of historic districts and
landmarks, the creation of the Historic Preservation Commission, and the empowerment
of the Commission with the authority to review all proposed work in designated areas.
Ordinance #49, Series of 1974 (attached by reference) made the Commercial Core, an
area that includes the property that is the subject of this interpretation, a designated
historic district.
In 1980, the City completed the first comprehensive survey of historic structures
throughout town, which resulted in a list referred to as the "Aspen Inventory of Historic
Sites and Structures." Regulations for the preservation of all properties on the Inventory
began to be adopted in 1986 and, for example, Ordinance #41, Series of 1986 (attached
by reference) included a list of those properties on the Inventory. "Contributing"
properties, which are sites in a historic district that have historic merit of their own, were
indicated as being on the Inventory, but "non-contributing" properties, or sites which are
part of the area where character preservation is to occur but which have not been
determined to be historically significant themselves, were not named as being on the
Inventory. The Inventory was reviewed, ratified, and amended several times after 1986
and only included the contributing sites.

It was therefore consistent with previous practice when 308 E. Hopkins Avenue was
removed from the Inventory via Ordinance #6, Series of 2001 due to a finding that it did
not retain historic integrity and was no longer a contributing historic resource.
In 2002, the City adopted an entirely revised preservation ordinance. This ordinance
defined the term "Aspen Inventory of Historic Landmark Sites and Structures" as
follows:
Section 26.415.030.A. Establishment of the Aspen Inventory of Historic
Landmark Sites and Structures. The Aspen Inventory of Historic Landmarks Sites
and Structures has been established by City Council to formally recognize those
districts, buildings, structures, sites and objects located in Aspen that have special
significance to the United States, Colorado or Aspen history, architecture,
archaeology, engineering, or culture. The location of properties listed on the
Inventory are indicated on maps on file with the Community Development
Department.
Staff interprets this code section to mean that historic districts are included on the
"Aspen Inventory of Historic Landmark Sites and Structures." This finding is
reinforced by other language such as:
Section 26.415.030.C. The property owner(s), the Historic Preservation
Commission (HPC) or the City Council may file an application for designation of
a building, district, site, structure, or object on the Aspen Inventory of Historic
Landmark Sites and Structures. The application for the designation of a property
or collection ofproperties shall include the following...
The Community Development Department displays a map of designated properties.
The map depicts 308 E. Hopkins Avenue as being located with the Commercial Core
Historic District.
The Community Development Department also posts a list of the properties on the.
Inventory on our website. This list does not include all of the non-contributing
properties in the historic district, as should have been the case starting after the
adoption of the new preservation ordinance in 2002.
There is a process for the removal of a property from the Aspen Inventory of Historic
Landmark Sites and Structures at Section 26.415.050. While 308 E. Hopkins was
removed from the Inventory as it was defined at the time of de -listing, the
Commercial Core Historic District as a whole has not been removed from the
Inventory as it is defined today.
INTERPRETATION
Staff s interpretation is that 308 E. Hopkins Avenue is on the "Aspen Inventory of
Historic Sites and Structures" by virtue of its location within a historic district.

2. The provisions of Section 26.415.060 do not apply to the demolition of the
existing improvements on the property.
Section 26.104.100 defines a "Historic Overlay District."
Historic Overlay District, "H." An area or site designated and regulated for its
historic architecture importance under Chapter 26.415 of this title.
Properties in the historic district are subject to Chapter 26.415.
Section 26.415.060 describes the effect of designation.
26.415.060 Effect of designation.
A. Approvals required. Any development involving properties designated on the
Aspen Inventory of Historic Landmark Sites and Structures, as an individual
building or located in a historic district, unless determined exempt, requires the
approval of a Development Order and either a Certificate of No Negative Effect
or a Certificate of Appropriateness before a building permit or any other work
authorization will be issued by the city.
This code section requires all development located in a historic district to receive a
Development Order and approval either in the form of a "Certificate of No Negative
Effect," granted by staff, or a "Certificate of Appropriateness," granted by HPC. A
Development Order is defined in Section 26.104.100 as follows:
Development order. A written authorization issued pursuant to the terms of this
Title to undertake development according to an approved site specific
development plan. (See Common Development Review Procedures —section
26.304.070 Development Orders.)
Section 26.304.070, cited in the above definition, notes that a Development Order is
published after final approval of all necessary reviews.
26.304.070 Development orders.
A. Publication of development approval. No later than fourteen (14) days following
final approval of all requisite reviews necessary to obtain a development order as set
forth in this title, the City Clerk shall cause to be published in a newspaper of general
circulation within the jurisdictional boundaries of the City of Aspen, a notice advising
the general public of the approval of a site specific development plan and creation of
a vested property right pursuant to this Title. Such notice shall be substantially in the
following form:
Notice is hereby given to the general public of the approval of a site specific
development plan, and the creation of a vested property right pursuant to the Land
Use Code of the City of Aspen and Title 24, Article 68, Colorado Revised Statutes,
pertaining to the following described property: [parcel address and legal

description], by [ordinance or resolution] of the [City Council or other appropriate
decision making body], numbered: [enter ordinance or resolution number].
INTERPRETATION: 308 E. Hopkins Avenue requires a number of reviews, some of
which have not yet been completed. It is correct that demolition is not the sort of work
reviewed for a ""Certificate of No Negative Effect" or a "Certificate of Appropriateness,"
however, demolition involving designated properties does require a Development Order,
which has not been issued. Therefore, 26.415.060 Effect of designation does apply to
demolition of existing improvements on the property.
3. The provisions of 26.415.080 are inapplicable to the request for a building permit
for demolition of 308 E. Hopkins and a permit should issue.
26.415.080 Demolition of designated historic properties.
It is the intent of this chapter to preserve the historic and architectural resources
that have demonstrated significance to the community. Consequently no
demolition of properties designated on the Aspen Inventory of Historic Landmark
Sites and Structures will be allowed unless approved by the HPC in accordance
with the standards set forth in this section.
INTEPRETATION: It has been noted above that the historic district is included
within the definition of the "Aspen Inventory of Historic Sites and Structures,
therefore this section is applicable. HPC has approved demolition as part of the
Conceptual level review of the project, however there are still review steps remaining
before a Development Order is issued and a permit can be submitted.
APPEAL OF DECISION
Any person with a right to appeal an adverse decision or determination shall initiate an
appeal by filing a notice of appeal on a form prescribed by the Community Development
Director. The notice of appeal shall be filed with the Community Development Director
and with the City office or department rendering the decision or determination within
fourteen (14) days of the date of the decision or determination being appealed. Failure to
file such notice of appeal within the prescribed time shall constitute a waiver of any
rights under this Title to appeal any decision or determination.

Dear Chris:
This letter shall constitute a Request for Interpretation made pursuant to 26.210.02013.5 of the City of
Aspen Land Use Code determining that the Property is not on the "Inventory of Historic Sites and Structures"
within the City of Aspen, ("Inventory"), further determining that the provisions of Section 26.415.060 do not
apply to the demolition of the existing improvements on the Property (the former "La Cocina" Restaurant),
further determining that the provisions of 26.415.080 are inapplicable to the request of JW Ventures, LLC for a
building permit for demolition of the now vacant existing improvements on the Property and that a building
permit should issue for the demolition thereof.
Attached hereto is:
1. A copy of a letter from me addressed to Amy Guthrie and John Worcester, Esq. dated December 19,
2006 and hand delivered with attachments.
2. A copy of Resolution No. 6, Series of 2001 of the Historic Preservation Commission of the City of
Aspen, which specifically removed the Property from the Inventory.
3. Amy Guthrie's January 3, 2007 reply to my December 19, 2006 letter.
No specific definition of either "Development or Demolition" is contained in 26.415.020 or the other
subsections of 26.415. In 26.104.100 (the general definitions section of the Land Use Code) there are
definitions for both. However, "Demolition" means razing, disassembling, tearing down or destroying of an
existing structure "prior to commencing development" emphasis added. This is irreconcilably inconsistent

with the definition of "Development" in that subsection. While 26.415.060 addresses properties on the
Designated Inventory of Historic Sites and Structures or properties within historic districts in the City of Aspen,
26.415.080 dealing with demolition applies only to properties on the Designated Inventory of Sites and
Structures. The Property was removed from the Inventory in 2001.
Also, enclosed is the $50.00 application fee required for a Request for Interpretation by the City.
It is the position of the Property owner, JW Ventures, LLC, that its application for a building permit to
demolish the improvements on the Property was timely filed, illegally and improperly rejected by the City of
Aspen Building Department at the specific direction of Amy Guthrie, that the same should have been accepted
on the date the same was tendered to and rejected by the City of Aspen Building Department and a demolition
permit issued thereon authorizing the demolition of the improvements on the Property.

Dear Lennie;
It appears that we are in disagreement regarding the purview of the Aspen Historic
Preservation Commission over the review of demolition applications for "non-
contributing" buildings within the Commercial Core Historic District.
We have previously discussed both the "Aspen Inventory of Historic Landmark Sites and
Structures and Historic Districts" map, which depicts 308 E. Hopkins within the historic
district, and we have discussed Section 26.415.030 of the Aspen Municipal Code, which
states that the Inventory shall include districts designated by Aspen City Council.
Properties listed on the Inventory are subject to the provisions of the Chapter 26.415 as a
whole.
In addition to the above citations, Section 26.415.060 states that "Any development
involving properties designated on the Aspen Inventory of Historic Landmark Sites and
Structures, as an individual building or located in a historic district, unless determined
exempt, requires the approval of a Development Order and either a Certificate of No
Negative Effect or a Certificate of Appropriateness before a building permit or any other
work authorization will be issued by the City." The proposed project at 308 E. Hopkins
Avenue has not been issued a Development Order or a Certificate of Appropriateness at
this time and work cannot commence. The property will also be subject to Ordinance
#51, Series of 2006 (a prohibition on most building permits in the Commercial Core)
until said ordinance expires.
308 E. Hopkins is scheduled for Growth Management Review before the Planning and
Zoning Commission on April 17th. We have not received any information related to
submission of an HPC Final Review application, but would be happy to schedule that
hearing as soon as complete materials are provided.

Dear John and Amy:
John, Amy did give me a call back at your request. Based on that conversation, I still do not have a
satisfactory answer to my question. Amy referred me to a GIS map entitled "Aspen Inventory of Landmark
Sites and Historic Districts" (last updated: September 10, 2004) ("Map"). I have a copy of the Map and have
reviewed it. While it is undisputed that the La Cocina property is within the Commercial Core Historic District,
the La Cocina property is not shown on the Map as a Landmark Historic Site or Structure.
Attached to this e-mail is the City of Aspen "The Aspen Inventory of Historic Landmark Sites and
Structures" (Updated: July 2003). The La Cocina property which is 308 E. Hopkins Avenue is not contained on
the Inventory. La Cocina was specifically delisted by Resolution No. 6 (2001) of the HPC.
In answer to my inquiry, I still do not understand on what basis there can be for an interpretation that the
La Cocina is on "The Aspen Inventory of Historic Landmark Sites and Structures" and therefore, subject to the
demolition requirements contained in 26.415.080 of the Aspen Municipal Code when it clearly does not appear
on that Map or Inventory. It would appear that Amy is attempting general application of the Inventory to all
properties within the Commercial Core Historic District. What is the legal basis and documentation upon which
the City, through Amy, relies in making such an application?
JW Ventures, LLC applied for a demolition permit prior to the December 2006 moratorium. That
application was not accepted for tiling on Amy's instructions.

We believe the unwillingness to accept the application was improper. We expect a full explanation on
sound footing to make an informed decision or a decision that JW Ventures' application should be accepted as
of a date prior to the moratorium adopted in early December and a permit for demolition issued thereon. We
believe HPC's review of demolition as a part of the recent conceptual review for redevelopment of the La
Cocina property, was unnecessary and in error, in the context of 26.415.080.

RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION TO
REMOVE THE LA CACINA RESTAURANT, LOCATED AT 308 EAST HOPKINS
AVENUE, LOTS M AND N, BLOCK 80, CITY AND TOWNSITE OF ASPEN,
FROM THE INVENTORY OF HISTORIC SITES AND STRUCTURES

WHEREAS, the Community Development Department has conducted an
evaluation of the City of Aspen "Inventory of Historic Sites and Structures" to identify
any properties which should be removed from the inventory due to loss of integrity, to
nominate any sites which should be added to the inventory, and to rate the resources using
the terms "significant," "contributing," and "supporting;" and
WHEREAS, the Community Development Department has forwarded a
recommendation to the Historic Preservation Commission; and
WHEREAS, Section 26.420.080 of the Land Use Code provides guidance on
evaluation of the inventory. According to that passage, the Inventory shall include all
structures in the City of Aspen which are at least fifty (50) years old and which continue
to have historic value, and such other structures identified by the Historic Preservation
Commission as being outstanding examples of more modern architecture; and
WHEREAS, Section 26.420.080 of the Land Use Code also requires that all
structures on the inventory be evaluated by the Historic Preservation Commission regarding
their current architectural integrity, historic significance, and community and neighborhood
influence and be categorized as "significant," "contributing," or "supporting;" and
WHEREAS, Staff provided the Historic Preservation Commission with the
Community Development Department's recommendations regarding 308 East Hopkins
Avenue, a property currently listed on the inventory; and - -
WHEREAS, at a regular meeting on February 14`h, 2001, the Historic
Preservation Commission considered the staff recommendation, and approved this
resolution by a vote of four to two, (4 to 2) to remove 308 East Hopkins Avenue from
Aspen's Inventory of Sites and Structures finding that the structure does not meet the
review criteria pursuant to Section 26.420.080.
NOW, THEREFORE, BE IT RESOLVED:
That the HPC finds that the standards and review criteria established in Section 26.420.080
of the Land Use Code are not met and that 308 East Hopkins Avenue, Lots M and N, Block
80, City and Townsite of Aspen, shall be removed from the "Inventory of Historic Sites and
Structures.
APPROVED BY THE COMMISSION at its regular meeting on the 14th day of
February, 2001.
