The applicant wishes to alter the approved landscaping plan for Open Space Parcel 9 as is represented in Exhibit B. Stephen Ellsperman, Natural Resources and Construction Manager for the City of Aspen has approved the attached landscaping plan that is depicted in Exhibit B. The trees are all native and are required to be placed at least fifteen feet apart by Stephen Ellsperman. Staff finds the proposed amendment to the landscaping plan to be minor in nature and will not alter the character of the development significantly. A minor amendment to the Moore family PUD may be approved by the Community Development Director if it meets the following criteria set forth in Ordinance 24, series of 1999: a. The amendment must be a clarification of technical amendment to a plat. b. The amendment must not change the use of the proposed development between residential, commercial and tourist accomodation uses. c. The amendment must be consistent with action taken during the review of the original development and does not constitute new land development activity. d. The proposed activity does not: 1. Change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation; 2. Increase off -site impacts in the surrounding neighborhood; 3. Endanger public health, safety or welfare; 4. Substantially increase the need for on -site parking or utilities, or affect affordable housing generation; and 5. Increase the floor are of the use by more than two (2) percent or decrease open space on the site by more than three (3) percent. Community Development staff recommends approval of the requested Insubstantial Amendment to the Moore Family Planned Unit Development to allow for an amendment to the landscaping plan for Open Space Parcel 9 as proposed in Exhibit B. WHEREAS, on March 29, 1999, the City Manager of the City of Aspen, on behalf of the City of Aspen, the James E. Moore Family Partnership, LLLP, Mark B Whitson, the Astri Corporation, Thomas H. Bailey, Robert M. and Nancy L. Beevers, the Zoom Flume LLC, Kevin L. That the tract of land described in the Petition for Annexation, commonly referred to as the "Moore Family PUD", and as shown on the annexation map, is hereby annexed to the City of Aspen, Colorado. The amendment must be a clarification or a technical correction to a plat. b. The amendment must not change the use of the proposed development between residential, commercial and tourist accommodation uses. C. The amendment must be consistent with action taken during the review of the original development and does not constitute new land development activity. d. The proposed activity does not: i. Change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation; ii. Increase off -site impacts in the surrounding neighborhood; iii. Endanger public health, safety or welfare; iv. Substantially increase the need for on -site parking or utilities, or affect affordable housing generation; and V. Colorado Blue Spruce is not desired in this area. Ponderosa Pine or Douglas Fir will be the only conifers for this area. - There is no irrigation plan shown on the proposal. An irrigation system to this system of trees must be in place and a plan for one must be submitted. - There is no seeding or restoration plan with the proposal. Zoom Flume LLC, is the successor in title to the James E. Moore Family Partnership and the ("developer") of the Moore Family PUD. Attachment 1, vicinity map, (Moore PUD Final Plat page 3/9) shows that the Moore PUD is located on south and east of Maroon Creek Road near the Aspen schools. The Moore PUD is bordered by the Meadowood Subdivision to the east. The applicant is seeking a minor PUD amendment to add landscaping in Open Space Parcel 1. Attachment 2, Moore Family PUD Final Plat page 4/9, depicts the location of Open Space Area 1. Open Space Area 1 is a 6.1 acre +/- panhandle shaped parcel which serves as a restricted open space buffer between Block A, and Lots 1 and 2 Parcel A. Lot 1 Parcel A is the location of athletic fields owned by the City of Aspen. Lot 2 Parcel A is restricted open space. Block A is improved with seven affordable housing units accessed by Bus Barn Lane. This insubstantial PUD amendment application seeks City of Aspen approval to landscape the northwest end of Open Space Area 1. Attachment 3 depicts the proposed landscape plan. The plan shows the existing land form located north of Lot 27e will be extended approximately 100 feet to the northwest. The land form will be landscaped with native grasses, aspen trees, ponderosa pines and colorado spruce. Attachment 3 shows that the proposed landscaping is consistent with the landscaping which has been completed on High School Road and the landscaping proposed for the Bus Barn Lane area which will be planted this spring. This application is being submitted pursuant to City of Aspen Ordinance NO. 24 Series of 1999, an ordinance which annexed the Moore Family PUD and established a procedure for the City of Aspen Community Development Director to approve minor PUD amendments (see Attachment 4). LAND USE APPROVALS On June 28, 1999 the City of Aspen approved Ordinance No. 24 Series of 1999 which approved a procedure and standards for minor PUD amendments to the Moore Family PUD (see Attachment 4).
