West End Street, Unit 1, Aspen, Colorado 81611 COLORADO ASBESTOS REGULATIONS SUMMARY: Colorado State Regulation 8 requires a State-certified Asbestos Building Inspector to inspect and sample for suspect asbestos containing materials (ACM) or suspect asbestos containing building materials (ACBM) prior to the disturbance, removal or demolition. In residential buildings of four or fewer units if more than 32 square feet of any surface coverage (e.g., gypsum wallboard or drywall and associated applied surfacing materials/textures, acoustic sprays, joint compounds, plaster, etc.), 50 feet of asbestos covered or asbestos insulated pipe or any material which would fill a 55-gallon drum—if these materials are going to be disturbed or removed—an asbestos inspection is required by a state certified asbestos building inspector. For buildings with more than four residential units (considered public), including commercial, public (including public access areas to a residential building), civic or industrial buildings, if more than 160 square feet of surfacing materials, 260 linear feet or more than 35 cubic feet of suspect ACM/ACBM is going to be disturbed, an asbestos inspection is required under NESHAP. City of Aspen Received 03/24/17 Building Department 2 County or City regulations may be more stringent. The regulations require an absolute minimum of 3 samples (EPA suggests 9) per homogenous suspect surfacing and TSI materials and an absolute minimum of 1 sample of homogenous miscellaneous materials or any number of “samples sufficient to determine whether a material is ACM” (Reg8.IV.D.3). More samples are required based on surface area or volume. For the contractor to proceed with disturbance, demolition, restoration or remodel/renovation the suspect materials have to be sampled and analyzed by a NVLAP accredited laboratory by polarized light microscopy (PLM) methods. OSHA compliance is required for all employers/employees no matter the quantity of asbestos present. CLIENT BACKGROUND: Forum Phi, LLC. hired HealthSafe Inspections, Inc. (hereinafter, HealthSafe) on behalf of the property owner and Client, Rob Andy, to perform an asbestos building inspection, bulk sampling and report for a complete interior gut of the townhome down to the structural framing and joists. This report includes a complete demolition of the interior finishing materials and it excludes all exterior materials. VISUAL INSPECTION & LABORATORY FINDINGS: An inspection was conducted by Jim Baker of HealthSafe on Thursday, March 16, 2017 with Ryan Lee of Forum Phi, LLC. present during the initial survey prior to the inspection. Suspect ACM/ACBM (drywall and sheet vinyl flooring materials only) were identified and sampled. Those materials are the following: 1. A kitchen sheet vinyl flooring [KIT-V], a homogeneous miscellaneous material requiring at least one sample. The PLM analytical estimated results: NONE DETECTED. 2. A homogeneous taped and joint compounded drywall system (classified as a miscellaneous material as a complete integral system) [FLT-J-1,2,3 and ST-FLR- 1-STRS-J]; these composite layered taped and joint compounded drywall materials are on ceilings and walls of the entire townhome interior with and without a surfacing material/texture (in certain portions, a skip-trowel was applied over the original flat, non-textured gypsum wallboard or drywall system. The estimated surface area is more than 3,000 sf, but less than 5,000 sf, requiring a minimum of at least two composite core samples of all drywall layers (“…number of samples sufficient to determine” …if asbestos is present or not). One sample was taken from the ground floor living-dining area, the twin bedroom closet and the second-floor laundry; the sample with skip-trowel texture was taken from the seating area on the second floor near the round window. The PLM analytical estimated results: NONE DETECTED. 3. A homogeneous trowel-applied surfacing material/texture (“skip-trowel”) [ST- FLR-1-STRS-T-1,2,3,4,5]. This surfacing material/texture is on ceilings and walls of the 1st ground floor (with the exception of the twin NE bedroom an closets) and the stairwell. The estimated surface area is more than 1,000 sf, but City of Aspen Received 03/24/17 Building Department 3 less than 3,000 sf, requiring a minimum of at least five surfacing/texture material samples. The PLM analytical estimated results: NONE DETECTED. There were no other additional suspect asbestos building materials to sample which were slated to be disturbed, removed or disposed of in this interior gut remodel/renovation. A total of 10 suspect homogeneous ACM/ACBM bulk samples were collected and 10 samples were analyzed. The bulk samples were analyzed by PLM by a NVLAP accredited laboratory in accordance with Colorado State Regulation 8 for the presence of asbestos mineral fibers. There is NO asbestos in all 10 samples analyzed. See supporting Hayes Microbial Consulting, Inc. data report #17006953. HEALTHSAFE CONCLUSIONS: There is NO asbestos in any of the suspect building materials slated to be impacted by the interior gut remodel/renovation project. NO asbestos abatement will be required. All building materials needing to be removed or disturbed can be dealt with without the concerns for asbestos fibers. All building waste and debris can be disposed of in any landfill which accepts normal, non-hazardous building waste.
