Vos Caudill, Pitkin County, CO RESOLUTION No. 10 (SERIES OF 2014) A RESOLUTION OF THE CITY OF ASPEN PLANNING AND ZONING COMMISSION APPROVING A VARIANCE FROM A RESIDENTIAL DESIGN STANDARD FOR LOT 1 OF THE EAST MEADOWS SUBDIVISION, COMMONLY KNOWN AS 320 MIDLAND AVENUE, CITY OF ASPEN, COLORADO. Parcel Identification Number: 2737-181-06-001 WHEREAS, HTM Properties, LLC submitted a request for a Residential Design Standard Variance to the Planning and Zoning Commission; and WHEREAS, the property is located in the Moderate-Density Residential (R-15A) zone district; and WHEREAS, upon initial review of the application and the applicable code standards, the Community Development Department recommended denial of the Residential Design Standard Variance; and WHEREAS, during a regular meeting on July 15, 2014, the Planning and Zoning Commission opened a duly noticed public hearing to consider the project; and WHEREAS, the Aspen Planning and Zoning Commission, upon review and consideration of the recommendation of the Community Development Department, presentation from the Applicant, and consideration of the proposal, approves the review as outlined in this resolution; and, WHEREAS, the Aspen Planning and Zoning Commission finds that the development proposal meets all applicable development standards to meet the criteria for granting a Residential Design Standard Variance, per Land Use Code Section 26.410.020.D.2.a, and approves this application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ASPEN PLANNING AND ZONING COMMISSION AS FOLLOWS: Section 1 The Planning and Zoning Commission approves the request for a variance from the Residential Design Standard found at Section 26.410.040.13 — Build-to lines, which states, "On parcels or lots of less than fifteen thousand (15,000) square feet, at least sixty percent (60%) of the front fagade shall be within five (5) feet of the minimum front yard setback line..." The variance will permit the Applicant to locate only approximately twenty-six percent (26%) of the front fagade within five feet (5') of the required front yard setback line, as reflected in Exhibit A. 1 Section 2• This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 3• If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
