Willow Court Building Envelope Adjustment - Insubstantial PUD Amendment DATE: August 1,2001 APPLICANT: Tiehack Development, represented by jeff Davis of Richard Wax & Associates, LLC LOCATION: Lot 23 Maroon Creek Club (81 North Willow Creek) REVIEW PROCEDURE: The Community Development Director, pursuant to Section 26.445.100, may approve insubstantial amendments to an approved PUD. SUMMARY: Tiehack Development, represented by jeff Davis of Richard Wax & Associates, LLC, has applied for an Insubstantial Amendment to an approved Maroon Creek Club PUD, specifically Lot 23, to allow for the building envelope to be adjusted, accommodating a construction error. The applicant is only requesting to have the proposed amendment apply to Lot 23, 81 N. Willow Court. There are three areas of the home that require the building envelope to be augmented. 1. Southeast corner of the chimney 2. West side of the top deck 3. Southwest corner of the top deck STAFF FINDINGS: The three elements listed above have already been constructed. No square footage will be lost or gained regarding this building envelope adjustment. Staff finds that 117 SF of the building envelope will be reduced from the northwest (front portion of house) and 49 SF will be reduced from the northern most corner of building envelope. The reduction will total 166 SF to accommodate the 166 SF that will be needed to adjust for the 3 areas mentioned above. See Attachment A A letter from Jeff Davis of Richard Wax & Associates, LLC has been provided to further explain the construction error and the reason for this PUD Amendment request. See Attachment B 1 , The insubstantial PUD Amendment checklist is attached as Exhibit C. Staff finds that all of the review criteria have been met. As a condition of approval, the amended plat shall be recorded to reflect the above change. RECOMMENDATION: Staff recommends the Community Development Director approve this Insubstantial PUD Amendment to allow for the adjustment of the building envelope for Lot 23 located at 81 N. Willow Court of the Maroon Creek Club Subdivision and PUD, finding that all of the review criteria per Section 26.445.100, of the Aspen Land Use Code, have been met, with the condition stated below. APPROVAL: I hereby approve this Insubstantial Amendment to the Maroon Creek Club PUD for the adjustment of the building envelope for Lot 23, as proposed, with the following condition: 1. There are three areas of the home that require the building envelope to be augmented. 1. Southeast corner ofthe chimney 2. West side ofthe top deck 3. Southwest corner of the top deck (triangular shape) As was explained to you during our pre-ap meeting on July 6,2001, we are at a disadvantage when it comes to locating the building envelopes on properties at the Maroon Creek Club because of the lack of dimensions and definition of the building envelope on the final plat map. The surveyor is forced to have to scale in the building envelope location from the final plat map. The final plat map has a very small scale of 1"=100'. This scale is cause for some discrepancy between the house location and the building envelope location. We request a plat amendment for Item #3 above because of our error. As general contractor we made an unfortunate error in locating the edge of the top deck. The total of the top deck that is outside the building envelope is 32 sq.ft. Your attention to this and your approval of such is much appreciated.
