Francis, Jake Vickery Case #96-02, Kirianoff Minutes 4 NOTICE OF PUBLIC HEARING CASE #96-07 Before the City of Aspen Board of Adjustment TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the BASEMENT MEETING ROOM, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 26, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. Temporary Relocation Variance The applicant is seeking a temporary relocation variance to move and temporarily set an historic cottage in a position to permit the excavation for and construction of a competent foundation and basement for the historical resource and addition. The applicant has obtained approvals from the HPC to split the fathering parcel into two lots indicated on the attached plat as Lot A and Lot B. The historical cottage currently straddles this new lot split property line. Please see the attached survey. As per HPC approvals, the historical cottage shall be permanently relocated to either Lot A or Lot B. Please see attached proposed site plans. The applicant has also received HPC approval for the partial demolition work associated with this relocation. Please see the attached temporary relocation and demolition site plan. In order to accomplish this move and to excavate and provide a competent foundation and basement for the historical cottage, it is necessary to temporarily set the cottage in a position which will not interfere with this construction. There are three potential alternative locations proposed. They are indicated as "Location A", "Location A2", and "Location B" on the attached demolition and temporary relocation site plan. The applicant is negotiating with a buyer for the sale of either of the these lots. The buyer has not determined which of these lots they will buy. The final choice of temporary location will be determined by the buyer's selection of lot and the conditions of this sale. The applicant is hopeful of having a final determined as to location site prior to the meeting for this variance. A brief explanation of the three locations is as follows: LOCATION A: If the historical cottage is to be permanently relocated to Lot B, it will be temporarily located at this location. This location is within the legal setbacks on this lot. LOCATION B: If the historical cottage is to be permanently located to Lot A, it will be temporarily located at this location. This location is within the legal setbacks on this lot. LOCATION A2: If the historical cottage is to be permanently located to Lot A and. if for some reason (such as simultaneous construction on Lot B) can not be feasibly located on Lot B, it will be located in this location. This location meets legal sideyard setbacks but does not meet the minimum rear yard setback. The historical cottage needs to be pulled this far to the rear of the site to best accommodate excavation and foundation construction on the front of the site. Under any circumstances the temporary relocation of the historical cottage will be for no more that 4 months from the start of construction. The applicant is in the process of applying for a building permit for this partial demolition and relocation work. A full building permit application is also in preparation. The proposed temporary relocation is necessary to do this foundation work, there is no other more feasible way to accomplish this work, and it will have a minimal disruption of normal neighborhood activities. Since the sale of a portion of this property is anticipated, this approval and any conditions of this approval shall be contractually incorporated into any such transaction and shall apply to the new buyers, their successors and assigns.
