HomeMy WebLinkAboutresolution.council.121-22RESOLUTION NO. 121 SERIES OF 2022 A RESOLUTION OF THE CITY OF ASPEN CITY COUNCIL IN SUPPORT OF CITY OF ASPEN BALLOT MEASURE 2A ESTABLISHING A TAX ON SHORT-TERM RENTALS WHEREAS, the City of Aspen (the "City") is a legally and regularly created, established, organized and existing municipal corporation under the provisions of Article XX of the Constitution of the State of Colorado and the home rule charter of the City (the "Charter"); and, WHEREAS, the City of Aspen currently regulates land uses within the City limits in accordance with Chapter 26.104 et seq. of the Aspen Municipal Code pursuant to its Home Rule Constitutional authority and the Local Government Land Use Control Enabling Act of 1974, as amended, §§29-20-101, et seq. C.R.S; and, WHEREAS, Aspen is a tourists destination, attracting tens of thousands of visitors a year in all seasons, visitors which require transient tourist accommodations and participate in and support Aspen's tourist economy; and, WHEREAS, a variety of tourist accommodations at varied sizes, quality, and price points is essential to supporting the City's tourist economy; and, WHEREAS, a tourist -based economy such as the City's requires a sufficient number of employees to provide the services required to serve such an economy. Without adequate workforce housing, altourist-based economy cannot thrive; and, WHEREAS, to allow for a sufficient number of employees to be hired to provide the services necessary to sustain a tourist -based economy there must be an adequate supply of workforce housing; and, WHEREAS, in addition to the required workforce housing, it is also essential to the continued vitality of the City's economy that adequate short-term housing be made available to the many tourists who visit the City each year; and, WHEREAS, short-term rentals are extremely valuable to the City's economy and exist in various locations throughout the City; and, WHEREAS, the operation of a short-term rental in the City is the operation of a business; and, WHEREAS, without regulations and limitations on their operation and extent, short-term rentals also have adverse impacts on the character of residential neighborhoods and the availability of long-term housing options; and, Resolution No. 121, Series of 2022 Resolution in Support of Ballot Measure 2A, City of Aspen Short -Term Rental Tax Page 1 of 2 WHEREAS, the tourist economy, like all economic sectors and activities, creates impacts to the City's natural environment and infrastructure; and, WHEREAS, such direct and indirect impacts to the natural environment include but are not limited to impacts to the health and welfare of wildlife, consumption of natural resources, air and water pollution, land degradation from development; and, WHEREAS, such direct and indirect impacts to community infrastructure include but are not limited to degradation of pedestrian, transportation, and transit infrastructure, degradation of utilities infrastructure, trails and open spaces; and, WHEREAS, in keeping with the goal of the Aspen Area Community Plan to support a diverse, sustainable economy, preserve the natural environment, and preserve small town character while maintaining livability, the City desires to minimize the adverse effects of short-term rentals on residential neighborhoods and the supply of housing in the City; and, WHEREAS, a tax on short-term rentals, as defined in ballot measure 2A will provide funds to the community in proportion to the scale and community costs of the negative impacts created by the short-term rental industry; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN AS FOLLOWS: The Aspen City Council hereby proclaims its support for the passage of City Ballot Question 2A to sustain our resort economies workforce needs, sense of community, culture and residential neighborhood cohesion, and encourages the participation of all the voters of Aspen to Vote Yes on Nov 8t" 2022 on City Ballot 2A.
