A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION (HPC)
PROVIDING SUPPORT FOR LAND USE CODE AMENDMENTS AFFECTING
REVIEW OF CERTAIN AFFORDABLE HOUSING PROJECTS UNDER HPC'S
PURVIEW
WHEREAS, in December 2021, Aspen City Council established a temporary moratorium on the
acceptance of any new land use application seeking a development order or notice of approval,
and on the acceptance of certain building permit applications for all residential uses in all zone
districts within the city; and declaring an emergency; and,
WHEREAS, one of Council's directives during the moratorium was for staff to pursue
amendments of the Land Use Code to "support the development of more affordable housing in
Aspen" and "Align land use review processes with community development needs, including
affordable housing, and the mitigation of the community impacts from free-market
development" among other objectives; and,
WHEREAS, in response to Council direction Community Development evaluated the review
process for certain affordable housing projects that are subject to review by the Historic
Preservation Commission. Staff authored proposed code amendments which would allow
Administrative approval of some aspects of an affordable housing development, while leaving
decisions that are singularly historic preservation matters to the discretion of the board; and,
WHEREAS, on June 2, 2022, HPC held a special meeting to comment on the proposed code
amendments and to provide feedback for staff to forward to City Council. HPC supported the
draft code amendments, with specific revisions documented in the meeting minutes, by a vote
of 6-0.
NOW, THEREFORE, BE IT RESOLVED:
That HPC hereby supports Council adoption of code amendments affecting the land use review
process for certain affordable housing developments under their purview.
