BACKGROUND:
The applicant requests an exemption for 8040 Greenline Review for construction of a
snowmaking feed line located at the base of Aspen Highlands Village and existing
easements within Moore Family Subdivision,based on Chapter 26.435.030(B)Exemption.
SUMMARY:
The applicant proposes to install a new snowmaking feed line along a new alignment. The
snowmaking line will be constructed within the 10' Raw Water Line Easement and the 30'
Water Easement as shown in Exhibit A. These easements also coincide with the Common
Ski Easement where a Nordic trail is located. The location of the snowmaking line within
the Nordic trail was coordinated with City Parks and the applicant will improve the grade
and vegetation of the trail.

STAFF EVALUATION:
In Chapter 26.435.030 (B), Exemption, development above the 8040 Greenline may be
exempted from review by the Community Development Director if the development is:
1. The development does not add more than ten percent (10%) to the floor area of the
existing structure or increase the total amount of square footage of areas of the structure
which are exempt from floor area calculations by more than twenty-five percent (25%);
and
2. The development does not require the removal of any tree for which a permit would be
required pursuant to Section 15.04.450 or the applicant receives a permit pursuant to said
Section; and
3. The development is located such that it is not affected by any geologic hazard and will
not result in increased erosion and sedimentation.
4. All exemptions are cumulative. Once a development reaches the totals specified in
Subsection 26.435.030.B.1, an 8040 Greenline review must be obtained pursuant to
Subsection 26.435.030.C.
The development does not add any additional floor area. The applicant consulted with City
Parks Staff and the project will not require a tree removal permit. Additionally, the
proposed alignment will improve the existing Nordic trail as discussed with Parks. There
is no known geologic hazard at the project location nor will the project result in increased
erosion or sedimentation; conversely,the project will be required to revegetate the existing
Nordic trail resulting in an improvement to existing conditions. The project will not result
in an increase in floor area; therefore, Criteria 4 does not apply.
The snowmaking line will be fed with untreated, also known as raw, water. Water lines as
platted are treated, potable drinking water. Coordination with City Utilities to protect the
line is required. Because the project will utilize the existing 30' Water Line Easement in
addition to the 10' Raw Water Easement; an amendment to the plat will be required to
show the shared use of both potable water and raw water within a shared easement. As-
built drawings will be required to be submitted to City Utilities upon completion of the
project.
The Moore Family plat will be amended upon completion of the project. This amendment
will be reviewed in a separate process.

DECISION:
The Community Development Director finds the project to be consistent with
Chapter 26.4325.030(B)8040 Greenline Review Exemptions noted above and thereby,
APPROVES the request.

REQUEST: 8040 Greenline Exemption
Planned Development- Insubstantial Amendment
DESCRIPTION:
The applicant seeks to replace an existing snowmaking line within
a new alignment. The present location of the existing snowmaking
line is unknown. A new alignment has been coordinated with the
City Parks Department along the Nordic trail to minimize impacts
to trees and the project will not require a tree removal permit. The
new alignment is located within Aspen Highlands Village, Moore
Family PUD and unincorporated Pitkin County.
The alignment is proposed within City utility easements, a
dedicated raw water easement, and a common ski easement
within the Moore Family/Five Trees Subdivision. The Moore
Family PUD has received prior approvals for development above
the 8040 Greenline; however, because the project is within a new
alignment and considered to be a new use within the area, an
8040 Greenline Exemption is required. The 8040 Greenline
Exemption cannot be processed until permission to use the City
utility easement is granted by the City Utility Department.
Aspen Highlands
The 8040 Greenline Review will be administratively processed by REPLACEMENT PRO PIPE
Staff and no additional action of the applicant for this land use Asc 6'30114
approval is required at this time.
Upon completion of the project, the applicant will be required to amend the plat of the Moore Family PUD to memorialize the
location of the new alignment. A portion of the pipe is located in Five Trees/ Moore Family PUD and a PD (formally PUD)
amendment approval is required to modify the plat and memorialize the utility easement change. Approval to apply for the
amendment shall be provided by the Homeowner's Association.

demonstrating the owner's right to apply for the Development Application.

address and telephone number of the representative authorized to act on behalf of the applicant.

❑ A site improvement survey (no older than a year from submittal) including topography and vegetation showing
the current status of the parcel certified by a registered land surveyor by licensed in the State of Colorado.

Transportation Impact Analysis Guidelines and Mitigation Tool, available online at:
