The current structure exceeds allowable floor area; the existing deck exceeds the deck exemption allowance. Building code requires that the applicant increase this non-conformity to extend existing handrails 1'-0" per IBC 1014.6. The applicant is requesting an exemption to the floor area limitations established in Section 26.575.020(d) and Section 26.710.190 of the Aspen Land Use Code. The architect, KA Designworks, has submitted documentation supporting the request for an exemption.The exterior scope of work in question includes the following items: • Increasing non-conforming deck area by 30 square feet to comply with building code requirements The applicant is requesting relief from the review standards listed above based on Section 26.575.020.K, Exceptions for Building Code Compliance, in the Land Use Code. This section of the Code allows the Community Development Director to approve exemptions to dimensional standards within the Land use Code if the review criteria can be met: a) The exemptions are needed to accommodate improvement required to achieve building, fire, or accessibility code in or on existing buildings when no other practical solution exists, and b) The visual impact of the exemption is minimal, and c) No other reasonable way to implement code compliance exists The scope of work identified above is therefore approved. This approval does not constitute a site-specific development plan and will not be issued a development order. The approval does not convey a vested right and the approved project is subject to any changes to the Land Use Code prior to building permit submittal.
