SUMMARY:
This administrative determination clarifies the zoning of 1000 Matchless Dr., a.k.a. Smuggler
Racquet Club. The administrative determination was initiated by Chris Bendon, Community
Development Director, to address the property that does not have a designated zone district on the
current City zoning map.
BACKGROUND:
1000 Matchless Drive, a.k.a. Smuggler Racquet Club, does not have a designated zone district
according to the Official Zone District Map of the City of Aspen. City of Aspen annexation history
was reviewed to determine when the property became a part of the City. Staff found the property
was annexed in 1956 as part of the Hughes Addition as shown in the Hughes Addition Plat,Exhibit

A. The relationship between the Hughes Addition and the current location of the Smuggler Racquet
Club are better detailed in the Smuggler Racquet Location Map, Exhibit B.
Historic zoning maps were reviewed to determine if the property was zoned. The 1967 Zoning
District Map—City of Aspen, amended 1968 (Exhibit C) does not depict the area currently known
as the Smuggler Racquet Club with a zone district; however, the following note is present on the
map: Note: Any incorporated territory, other than public right-of-way, whereon the zone district
is not indicated by symbol, shall be subject to the most restrictive adjacent zone district regulation.
The only, and most restrictive, adjacent zone district is R-15, Residential. The property is not
shown as being within Aspen City Limits.
DETERMINATION:
The Hughes Addition was annexed into the City in 1956. While the Hughes Addition was not
shown with the city limits on the 1968 Zoning Map, the addition, including the area presently
known as the Smuggler Racquet Club,was within the City of Aspen. The note on the 1967 zoning
map states the most restrictive adjacent zone district shall apply to any incorporated area that does
not have a symbol indicating the zone district. The only adjacent zone district shown on the 1967
map was R-15. Therefore, 1000 Matchless Drive, a.k.a Smuggler Racquet Club, is currently zoned
R-15, Moderate Density Residential. Because the property was designated R-15 in 1967, the
procedures outlined in 26.310.060 Rezoning—Procedure for Amendment do not apply.
This administrative determination was provided on September 2, 2014 and shall become effective
September 2, 2014. The Community Development Director shall cause the Official Zone District
Map of the City of Aspen to reflect this determination.
