A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION
GRANTING FINAL MAJOR DEVELOPMENT APPROVAL FOR THE PROPERTY
LOCATED AT 301 LAKE AVENUE,THE EAST 1/, OF LOT 5 AND ALL OF LOTS 6 AND
7,BLOCK 40, HALLAM'S ADDITION TO THE CITY AND TOWNSITE OF ASPEN,
COLORADO

WHEREAS, the applicant, 301 Lake Avenue, LLC, represented by One Friday Design,
Oppenheim Architects, Bluegreen and Haas Land Planning, has requested Final Major
Development. Conceptual approval was granted through HPC Resolution #20, Series of 2014
and Council AspenModern negotiation approval was granted through Ordinance #21, Series of
2014; and
WHEREAS, Section 26.415.070 of the Municipal Code states that "no building or structure
shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a
designated historic property or district until plans or sufficient information have been submitted
to the Community Development Director and approved in accordance with the procedures
established for their review;" and
WHEREAS, for Final Major Development Review, the HPC must review the application, a staff
analysis report and the evidence presented at a hearing to determine the project's conformance
with the City of Aspen Historic Preservation Design Guidelines. The HPC may approve,
disapprove, approve with conditions or continue the application to obtain additional information
necessary to make a decision to approve or deny; and
WHEREAS, Amy Simon, in her staff report to HPC dated October 15, 2014, performed an
analysis of the application based on the standards and recommended approval with conditions;
and
WHEREAS, at their regular meeting on October 15, 2014, the Historic Preservation
Commission considered the application during a duly noticed public hearing, including the staff
recommendation and public comments, and found the project to be consistent with the review
criteria, with conditions, by a vote of 4 to 0.
NOW, THEREFORE, BE IT RESOLVED:
That HPC hereby approves Final Major Development for 301 Lake Avenue with the following
conditions:
1. The glass in the windows, doors and skylights of the historic house is approved to be
replaced, with details to be reviewed by staff and monitor. Staff and monitor are
authorized to approve the replacement of existing mullions and frames if determined to
be necessary by Owner or its General Contractor, and, if approved, staff and monitor will
review the details of any replacement, so that the replacement shall be reasonably
consistent with the appearance of the existing glass and mullions.
2. Any outdoor lighting not represented in the application will require review and approval
by staff and monitor.
3. Regarding the Residential Design Standards, the project was granted a waiver from the
Build-to-line Residential Design Standard and the Building Orientation Standard through
City Council Ordinance #21, Series of 2014. The existing structure is exempt from
Building Form and Building Elements standards 1, 2, and 3 because the applicant cannot
change historic features of the house. HPC grants a waiver of Parking standard 1, to
allow the garage door to be a double stall door. HPC allows a waiver of the Window
standard related to the height of the windows in the new construction, since the addition
is only one story tall and windows do not span from a first to a second floor, which is the
concern addressed by the standard. The Fences, Lightwells, Context and Inflection
standards are found to be met.
4. Staff and monitor will review and approve the cold rolled steel sample to be used on the
new construction.
5. The proposed ground mounted lighting to illuminate the historic structure is considered
appropriate in this case, rather than fixtures attached to the house.
APPROVED BY THE COMMISSION at its regular meeting on the 15th day of October,
2014.
