Re: Building Awnings Overhanging Public Rights -of -way
When any portion of a building awning assembly is requested to overhang in public right-of-way,
an encroachment license application (Engineering Policy 204) is required to be submitted.
When the submittals required for an encroachment license are approved, a license may be granted
by the City Engineer. The conditions of licensing that will be unique to awnings are as follows:
1. The lowest portion of an awning and appurtenances must be eight feet above the pedestrian
surface over which it projects.
2. The licensee must remove snow from the awning following a snowfall and continuously during
sustained snowfalls.
3. If the City has removed snow on the downtown mall prior to the licensee removing the snow
from his/her awning, the licensee must remove the snow from the awning off of the mall.
4. The licensee is responsible for removal of ice on the mall caused by the awning and
appurtenances.
