Condominiumization.A subdivision to establish, amend, or vacate separate ownership interests of a single property in a Condominium or Common Ownership Interest Community form of ownership shall be approved,approved with conditions,or denied by the Community Development Director. Condominiumization shall be limited to allocating ownership interests of a single parcel and shall not effect a division of the parcel into multiple lots, an aggregation of the parcel with other lands, a change in use of the property, and shall not operate as an abatement of other applicable regulations affecting the property. The Director shall review the condom iniumization plat pursuant to Section 26.480.030, Procedures for Review, and according to the following standards: 1. The Condominium Plat is in an acceptable style and format as prescribed in Title 29—Engineering Design Standards, Plats. Staff Finding.- The Condominium Plat is an acceptable style and format by current City Engineering Design Standards. Staff finds this criterion met. 2. The Condominium Plat shall be reviewed and then recorded in the office of the Pitkin County Clerk and Recorder. No subdivision agreement need be prepared or entered into between the applicant. and the City unless the Community Development Director determines such an agreement is necessary. We were able to get access to the roof and properly locate the boiler area. Your engineering department was correct that it was shown in the wrong place—correct corner of the building, but wrong wall. It faces north instead of west. It is now fixed and the other changes have been made to. Let me know if we now look good for printing mylars. Regarding the note to add the Section E depiction, he explained to me that Section E line was accidentally left on from the First Amendment template and doesn't have anything to do with the Unit B modification that are being shown on this Second Amendment. I think we can just omit Section E altogether. Please confirm this is okay. All other condominium units in the Isis Theater Condominium building are owned by the City of Aspen Public Facilities Authority,which controls the condominium association. Included in the attached PDF is a copy of an Agreement between the Authority and my client agreeing to a number of issues relating to the building. Section 3 of the Agreement address the 500 sf addition to Unit B and agrees that it is permitted and that the City will cooperate in processing all amendment required for it.
