GRANTING FINAL MAJOR DEVELOPMENT APPROVAL FOR THE PROPERTY
LOCATED AT 229 W.,SMUGGLER AND 426 N. SECOND STREET, UNITS A AND B,
SECOND AND SMUGGLER SUBDIVISION, CITY AND TOWNSITE OF ASPEN,
COLORADO

WHEREAS, the applicant, 229 W. Smuggler LLC and 426 N. Second LLC, represented by Haas
Land Planning, CCY Architects, and Bluegreen, has requested Final Major Development approval for
the property located at 229 W. Smuggler and 426 N. Second Street, Units A and B, Second and
Smuggler Subdivision, City and Townsite of Aspen, Colorado; and
WHEREAS, Section 26.415.070 of.the Municipal Code states that "no building or structure
shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a
designated historic property or district until plans or sufficient information have been submitted
to the Community Development Director and approved in accordance with the procedures
established for their review; and
WHEREAS, for Final Major Development Review, the HPC must review the application, a staff'
analysis report and the evidence presented at a hearing to determine the project's conformance
with the City of Aspen Historic Preservation Design Guidelines per Section 26.415.070.D.4 of
,the Municipal Code and other applicable Code Sections. The HPC may approve, disapprove,
approve with conditions or continue the application to obtain additional information necessary to
make a decision to approve or deny; and
WHEREAS, HPC reviewed the project on February 25, 2015. HPC considered the application,
the staff memo and public comments, and found the proposal consistent with the review
standards and granted approval with conditions by a vote of 4 to 1.
NOW, THEREFORE, BE IT,RESOLVED:
That HPC hereby grants Final Major Development approval for 229 W. Smuggler and 426 N. Second
Street, Units A and B, Second and Smuggler Subdivision, City and Townsite of Aspen, Colorado with
the following conditions:
1. Per HPC Resolution #1, Series of 2015, the following setback reductions have been
granted:
An east sideyard setback reduction of 5', above and below grade, at the garage.
• A rear yard setback reduction of 5' below grade, at the garage.
• A rear setback reduction of 4', above and below grade, at the new unit, plus an
additional reduction of up to F for a cantilevered dormer on the south fayade.
• A combined sideyard setback reduction of 15'.

2. Per HPC Resolution #1, Series of 2015, a report from a licensed engineer, architect or
housemover demonstrating that the structure can, be moved, and the method for moving
and protecting the structure, must be submitted with the building,permit application. In
addition the applicant must provide a bond, letter of credit or cashier's check in the
amount of$30,000 to be held by the City during the duration of the relocation process.
3. The existing stone at the base of the Victorian is to, ideally, be stripped of paint before re-
installation as the foundation veneer. Staff,and monitor will work with the architect and
contractor to determine a reasonable solution; which may include a different option,
during the construction process.
4. The design of the railing on the Victorian porch deck must be restudied to match the
historic design, to be reviewed and approved by staff and monitor.
5. Work with the Building Department to determine if handrails to the front porch of the
Victorian can be omitted, which is typically an option if the porch deck is no more than
30" above grade. Otherwise, the design of the handrail is to be reviewed and approved by
staff and monitor.
6. The existing windows generally may not be replaced and should berepaired, including
new glazing putty and weatherstripping to reduce air infiltration. Interior storm windows
can be added to achieve a similar R value as new windows would create. Staff will
inspect each window with the architect and contractor during the construction process and
will review and approve a treatment approach for each window with the project monitor.
7. In the building permit, specify the use of a painted or galvanized roof flashing on the
Victorian. Any proposed gutters and downspouts require review and approval by staff
and monitor.
8. Work with the City Forester to identify an acceptable plan, if any, for adding perennials to
the right-of-way adjacent to the property.
9. The material to be used for the stone curb in the landscape is to be reviewed and approved
by staff and monitor. The .height of the curb may be no more than the height of one
standard stair riser.
10. The material for the front steps to the Victorian porch is to be reviewed and approved by
staff and monitor.
11. One in ground path light, located on private property, is permitted along the walkway
leading to the Victorian porch.
