COMMERCIAL CORE & LODGING COMMISSION
MINUTES OF APRIL 1, 2015
Chairperson, Riley Tippet called the meeting to order at 8:30 a.m.
Commissioners in attendance were Bill Dinsmoor, Terry Butler, Don
Sheeley and Fred Ayarza. Siam Castillo was absent.
Kiki Raj was seated at 8:48 a.m.

Minutes: Fred made the motion to approve the minutes of March 18t';
second by Don. All in favor, motion carried 5-0
Dan said seasonal hires are going on. All the XMAS decorations are down.
Every night someone rips the Wagner fence down because they want to walk
their dogs.
Hops some kind of drip irrigation: put some kind of decorative ropes up to
mark the ditch.

Riley said the decision was made at 30 feet in the.center of Hyman.
Bill said it would be nice to have 45 feet.
Riley said there was a lot of discussion around sizes and the current mall
configuration. The City wants to keep spaces open on either end and have
cross ways.
Brian Nichols, Aspen Fire Department. Brian said he was summonsed over
there last year every Friday. There is an egress space.
Scott said he drilled to hold the fence in a permanent gate.
Brian said he will be writing tickets this year.

Jim Pomeroy said there is a bike rack at the center of the alley that needs to
be removed.
Bill said the underground electrical is complete. Bill said he also has a new
wash station.
Brian Nichols said they are migrating away from propane heaters.
Jim Pomeroy said mall lease holders can have one sandwich board sign and
one menu board 4 square feet. All mall lease holders need to determine
where that menu board goes.
MOTION: Don moved to approve Hops, second by Bill. All in favor,
motion carried.
Peaches
Lisa Haisfield, owner
Lisa said they will not have umbrellas on the two tables.
Bill said all the time there are three chairs or four. Bill asked Lisa to inform
her staff to try harder to maintain the two tables and not have more chairs in
.the right-of-way.
MOTION: Don moved to approve Peaches; second by Bill. All in favor,
motion carried.
Red Onion
Michael Tierney said they have a new diagram.
Michael said he will e-mail Kathy a photograph of the tables and chairs.
MOTION: Bill moved to approve Red Onion; second by Fred. All in favor, r
motion carried.
Le Creperie —new drawing for 2016
Don said the drawing is poor and for 2016 a new drawing needs submitted.
Raphael Derly, owner said they will have no umbrellas. The tree gives
enough shade.

Jim Pomeroy said there were problems with ash trays in front of the
handicapped space.
Brian Nichols said there can be no open flames.
Jim Pomeroy also said the siginage has morphed. One sandwich board and
one memo board is all that is allowed.
Fred said it gets messy out in front of the restaurant and please keep clean it
cleaned up.
MOTION: Terry moved to approve LeCreperie; second by Kiki. All in
favor, motion carried.
Acquolina
Gretchen Learly, manager said they will honor the code regarding propane
heaters. Gretchen said she is glad that the heater regulations are applying to
everyone. Gretchen said they have a tricky location. There is six feet of
clearance for the walkway. The umbrellas protrude 3/12 feet and they are 7
feet tall. Gretchen said a couple of times they have moved the tables to
accommodate patrons.
MOTION: Don moved to approve Acquolina; second by Bill. All in favor;
motion carried.
Ellina
Ryan O'Donnell, owner said they are having the same space. We will have
ten tables that will be smaller.
Terry said everyone should emulate Ellina's.
Ryan said he stacks his chairs behind his bushes and they are not visible.
Bill said to be consistent if chairs are setup in the public right-of-way they
should be used for the public.
Ryan said he can move them out of the public space.
MOTION: Don made the motion to approve Ellina's as is; second by Kiki.

Aspen Over Easy ,
Bill said he looked at the drawing and the lowest part of the umbrella has to
be 7 feet tall.
Mladen Todorovic, owner said his space is the same as last year. Mladen
said he would be interested in taking the Square Grouper space if they don't
go out.
Bill said he is not comfortable leasing additional space in front of another
restaurant without reviewing it.
MOTION: Don made the motion to approve the outside seating for Aspen
Over Easy with the condition that the umbrellas be 7 feet high; second by
Fred. All in favor, motion carried.
Jimmy's Bodega
Ann Grayson said there are no changes from last year. The radiant heaters
are in the umbrellas and we will have the Fire department look at them.
Bill said the radiant heaters are more efficient.
Don said when people tie their dogs up to the fence people can't get through.
Dan Nelson said someone put their dog in the flower bed. Dan also said
horses are not allowed on the mall.
Fred said dogs are a major problem.
Jim Pomeroy said move the dogs to the side and give them water and hooks.
MOTION: Fred made the motion to approve Jimmy's Bodega; second Don.
All in favor, motion carried.
Escobar
Ian.Perry said he appreciates the fairness in the mall leases. It would be
great to get a long term lease.
Kathy said the state doesn't allow long term leases. All outside dining leases
are for one year.

Ian asked if there could be a discussion if Zocalito and Finbarr's doesn't
come out.
Jim Pomeroy said the city manager wants everyone to be equal on the mall.
MOTION: Kiki made the motion to approve Escobar, second by Bill. All in
favor, motion carried.
Grey Lady
Ian said the space will be a little larger than last year but out the same
distance. The chairs and tables are the same ones that R&R used.
MOTION: Bill moved to approve Grey Lady; second by Kiki. All in favor,
motion carried.
Justice Snows
Bill said the umbrellas are too large and are hanging into the right-of-way.
They need to be raised or get new umbrellas.
Michelle Kiley, owner said it would be difficult to have a fence around the
tables.
Fred also said Justice Snows umbrellas creep.
MOTION: Riley moved to approve Justice Snow with the condition that the
umbrellas be looked at as they are too wide and too low. Motion second by
Kiki. All in favor, motion carried.
MOTION: Fred moved to adjourn; second by Bill. All in favor, motion
carried.
