SUMMARY: The Applicant is requesting approval to relocate the Aspen RevIVe spa from its
current location on Main St. to a basement space within the conference room area of the Sky
Hotel.
BACKGROUND: Aspen RevIVe is currently located at 100 E. Main Street in the City of
Aspen. Services offered include intravenous hydration and vitamin treatments, aromatherapy,
oxygen bars and massage.
CURRENT PROPOSAL: The Applicant is proposing to locate her business, Aspen RevIVe
spa, within the conference room area on the basement level of the Sky Hotel.
REVIEW PROCEDURE:
• Minor expansion of a commercial, lodge or mixed -use development. The minor
enlargement of a property, structure, or portion of a structure for commercial, lodge or
mixed -use development shall be approved, approved with conditions or denied by the
Community Development Director based on criteria found in Section 26.470.060.5 of the
Land Use Code, which states the expansion must involve no more than five hundred
(500) square feet of net leasable space, no more than two hundred (200) square feet of -
Floor Area, and up to two (2) additional hotel/lodge units. No employee mitigation is
required for expansions that meet these criteria. These floor area additions are
cumulative, including administrative GMQS approvals.

STAFF EVALUATION: The Applicant is proposing to locate the Aspen RevIVe spa in the
basement level conference room of the Sky Hotel. Prior approvals indicate this 994 sq. ft.
conference room space to be non -unit. The inclusion of the Aspen RevIVe spa in this location
would change the non -unit floor area to commercial net leasable floor area.
According to Section 26.470.060.5 of the Land Use Code, a minor expansion of 500 sq. ft. or
less is permitted within a structure without triggering mitigation requirements. The Applicant
has indicated the intent to divide the conference room to provide a space that is no larger than
500 sq. ft. in size, as indicated in Exhibit A.
Staff has found no evidence of the Sky Hotel requesting a floor area increase in the past. The
addition of this commercial space will not change the building's footprint or overall floor area.
Thus, Staff finds the proposal to meet the requirements for a Minor Expansion of a Commercial,
Lodge or Mixed -Use Development.
DECISION: The Community Development Director finds the application for a Minor
Expansion of a Commercial, Lodge or Mixed -Use Development, as noted above, to be
consistent with the review criteria (Exhibit B) and thereby, APPROVES the request.

DEVELOPMENT ORDER

Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070,
"Development Orders", and Section 26.308.01.0, "Vested Property Rights", of the City of Aspen
Municipal Code. This Order allows development of a site specific development plan pursuant to the
provisions of the land use approvals, described herein. The effective date of this Order shall also be the
initiation date of a three-year vested property right. The vested property right shall expire on the day after
the third anniversary of the effective date of this Order, unless a building permit application submittal is
accepted and deemed complete by the Chief Building Official, pursuant to Section 26.304.075, or unless
an exemption, extension, reinstatement, or a revocation is issued by City Council pursuant to Section
26.308.010. After Expiration of vested property rights, this Order shall remain in full force and effect,
excluding any growth management allotments granted pursuant to Section 26.470, but shall be subject to
any amendments to the Land Use Code adopted since the effective date of this Order.

Review Criteria
Minor expansion of a commercial, lodge or mixed -use development. The minor enlargement
of a property, structure or portion of a structure for commercial, lodge or mixed -use development
shall be approved, approved with conditions or denied by the Community Development Director
based on the following criteria. The additional development of uses identified in Section
26.470.020 shall be deducted from the development ceiling levels established pursuant to Section
26.470.030 but shall not be deducted from the respective annual development allotments.

space, no more than two -hundred -fifty (250) square feet of Floor Area, and up to two (2)
additional hotel/lodge units. The expansion involves no residential units. No employee
mitigation shall be required. This shall be cumulative and shall include administrative

Staff Response: The Applicant is proposing to locate the Aspen RevIVe spa within the
basement conference center space of the Sky Hotel. The proposed use will change 500 sq. ft.
of non -unit space to commercial net -leasable space. No changes will be made to the
building's footprint or overall floor area. This proposal involves no additional hotel/lodge
units and no residential units. Staff has found no past requests for expansion of the Sky
Hotel. Staff finds this criterion to be met.

5. Minor expansion of a commercial, lodge or mixed -use development. The minor
enlargement of a property, structure or portion of a structure for commercial, lodge or mixed -
use development shall be approved, approved with conditions or denied by the Community
Development Director based on the following criteria. The additional development of uses
identified in Section 26.470.020 shall be deducted from the development ceiling levels
established pursuant to Section 26.470.030 but shall not be deducted from the respective
annual development allotments.
