Snowmass, Colorado 81654 SUBJECT & SITE OF AMENDMENT: Aspen Valley Ski and Snowboard Club 300 AVSC Drive Aspen, Colorado 81611 SUMMARY: The Applicant is requesting administrative approval to amend the planned development approval to allow the addition of a number of improvements to the AVSC parcel for the purpose of athlete training. Some of the improvements will encroach into the setbacks. Article Vill of the Moore Family PUD Guide indicates all development must be maintained within the building envelope for the site. This parcel does not have a designated building envelope, therefore the setbacks serve as the building envelope. Proposed development within the parcel's setbacks requires an amendment to the planned development approval. BACKGROUND: The subject site is zoned PUB/PD, and is Block B of the Moore Family Planned Development. The final plat was recorded in August of 1998. According to the Moore Family PUD Guide, the subject parcel was intended to be used as a Ski Club Facility. All development, including grading, was directed to be contained within the building envelopes for each parcel within the Moore Family PUD. Grading for driveways and driveway retaining walls are allowed an exception to this restriction. Block B does not have a prescribed building envelope, but is restricted by 10' setbacks on all sides. CURRENT PROPOSAL: The applicant is proposing the addition ofa number of structures to the site, some of which encroach into the parcel's setbacks. The proposed improvements include: • A super trampoline at the north corner of the property. The trampoline is proposed with an at-grade surrounding patio, and a fence that will measure 6' from the finished grade. The deck and fence will not extend into the setback; s A skate ramp/air bag area at the eastern side of the property, adjacent to the existing AVSC building. Proposed supporting structure will include removable stairs and a tiered landscape retaining wall which will extend into the setback; and e A walkway between the airbag and trampoline areas, the majority of which will extend into the setback. 1 Further proposed on-site changes include: • The relocation of the existing trash enclosure, which is currently off-site, to be located on the eastern side of the property. adjacent to the proposed walkway; • The reconfiguration of parking at the north end of the property and the relocation of this parking along the southern end of the paved circular area. No loss in parking will ensue as a result ofthis realignment ( 16 spaces). and additional spaces have been proposed. • The removal of the existing off-site storm drainage culvert and its replacement in a nearby, off-site location; and • The rerouting of existing water service adjacent to the AVSC building. REVIEW PROCEDURE: • Insubstantial Amendment. Per subsection 26.445.110.A of the Land Use Code, the Community Development Director may approve, approve with conditions, or disapprove an application for an Insubstantial PD Amendment based on the review criteria, as found in Exhibit B to this memo. STAFF EVALUATION: Staff has evaluated this application against the review criteria for an Insubstantia] PD Amendment, and notes the following. The site is currently used as an athletic training facility for the Aspen Valley Ski and Snowboard Club. The proposed additions will provide further training options, and is in line with the current use and character of the parcel. The project will require no variations from permitted uses on the site, and there are no requests for increases in floor area associated with this application. The fences proposed in the areas of the airbag and the super trampoline will be maintained at a height of six feet or less from finished grade. The patio areas at the airbag and the skate ramp area will be developed on-grade, so to avoid adding fioor area to the site. Furthermore, the uses proposed for the site are not incompatible with the neighboring properties, which host the high school and Marolt open space. The remaining parcels of the Moore Family PD are residential in nature; however the proposed changes to the lot are set back substantially from the residential area. Furthermore, the Applicant has provided a signed letter from the Five Trees Design Review Board indicating their support ofthe planned improvements. Al[ proposed development is within the approved dimensional requirements of the planned development and the Land Use Code. The Code permits walkways within the setbacks so long as they do not exceed thirty (30) inches above and below grade, simultaneously. The Applicant has indicated compliance with this provision. The existing trash/recycling area is currently off-site. The Applicant has indicated this will be moved on-site, near the proposed walkway on the eastern side of the site. I f the current trash structure is not used, and another is created for this site, this must be approved by the City's Environmental Health Dept. 2 REFERRALS: Staff has gathered the following referral comments for the proposed work that is outside of the scope ofthe Planning Dept. A. Engineering Dept. - At this time the Engineering Department finds no major issue with the proposed airbag area and super tramp on the AVSC property. A few comments to be addressed: 1. In the drainage report show the ofGite basin for which runoff is routed through the east swale and culvert. 2. The relocation of the swale to the east of the airbag area will be further reviewed when a drainage report is provided. The report must show the realigned swale has capacity. Further down it should be clearly shown how the new swale ties in to the existing swale which crosses over the gravel road. 3. The report should also show capacity for the proposed stonn culvert and extend the plan sheet to show the outlet point of the existing and proposed storm culverts NE ofthe property. 4. Permission must be granted from Moore Open Space as the neighboring property for the placement of the proposed culvert beyond the AVSC property as well as the grading of the proposed swale. These improvements are all beyond the property boundary. 5. One plan set shows a boulder wall east of the airbag, another plan shows a tiered wall configuration. Ensure in the submittal each sheet is consistent. 6. Engineering does not have an issue with the proposed second curb cut, as the access is onto a private road. B. Parks Dept. 1. There is an existing irrigation main line just to the north side ofthe proposed walkway, as well as irrigation wires. Care will need to be of utmost priority when digging in the proposed new culvert. Additionally, there may be other utilities in the area, such as fiber optic, electric and sewer. 2. There is a water line coming from the school parking lot that goes to the drinking fountain at the Upper Moore backstop area that will need to be located. 3. The Nordic Trail alignment is just east of the proposed boulder wall by the airbag. It appears that there will be enough room to drive the snow cat uphill to access the Nordic Trail that runs up to the Meadowland trail system, but this should be verified. 4. Another concern is the conveyance o f water away from the Upper Moore field. We have had issues in the past with a real soggy field out on that end. 5. 1 want to make the applicant aware that there is a ditch/stormwater conveyance line that runs off o f Moore Dr. along the school driveway on the AVSC side of the road. This is an open ditch that goes into a culvert under the existing driveway then daylights again 50-60 feet east of the current driveway where it is again an open ditch running just to the north-northwest of the proposed new trampoline. This ditch does not run all the time, however, the pumphouse for SkiCo is up the road and there have been issues in the past with water running. I believe it is primarily a stormwater conveyance ditch. 3 C. Fire Dept. 1. The trampoline may not encroach into the parking area any farther than the existing parking spaces currently occupy." 2. There will be no parking permitted around the trampoline area. D. Utilities Dept. 1. More detail and confirmation will be required from a fire sprinkler designer that the addition 45's do not impact the operational design and effectiveness of the existing sprinkler systems. 2. What style of restraint will be used for any and all additional bends, as this is a 4" service. DECISION: The Community Development Director finds the application for an Insubstantial Amendment to the Planned Development, as noted above, to be consistent with the review criteria (Exhibit B) and thereby, APPROVES the request, with the conditions as stated in the Referrals section, above, and as found below. • Any new trash/recycling structure must be approved by Environmental Health. An insubstantial amendment to an approved Project Review or an approved Detailed Review may be authorized by the Community Development Director. An insubstantial amendment shall meet the following criteria: 1. The request does not change the use or character o f the development. Staff Response: The site is currently used as an athlete training facility for the Aspen Valiey Ski and Snowboard Club. The proposed additions will enhance the ability of athletes to train at this facility. The use and character of the development will remain the same. Stafflinds this criterion to be met. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Staff Response: The changes proposed to the AVSC property represent an insubstantial change to the parcel. The airbag is a temporary feature that will be removed for the winter season. The decks for the features are proposed at grade and will not add any floor area to the site. The proposed stairs are temporary and will be removed at the end of the usable season. Furthermore, the uses proposed for the site are not incompatible with the neighboring properties, which host the high school and Marolt open space. The remaining parcels of the Moore Family PD are residential in nature; however these proposed changes to the lot are set back substantially from the residential area. Furthermore, the Applicant has provided a signed letter from the HOA president in support of the site improvements. Sta#Jinds this criterion to be met. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Staff Response: The project will not require any variations from the use that is allowed on the site, nor are there any requests for an increase in floor area. The fences will be maintained at a height of six feet or less from finished grade. All structures that are proposed within the setbacks (walkway, ratios) are required to meet the dimensional standards found in the Land Use Code. Stafffinds this criterion to be met. 4. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that could not have been foreseen during the Project Review approval, are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Staff Response: This applicant involves a number of improvements within the parcel's setbacks. Although the proposed changes are not limited to a technical nature, they are 1 within the dimensional tolerances allowed per the Code. For instance, fences are permitted to be within the setbacks so long as they do not exceed the height limitation (6'), and they do not extend past the property's boundaries. The proposed airbag and adjacent stairs are temporary features that will be removed after the warm weather season. The proposed walkway will not be any lower than 30" below grade. Stafffinds this criterion to be met. 5. An applicant may not apply for Detailed Review if an amendment is pending. Staff Response: The applicant is not applying for a Detailed Review at this time.
