PARKING SPACE USER RIGHTS SHALL BE ESTABLISHED ITS THE SUBDIVISION/PUD/SPA AGREEMENT, AND SPECIFIC PARKING SPACES SHALL BE ASSIGNED TO AUTHORIZED USERS THEREOF FROM TIME TO TIME BY ACRC OR ITS MANAGING AGENT. THE ACTUAL LOCATION OF SUCH DRIVEWAY AND SURFACE PARKING EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE DRIVEWAY AND SURFACE PARKING IMPROVEMENTS SHOWN ON SHEET 3 HEREOF; 10. DOES HEREBY DEDICATE AND GRANT A PERPETUAL, NON-EXCLUSIVE UTILITY EASEMENT OVER, UPON AND BENEATH THE "DRY UTILITY EASEMENT" SHOWN ON SHEET 2 HEREOF, FOR PURPOSES OF INGRESS AND EGRESS FOR THE CONSTRUCTION, INSTALLATION, ENLARGEMENT, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF UNDERGROUND DRY UTILITIES INCLUDING ELECTRICITY, TELEPHONE AND CABLE TV, TOGETHER WITH ASSOCIATED EQUIPMENT REQUIRED ABOVE GROUND IN LOCATIONS APPROVED IN ADVANCE BY ACRC, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES, FOR THE USE AND BENEFIT OF ALL UTILITY COMPANIES OWNING, OPERATING OR OTHERWISE DEALING WITH THE UTILITY FACILITIES INSTALLED IN SAID EASEMENTS FROM TIME TO TIME, AND FOR THE BENEFIT OF THE OWNERS FROM TIME TO TIME OF LOTS 15-A THROUGH 15-E, RESPECTIVELY, AND ALL PORTIONS THEREOF. SAID UTILITY COMPANIES ARE ALSO HEREBY GRANTED A PERPETUAL, NON-EXCLUSIVE EASEMENT OVER AND ALONG THE UTILITY MAINTENANCE ACCESS EASEMENT SHOWN AND DEPICTED HEREON FOR PURPOSES OF VEHICULAR AND PEDESTRIAN ACCESS FOR THE PURPOSE OF MAINTAINING THE DRY UTILITY FACILITIES LOCATED WITHIN THE HEREBY DEDICATED DRY UTILITY EASEMENT. THE ACTUAL LOCATION OF SUCH ACCESS EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE ACCESS IMPROVEMENTS SHOWN ON SHEET 3 HEREOF; 11. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF THE ASPEN CONSOLIDATED SANITATION DISTRICT ("ACSD") A PERPETUAL, NON-EXCLUSIVE EASEMENT ALONG THE ENTIRE COURSE OF THE "SANITARY SEWER EASEMENT" SHOWN ON SHEET 2 HEREOF, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF AN UNDERGROUND SANITARY SEWER LINE AND ASSOCIATED MANHOLES, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES. THE SANITARY SEWER EASEMENT SHALL BE TWENTY (20) FEET IN WIDTH AND SHALL BE BOTH A SURFACE AND A SUBGRADE EASEMENT WITH SURFACE ACCESS PERMITTED WITHIN THE EASEMENT. ACSD IS ALSO HEREBY GRANTED A PERPETUAL, NON-EXCLUSIVE EASEMENT OVER AND ALONG THE UTILITY MAINTENANCE ACCESS EASEMENT SHOWN AND DEPICTED HEREON FOR PURPOSES OF VEHICULAR AND PEDESTRIAN ACCESS FOR THE PURPOSE OF MAINTAINING THE SANITARY SEWER FACILITIES LOCATED WITHIN THE HEREBY DEDICATED SANITARY SEWER EASEMENT. THE ACTUAL LOCATION OF SUCH ACCESS EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE ACCESS IMPROVEMENTS SHOWN ON SHEET 3 HEREOF. 12. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF THE ASPEN FIRE PROTECTION DISTRICT A PERPETUAL, NON-EXCLUSIVE EASEMENT FROM LITE AVENUE OVER AND ALONG THE 16 FOOT WIDE FIRE ACCESS EASEMENT SHOWN AND DEPICTED HEREON FOR PURPOSES OF VEHICULAR AND PEDESTRIAN ACCESS TO ALL PORTIONS OF THE PROPERTY AND THE IMPROVEMENTS THEREON FOR FIRE PROTECTION.THE ACTUAL LOCATION OF SUCH ACCESS EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE DRIVEWAY AND ACCESS IMPROVEMENTS SHOWN ON SHEET 3 HEREOF; 13. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF LOTS 15-A THROUGH 15-E, RESPECTIVELY, AND ALL PORTIONS THEREOF, INCLUDING WITHOUT LIMITATION THE CONDOMINIUM UNITS TO BE CONSTRUCTED ON LOTS 15-13, 15-C AND 15-D, A PERPETUAL, NON-EXCLUSIVE EASEMENT ALONG THE ENTIRE COURSE OF THE PRIVATE WATER LINE SHOWN AND DEPICTED ON THE MASTER UTILITY PLAN (SHEET C5) TO BE RECORDED WITH THIS FINAL PLAT, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF A PRIVATE UNDERGROUND WATER LINE AND NECESSARY SURFACE IMPROVEMENTS, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES (THE "WATER LINE EASEMENT"). THE ACTUAL LOCATION OF SUCH WATER LINE EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE PRIVATE WATER LINE. THE WATER LINE AND ASSOCIATED IMPROVEMENTS SHALL BE OWNED BY ACRC AND SHALL BE MAINTAINED BY ACRC IN ACCORDANCE WITH THE PROVISIONS OF A MASTER EASEMENT AGREEMENT TO BE ENTERED INTO BETWEEN ACRC AND THE ASPEN CLUB CONDOMINIUM ASSOCIATION (THE "MASTER EASEMENT AGREEMENT); 14. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF LOTS 15-A THROUGH 15-E, RESPECTIVELY, AND ALL PORTIONS THEREOF, INCLUDING WITHOUT LIMITATION THE CONDOMINIUM UNITS TO BE CONSTRUCTED ON LOTS 15-13, 15-C AND 15-D, A PERPETUAL, NON-EXCLUSIVE EASEMENT ALONG THE ENTIRE COURSE OF THE PRIVATE NATURAL GAS LINE SHOWN AND DEPICTED ON THE MASTER UTILITY PLAN (SHEET C5) TO BE RECORDED WITH THIS FINAL PLAT, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF SAID PRIVATE NATURAL GAS LINE AND ASSOCIATED IMPROVEMENTS, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES (THE "GAS LINE EASEMENT"). THE ACTUAL LOCATION OF SUCH GAS LINE EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION OF THE PRIVATE NATURAL GAS LINE. THE GAS LINE AND ASSOCIATED IMPROVEMENTS SHALL BE OWNED BY ACRC AND SHALL BE MAINTAINED BY ACRC IN ACCORDANCE WITH THE PROVISIONS OF THE MASTER EASEMENT AGREEMENT; 15. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF LOTS 15-A THROUGH 15-E, RESPECTIVELY, AND ALL PORTIONS THEREOF, INCLUDING WITHOUT LIMITATION THE CONDOMINIUM UNITS TO BE CONSTRUCTED ON LOTS 15-13, 15-C AND 15-D, PERPETUAL, NON-EXCLUSIVE EASEMENTS ALONG THE ENTIRE COURSE OF ALL UTILITY SERVICE LINES THAT MAY BE CONSTRUCTED BETWEEN THE UTILITY MAINS ON THE PROPERTY AND THE VARIOUS BUILDINGS ON THE PROPERTY, IN THE AS -BUILT LOCATION OF SUCH SERVICE LINES, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF SUCH SERVICES LINES, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES. THE SERVICE LINES SHALL BE OWNED BY ACRC AND SHALL BE MAINTAINED BY ACRC IN ACCORDANCE WITH THE PROVISIONS OF THE MASTER EASEMENT AGREEMENT. 15. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF LOTS 15-A THROUGH 15-E, RESPECTIVELY, AND ALL PORTIONS THEREOF, INCLUDING WITHOUT LIMITATION THE CONDOMINIUM UNITS TO BE CONSTRUCTED ON LOTS 15-13, 15-C AND 15-D, A PERPETUAL, NON-EXCLUSIVE EASEMENT ALONG THE ENTIRE COURSE OF THE ON-SITE DRAINAGE IMPROVEMENTS SHOWN AND DEPICTED ON THE ON-SITE DRAINAGE AND WATER QUALITY BASIN PLAN (SHEET C2) TO BE RECORDED WITH THIS PLAT, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF A PRIVATE ON-SITE STORM WATER DRAINAGE SYSTEM AND NECESSARY SURFACE IMPROVEMENTS, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES (COLLECTIVELY, THE "DRAINAGE EASEMENT"). THE ACTUAL LOCATION OF SUCH DRAINAGE EASEMENT SHALL BE DEEMED AUTOMATICALLY AMENDED TO COINCIDE WITH THE AS -BUILT LOCATION THEREOF. THE ON-SITE STORM WATER DRAINAGE SYSTEM AND ASSOCIATED IMPROVEMENTS SHALL BE OWNED BY ACRC AND SHALL BE MAINTAINED BY ACRC IN ACCORDANCE WITH THE PROVISIONS OF THE MASTER EASEMENT AGREEMENT. TO THE EXTENT THE ON-SITE SYSTEM CARRIES OFF-SITE STORMWATER GENERATED FROM THE OFF-SITE DRAINAGE IMPROVEMENTS SHOWN AND DEPICTED ON THE OFF-SITE DRAINAGE AND RIGHT-OF-WAY IMPROVEMENTS PLAN (SHEET C4) TO BE RECORDED WITH THIS PLAT, THE CITY OF ASPEN IS HEREBY GRANTED A PERPETUAL, NON-EXCLUSIVE DRAINAGE EASEMENT WITHIN THE AS -BUILT ON-SITE DRAINAGE SYSTEM ALONG THE WESTERLY PROPERTY BOUNDARY FOR SUCH USE; 17. DOES HEREBY DEDICATE AND GRANT PERPETUAL, NON-EXCLUSIVE PRIVATE ACCESS EASEMENTS OVER AND ALONG THE COURSE OF ALL PRIVATE SIDEWALKS, STAIRCASES AND INTERIOR CORRIDORS LOCATED ON LOT 15-A THAT MAY BE CONSTRUCTED WITHIN THE PROPERTY FROM TIME TO TIME FOR DIRECT PEDESTRIAN ACCESS TO LOT 15-13, FOR THE USE AND BENEFIT OF ALL OWNERS, MEMBERS, GUESTS, TENANTS, iNViTEES AND EMPLOYEES FROM TIME TO TIME OF LOT 15-B AND ALL PORTIONS THEREOF, INCLUDING WITHOUT LIMITATION THE CONDOMINIUM UNITS TO BE CONSTRUCTED ON LOT 15-13, FOR PURPOSES OF INGRESS AND EGRESS BY PEDESTRIANS. THE ACTUAL LOCATION OF SUCH PRIVATE ACCESS EASEMENTS SHALL COINCIDE WITH THE AS -BUILT LOCATIONS SHOWN ON SHEET 4 HEREOF. 18. DOES HEREBY DEDICATE AND GRANT FOR THE USE AND BENEFIT OF THE CITY OF ASPEN WATER DEPARTMENT A PERPETUAL, NON-EXCLUSIVE EASEMENT ALONG THE ENTIRE COURSE OF THE "PUBLIC WATER EASEMENT" SHOWN ON SHEET 2 HEREOF, FOR PURPOSES OF CONSTRUCTION, INSTALLATION, USE, OPERATION, MAINTENANCE, REPAIR, REMOVAL AND REPLACEMENT OF AN UNDERGROUND WATER MAIN AND ASSOCIATED APPURTENANCES, TOGETHER WITH A REASONABLE RIGHT OF ACCESS FOR THE ACCOMPLISHMENT OF SUCH PURPOSES. THE PUBLIC WATER EASEMENT SHALL BE TWENTY FIVE (25) FEET IN WIDTH AND SHALL BE BOTH A SURFACE AND A SUBGRADE EASEMENT WITH SURFACE ACCESS PERMITTED WITHIN THE EASEMENT. 19.
