A RESOLUTION OF THE CITY OF ASPEN, COLORADO, DESIGNATING CERTAIN
PUBLIC AREAS AS SACROSANCT, DIRECTING CITY STAFF TO PROHIBIT ANY
SPECIAL EVENTS TO TAKE PLACE ON SAID PUBLIC AREAS, AND TO DIRECT THE
CITY ATTORNEY TO DRAFT' A BALLOT QUESTION FOR THE NOVEMBER 2001
MUNICIPAL ELECTION SEEKING TO AMEND THE 'CITY CHARTER TO
PERMANENTLY PROTECT SUCH AREAS. :
WHEREAS, there are 6ermin public areas owned by the City of Aspen that, because of
their unique nature or because of their Particularly designated use, should be protected from
incompatible uses by the public; and
WHEREAS, the City COUncil has determined that such parcels of land should be
considered as sacrosanct and as such should not be allowed to be used for incompatible purposes
notwithstanding any permitted or conditional uses allowed in the zone district Or any temporary
use pen-nits that may be authorized by Section 26.450 of the Aspen Municipal Code.
NOW, WHEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADOi THAT:
Section One
The City Council of the City of Aspen hereby designates the following parcels of land as
sacrosanct land:
The Ute Cemetery.
The Red Butte Cemetery.
The Aspen Grove Cemetery.
The John Denver Sanctuary ai the Rio Grande Park.
Section Two
The City Council hereby directs all City staff to prohibit any uses on parcels designated
as sacrosanct that are inconsisient with the current: uses of the sacros.anct parcels; notwithstanding
any provision of the Aspen Municipal Code that would authorize a temporary use that is not
normaIly authorized on the parcel.
Section Three
The City Council hereby agrees not to amend this policy on the designation and uses of
sacrosanct parcels without a concurring vote o1' all five members of the City Council.
Section Four
The City Council hereby directs the City Attorney to draft a resolution for its
consideration that would place on the November 2001 municipal election a ballot question
approving an ordinance to amend the City Charter 'to permanently designate sacrosanct lands and
reqmring the concurring vote of all five members of Council to remove a parcel from its
designation as a sacrosanct parcel or to allow any temporary use on the parcel that is inconsistent
with the purpose of the parcel.
