Building 2 is very similar to Building 8 in that it is a fl S P E n mixed use building that includes Tourist Accommodation Units, a Deed Restricted Rental Unit, as well as plaza level retail. �I I G N L 0 n D S We tried to incorporate all of Nick Adeh's comments on previous maps regarding snow V I L L fl G E storage, trash storage, etc. on this Lot 2 map to reduce the revision time. In addition, Alpine Engineering, the surveyor, has contacted Nick Adeh to insure that this map meets the city's requirements regarding monumentation. Alpine has included copies of the Colorado Land Survey Monument Record for the monuments of interest to aid in P. O. Box 51 15 Engineering in their review. In consideration of this grant of easement, the District shall be solely responsible, at its sole cost and expense, for all maintenance, repair and replacement of the 'Metro District Easement Area" and all improvements thereon and oil fixtures, equipment and personal property located therein, and for casualty and liability insurance of the some. The rights granted, to the District pursuant to this General Note 13 are expressly subject to the following provisions (any capitalized term used in this General Note 13 below without definition shall have the meaning attributed to that term in the Declaration): a) Except for the improvements constructed or installed upon the Metro District Easement Area in connection with the initial development of this condominium project, and replacement thereof with substantially similar improvements, the District shall construct or install no above -grade improvements upon or within the Metro District Easement Area without the prior written consent of the Executive Board, including approval of a majority of the Residential Directors and a majority of the Commercial Directors. b) The Association shall have the right, exercised by the Tourist Accommodation Directors only, to direct the District to undertake additional services with respect to the maintenance, repair, replacement and improvement of the Metro District Easement Area, including, without limitation, the right to direct the District to construct or install additional or different londscaping, and the District shall be obligated to provide such additional services: provided, however, that ail direct costs of the District inproviding such additional services shall be paid by the Association and shoil be allocated only to the Tourist Accommodation Units therein as part of the LCETA Budget, and no other Owner shall be liable for the costs of any such additional services; and c) Except as reasonably necessary to perform its functions and obligations within the Metro District Easement Area, the District shall not park any vehicle or store or place any materials or debris within the Metro District Easement Area. 14. Trash storage for the property described within this condominium map is provided from a common trash area located within the Aspen Highlands Village Parking and Loading Dock Facility, a Condominium, according to the condominium map recorded January 11, 2001 in Plat Book 56 at Pages 20-23 as Reception No. 450453, in the Office of the Pitkin County, Colorado, Clerk and Recorder. 15. Certain paved surface areas of the exterior portions of property as described within this condominium map are served by a central snowmelt system. 16. The Drainage Easement depicted on this condominium map is subject to limitations as described in General Note 7 of the Block D Plat. Said limitation is identified on Sheets 11 and 12 of this condominium map. 17. Hines Highlands Limited Partnership and the Ritz -Carlton Development Company, Inc., hereby grant and convey to the owners of Units C-2105 and DR-2210 as shown on this condominium map, and their lessees, guests, invitees, customers, employees, successors and assigns, a perpetual, non-exclusive easement for access, ingress and egress purposes to such Units over and across those portions of this condominium map identified as "Porte Cochere L.C.E.-TA 18.
