A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, APPROVING A CONTRACT AMENDMENT BETWEEN THE
CITY OF ASPEN AND CUSHING TERRELL, AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID CONTRACT AMENDMENT ON BEHALF
OF THE CITY OF ASPEN, COLORADO.
WHEREAS, there has been submitted to the City Council a contract
amendment between the City of Aspen and Cushing Terrell, a true and accurate
copy of which is attached hereto as "Exhibit A";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO,
That the City Council of the City of Aspen hereby approves the contract
amendment between the City of Aspen and Cushing Terrell, a copy of which is
annexed hereto and incorporated herein, and does hereby authorize the City
Manager to execute said contract on behalf of the City of Aspen.
INTRODUCED, READ AND ADOPTED by the City Council of the City of
Aspen on the I I' day of July, 2023.

Entitlements Part 2: Continued Support of the Entitlements Process
SCOPE OF WORK
Entitlements Services: Part 2
Cushing Terrell and consultant team will continue to provide Entitlement Services and design consulting in
support of the Land Use Entitlements Review Process. Part 2 Services build upon previously contracted Part 1
services and include preparing supplemental exhibits for the Development Application in response to
comments, preparation of the CDoT access permit and attendance at CDoT meetings, attendance at two
planning and zoning hearings with associated presentations. Scope of work includes preparing responses to
P&Z conditions of approval. Responses related to air quality testing and level of service concerns at the
signalized intersection are included in separate scopes outlined in Exhibit 6C. Air quality testing scope is
included in a separate scope outlined in Exhibit 6B. Presentation preparation and attendance at four City
Council Hearings (three in person and virtual attendance at the first reading) is included.
Continued Support of the Entitlements Process
This scope of work includes Continued Project Support during the approval process. Hourly support from the
project team (Land Planner, Project Manager, Director of Affordable Housing, Landscape Architect, Civil
Engineer) including presentation preparation and attendance at up to two Council work sessions, weekly
team meetings with CoA project manager, general consulting and coordination with CDoT, environmental
consultant, CommDev and others is budgeted at approximately 300 hours and is included.
Entitlements Services: Part 2 and Continued Support of the Entitlements Process scope of work concludes
after six City Council meetings, or by August 31, 2023, whichever occurs first.

Compensation for Entitlement Services: Part 2 labor (hourly) and expenses shall not to exceed $70,000.

Additional Air Quality / Environmental Consulting
SCOPE OF WORK
Cushing Terrell's sub consultant Slosky and Company, Inc. will provide additional air quality and
environmental testing recommendations. Additional air quality testing recommendations follow up on the
peer review of the initial air quality testing. This scope of work addresses conditions of P&Z approval related
to air quality.

Additional Transportation Consulting
SCOPE OF WORK
Cushing Terrell's sub consultant Fehr and Peers will provide additional transportation consulting to include
CDoT access permit preparation, additional information added to the TIA in response to P&Z conditions of
approval, and support of the entitlements process by participating in P&Z hearings, council work sessions,
and preparing exhibits addressing transportation questions.
Anticipated consulting could include preparation of additional exhibits related to council questions related
to traffic concerns, alternatives to the signalized intersection/relationship to the CDoT access Control Plan,
and further design studies.
