Legally Described as: The South 10 feet of Lot 12 and the South 10 feet of the North 15 feet of Lot 12 and the North 30 feet of Lots 22 and 23,Block 1,RIVERSIDE ADDITION to the City and Townsite of Aspen. SUMMARY: The applicant has requested a Stream Margin Review Exemption to remodel the exterior of the building including: the front entry to the building, replacement and addition of sliding glass doors and windows, and reconfiguration of the front light well, in addition to interior alterations. On the east side of the building the applicant proposes to bump out the front door, which is currently recessed from all other façades, add windows, reconfigure the window well, and replace the garage door. On the south, west, and north elevations the changes are limited to replacement and addition of windows and sliding glass doors. Skylights are proposed on the roof, and all deck railings are to be replaced on all sides of the building. The property is located on the east bank of the Roaring Fork River. The building falls . within the Stream Margin Area but.no portion of the building is in the 100-year flood plain. Due to the environmental significance of Aspen's watersheds, development projects located within 100 feet of the Roaring Fork river's high-water line (i.e. Stream Margin Review Area) are subject to heightened review under Title 26.43 5.040 of the City of Aspen's Land Use Code. • The applicant also applied for, and received, Residential Design Standard approval for all exterior alterations to the building. Most applicable to this case are the standards established for "the expansion, remodeling or reconstruction of existing development." In summary, staff has evaluated these standards and determined the following: a) Documentation was submitted that shows a reduction in total proposed floor area, the total floor area decreases by 3.3 sq. ft. These calculations will need to be verified at building permit. Given the reduction in floor area, the proposal meets the criteria for any increase in floor area as a percentage of the total allowable floor area. b) The remodel does not require the removal of any trees.No site work is being proposed. c) The proposed work will_not cause any portion of the building to be any closer to the high-water,line than currently exists. d) No building envelope has been designated through prior review, all work is within existing setbacks. e) The proposed structure is not within the 100-year flood plain. The Parks and Engineering Department reviewed and approved the application for Stream Margin Exemption. Therefore, considering the review criteria for a stream margin exemption, staff fords that the proposed remodel to the entry way and other exterior alterations qualifies for an exemption from Stream Margin Review. For a more detailed analysis of the review criteria for this exemption, please refer to Exhibit B. DECISION: The Community Development Director finds the request for Stream Margin Exemption at 311 Park Ave. as noted above is consistent with the review criteria (Exhibit B) and thereby, APPROVES the Stream Margin Exemption as specified above.
