Felson Irrevocable Trust and Jayme N.Felson Irrevocable Trust From: Ute Place Subdivision Homeowners Association(the"Association")Architectural Committee(the "ARC") and Board of Directors Re: Lot 4,Ute Place Subdivision(36 Ute Place,Aspen, CO) Approval of Improvement Envelope and Hot Tub Relocation To Joe and Sherry: You have requested a variance for the relocation of a portion of the improvement envelope for Lot 4 of the Ute Place Subdivision, located at 36 Ute Place, as more thoroughly detailed in the letter from Bill Poss and Associates Architecture and Planning,P.C.'s January 20, 2016 letter to Danielle Nussmeier,the Ute Place ARC Coordinator(the"Application Letter"). The relocation of the improvement envelope is requested to allow for the relocation of a hot tub farther away from Lot 3 of the Ute Place Subdivision in order to increase the privacy of both Lots 3 and 4. The improvement envelope and hot tub as relocated are depicted in the attached Exhibit A. Pursuant to the requirements and procedures of the Covenants, Conditions and Restrictions for Ute Place Subdivision,the ARC,Board of Directors, and in excess of 67%of the members of the Association have all voted to approve your request as described in the Application Letter, subject to the following conditions: 1. The hot tub will be screened from view in accordance with the planting plan submitted to the ARC as presented in emails dated April 28,2016 and May 5,2016. } 2. You must obtain all necessary City of Aspen land use approvals necessary to complete and record an Amended Plat for Lot 4 and provide a copy of the same to the ARC prior to beginning construction. 3. The Association's approval is contingent upon any terms and conditions imposed by the City of Aspen and the Association reserves the right to impose new requirements in light of any conditions imposed by the City of Aspen. 4. You shall be responsible for payment of all fees and expenses incurred from the iI Association's attorney and management in connection with the approval, :ompletion and recordation of the amended Plat. f 5. This approval shall be of no force or effect and shall be deemed to be revoked if you are unable to secure the Plat Amendment for the proposed improvement envelope from the City of Aspen.
