All referenced code sections are from the City of Aspen Land Use Code unless noted otherwise. You can find a copy of all adopted codes on our website. The attached comments must be addressed. Please revise and redraw the plans to clearly respond to the attached comments. Plan corrections cannot be made on the blueprints (i.e., red-lined). All changes must be made to the originals prior to making prints. Revised drawings must clearly show code compliance. In addition, please resubmit this comment letter with your written response to each comment. Your response should indicate which detail or specification page shows the required information. Responses such as "will comply with code" are not adequate. Finally, please provide both a physical copy and a digital file of your resubmission. The comment letter should be a Word document. If you have any questions specifically regarding the comments below, please feel free to contact me directly. If you have questions regarding the status of other review agencies' comments, the status of your permit in the queue, or general permitting questions,please contact your Permit Coordinator. (See above for phone numbers.) IMPORTANT NOTE: Zoning plan check is only one part of the often complex process by which projects are reviewed for approval. These parts are interrelated and are sometimes conflicting. Because we are issuing these first review round comments prior to the time that all review agencies have completed their work, you are receiving incomplete comments from the City as a whole. It is ultimately the applicant's responsibility to respond to the requirements of ALL review agencies. Building Department agencies, you assume any and all risks associated with needing to adjust, update, modify, or otherwise redo your work. When you have received and addressed ALL items from ALL review agencies, please call 970-920- 5090 to schedule a required appointment for re-submittal with your Permit Coordinator. You will be required to bring a copy of this letter, along with ALL other staff comment letters, with ALL responses and required documentation. If all items listed have not been addressed, the resubmittal will be deemed incomplete, and will not be accepted. ZONING PLAN REVIEW COMMENTS AND CORRECTIONS 1. Please provide deck-exemption, existing and proposed. The deck-exemption is based on 15% of allowable floor area. If deck exemption exceeds 15% or allowable; floor area calculation of the existing house will be required. Zone district: R-15/PD Allowable Floor area listed on Deed of Conveyance Floor Area Calculations based on COA(City of Aspen) Code 1986 Deck-exemption: 15% of allowable floor area Lot 4 Deed of Conveyance: allowable floor area 4,200 square feet Deck-exemption for lot 4: 630 square feet Response: A brief History of 35 Ute 2006 Permit submitted and approved for a total remodel of the house 2010 Permit submitted and approved for changing a covered BBQ area to an office, and an exterior reconfiguration. Please refer to the attached PDF—Existing FAR Calculations— 11.01.10. Sheets G-002 thru G-004 were the FAR sheets submitted and accepted for the 2010 permit. At the end of the project we had 3.08 sf of available FAR and no available deck area for the property, so the required deck area used up 70.91 sf of FAR. A summation from the sheet G-002 is shown below: Available FAR in 2010 177.94 sf 2010 New FAR 103.95 sf 2010 Deck area counted as FAR 70.91 sf (174.86 sf total) Remaining FAR 3.08 sf Thus,per 26.575.020 D.4, to have the deck FAR for a new stair from the main level deck to the lower level, we have to take existing deck area from one area that is equal to the size of the new stair. Please refer to the permit Sheets FAR1 thru FAR3. FAR1 describes the size of the new stair(47 sf). FAR2 describes the size of the existing deck on the upper level of 102.66 sf. FAR3 describes the size of the area we are taking out of the deck to give to the new stair. (49.5 sf). At the end of this permit we will still have 3.08 of available FAR and 2.5 sf of available deck area(49.5 sf- 47sf) for the property. Response: The height of the retaining wall around the spa is 3'-4". 3. Please provide outdoor lighting information Response: A proposed lighting plan PDF has been attached to the email. It is named 36ute—Proposed Lighting Plan—042417. We have included the fixture cut sheet. The new fixtures are LED. 4. Please provide reception number for plat amendment Per the City of Aspen Clerk, the Reception number is Book 118, Page 84. I have attached a PDF copy of the recorded plat. 5. Zoning Compliance Verification policy will be required to verify correct location of the new improvements Response: A Zoning Compliance Verification Policy has been signed by the contractor and has been attached to this email.
