The City Planning Staff is in support of the lot line adjustment between Qwest and the
Housing Authority so that the Housing Authority can acquire approximately 15,000
square feet of land that will be part of the Burlingame Ranch Subdivision. We would
request that following the approval of the Lot Line Adjustment, the subject property be
annexed into the City of Aspen.

Description of Project/Development: The Applicant is proposing to acquire approximately 15,000 square feet

RE: Request to for Lot Line Adjustment Fee Waiver
Please accept APCHA's request for a lot line adjustment fee waiver.
APCHA will go through the Pitkin County Board of Commissioners for approval.
The project in question is the City of Aspen's purchase of 15,004 sq. ft. of Qwest
Telecommunications outdoor parking facility. This 15, 004 sq. ft. will join or become a
part of Burlingame Ranch Subdivision Lot 1 which was previously annexed into the City.
APCHA plan is to construct a 100% affordable housing project on the combined land as
noted above. For more information, please see the enclosed application.

Dear Ms. Pregl:
Please consider this correspondence in follow up to our pre -application conference with both
City of Aspen and Pitkin County legal and community development staff. In addition, this
correspondence is the required summary letter explaining the request and addressing all
necessary Land Use Code Standards as stipulated by Pitkin County Community Development.
The Aspen/Pitkin County Housing Authority (APCHA) is working to purchase roughly 15,004
sq. ft. of Qwest Telecommunications' outdoor parking facility located at the Aspen Airport
Business Center (AABC). The roughly 15,004 sq. ft. begins at the N.E. corner of the Lot 3 of
Block 1.
Qwest is currently the legal owner of the area in question, but has provided its consent to move
forward with the approved land use process. Please see attached letter from Brenda Lewis of
Qwest, dated April 22, 2002.
The acquisition of this land will:
• be annexed into the City of Aspen;
• ensure adequate access to and from the site for emergency services, law enforcement,
commercial services, and resident vehicles for any future affordable housing project;
• combine and compliment a section of the City's land on the lower sloping west side of
Deer Hill to produce a more desirable (i.e. flat and stable) building envelope;
• ensure flexibility within the building envelope to provide adequate parking, storage and
other basic amenities for APCHA's customers and the City of Aspen's constituents;

• allow a range of 24 to 30 affordable housing units as reflected in the unit range outlined
in the 2000 Aspen Area Community Plan; and
comply with the goals and purpose of Urban Growth Boundary.
Land Use Code Standards:
Pitkin County Code - Sec. 3-190-030; Subdivision Exemption of a Lot Line Adjustment:
A. The adjustment creates not more than the original number of lots or parcels.
Response: The small area (15, 004 sq. ft.) in question will join and, thus, become a part
of Lot 1 of the Burlingame Ranch Subdivision (Burlingame Ranch Lot 1 has
been annexed into the City of Aspen). No additional lots or parcels will be
created. The small area in question will be immediately annexed into the City
of Aspen. Any future site planning and construction will fall under the City's
Land Use Code.
B. The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel,
nor any increase in floor area ratio for a parcel which gains size, nor creation of a lot or
parcel substantially different in size for development or resale purposes.
Response: Again, the small area in question will not create a new lot or parcel, nor will
there be an increase in floor area ratio for a parcel which gains in size, nor will
there be the creation of a lot or parcel substantially different in size for
development or resale purposes. In addition, both Pitkin County Community
Development and Pitkin County Legal Counsel believe a Lot Line Adjust is
the most efficient and effective manner to subdivide and annex.
C. In the case of conforming lots and parcels any resulting lot or parcel shall conform to the
minimum requirements for area or width established by the provisions of the Code.
Response: The small area in question will be immediately annexed into the City of
Aspen. Any future site planning that will involve conformity to minimum
requirements for area or width which will fall under the City's Land Use
Code.
D. In the case of substandard size lots or parcels, the resulting lots or parcels may increase in
non -conformity as to lot size so long as the other standards of this code continue to be
met.

Response: The small area in question will be annexed into the City of Aspen. Any future
site planning and construction on the site will involve conformity to the
requirements of the City of Aspen's Land Use Code.
E. The applicant shall prepare a subdivision exemption lot line adjustment map in
compliance with the standards in Section 5-60.
Response: Please see attached subdivision exemption lot line adjustment map.
F. A lot line adjustment shall not be used to increase the floor area ration for a parcel that
increases in size due to the adjustment. The floor area ration will be reduced on a parcel
that decreases in size due to the adjustment. Applications to add floor area ratio to a lot
or a parcel are considered to be major plat amendments and shall be reviewed pursuant to
Subsection 3-190-090.
Response: There will be no increase in floor area ratio. The small area in question will
be immediately annexed into the City of Aspen. Any future site planning and
construction will involve conformity to the minimum requirements that fall
under the City's Land Use Code and its regulations.

Buy and Sell Real Estate dated February 4, 2002, pursuant to which Buyer is acquiring from
Seller a parcel of land in the Aspen Business Center Filing No. 1, Pitkin County, Colorado
("Contract").
Pursuant to section 4 b of the Contract, the sale is subject to Purchaser's ability to complete
a legal subdivision of Lot 3, Block 1, Aspen Business Center Filing No. 1. By this letter,
Seller hereby acknowledges that it has granted the Buyer the authority to proceed with the
legal process for effecting such subdivision; provided that no such subdivision shall be
effective until on or subsequent to the closing of the sale under the Contract.
