SUMMARY:
Jeanette Darnauer ofthe Darnauer Group, has applied for an Insubstantial
Amendment to the Aspen Highlands Village Planned Unit Development (PUD) on
behalf of the Aspen HigWands Master Association to amend the lighting regulations
to allow for outdoor movies to be shown adjacent to Building 4. Currently, the code
is unclear as to whether this type of illumination and activity is permissible. The
applicant has notified neighbors both in and around to the village and has agreed to
comply with the City's noise regulations.
Community Development staff recommends approval ofthe requested Insubstantial
Amendment to allow outdoor movies at Aspen Highlands Village.

criteria, and hereby approves the following amendment to the Aspen HigWands Village
PUD: The Aspen Highlands Village PUD Development Guide lighting standards shall
permit outdoor movies in the village core.

REVIEW CRITERIA & STAFF FINDINGS
The standards for an Insubstantial PUD Amendment for the Aspen Highlands Village
PUD were set by Ordinance 8, Series of 2000, Section 4. The Section states:
The Community Development Director is hereby authorized to approve minor PUD
amendments to the Aspen HigWands PUD which are intended to change an element or
condition of the development permit; provided, however, that the proposed amendments
are consistent with the following standards:
a. The amendment must be a clarification or a technical correction to a plat.
b. The amendment must not change the use of the proposed development
between residential, commercial and tourist accommodation uses.
c. The amendment must be consistent with action taken during the review of
the original development and does not constitute new land development
activity.
d. The proposed activity does not:
i. Change the basic character of the approved use of land on which the
activity occurs including basic visual appearance and method of
operation;
ii. Increase off-site impacts in the surrounding neighborhood;
iii. Endanger public health, safety or welfare;
iv. Substantially increase the need for on-site parking 01' utilities, or
affect affordable housing generation; and
v. Increase the floor area of the use by more than two (2) percent or
decrease open space on the site by more than three (3) percent.
Staff Finding
Standard a. is not relevant because the amendment is not a clarification or technical
correction to a plat.
The amendment does not change the use ofthe proposed development in any way and is
consistent with action taken during the review of the Aspen Highlands Village PUD.
In addition, the basic character of the approved land use does not change. Off-site
impacts on the surrounding neighborhood will not be increased as the applicant has
agreed to comply with the City's noise requirements. The amendment also does not
change the amount of FAR or open space for the neighborhood or the need for on-site
parking or utilities. Finally, the amendment does not endanger the public health, safety or
welfare.

Dear Julie Ann:
Thank you so much for your consideration to amend the light ordinance that will allow us
to bring Aspen's first outdoor movie theater to Aspen HigWands. This letter will address
the marketing strategy behind "Outside at the Movies," a logistics plan, and our plan for
informing HigWands' residents of the potential impact.
"Outside at the Movies" is part of our "Rediscover HigWands" program, designed to
strengthen brand identity of the Aspen Highlands and to stimulate business. The
foundation for the plan is based on a series of five intensive focus groups conducted in
May by the Darnauer Group with long-time Aspen Highlands and Aspen-area skiers,
HigWands and Aspen-area employees, and HigWands and Maroon/Castle Creek Valley
residents. They told us that we need to "put the fun back into HigWands." They asked for
unique, activities and events (free, when possible) that are indicative of the free-spirited
nature on the mountain. Already, we've had an overwhelming response by members of
the community who are excited about "Outside at the Movies."
Following is our plan and schedule of movies:
Outside at the movies will take place Tuesdays, July 16 through1t1J{ 20,2002, starting at
approximately 9 p.m., or sundown. Movies will run no later than midnight.
We plan to use up to a 5000-lumen projector to project movies onto a 12-foot wide by 9-
foot high screen, which will be placed on the mound of grass at the south end of the
garden park. The projector will be placed on the garden park approximately 20 feet from
the screen.
We have secured two 15-inch JBL speakers, which will be placed on each side of the
screen, projecting sound length-wise onto the garden park. We will comply with the
sound ordinance, which allows for 65 decibels.
Public seating is on the garden park.

Aug. 6 - The Sound of Music
Aug. 13 - Butch Cassidy and the Sundance Kid

We b~lieve that we have taken every precaution to minimally impact HigWands's
residents of which there are only six in the building located at the base of the mountain,
adjacent to the garden park. The movie is being projected onto a screen, not into the
night air, nor is it being projected toward the residents or residents of the Ritz Carlton
Club. We already have posted flyers on residents' doors and surrounding neighbors
indicating dates and times of all of our proposed activities and events, and we will
continue to alert them in this manner. The Master's Association, which represents the
Aspen HigWands residents, is sending a newsletter in which it lists a summer schedule of
events. We posted flyers on Aspen Highlands resident's doors and have mailed a
schedule of events to the Maroon/Castle Creek Caucus. And, of course, we've been
advertising on the radio and in The Aspen Times and distributed posters throughout the
valley.
If this unique event is as successful as we anticipate, we'd like the opportunity to
continue through September and next year.
