SUMMARY:
Amy Margerum, representing the Aspen Institute and Aspen Music Festival
("MAA"), is requesting an insubstantial amendment to the Aspen Meadows SPA
to allow two public events to run concurrently on July 2, 2002. As part of the
representations during the approval process for Harris Hall (one aspect of the
Aspen Meadows SPA), it was agreed that Harris Hall and the Music Tent would
not be used for public events simultaneously. The Applicant is requesting this
stipulation be waived for one day so that the Aspen Institute can hold a special
event in Harris Hall and the MAA can proceed with the regularly scheduled
concert.
Staff has reviewed this proposal and recommends that the Community
Development Director approve the SPA Amendment as proposed.

REVIEW PROCEDURE:
Insubstantial amendments to an approved SPA may be approved by the Community
Development Director, pursuant to Land Use Code Section 26.440.090, Amendment
to SPA Development Order.
STAFF COMMENTS:
Review criteria and Staff Findings have been included as Exhibit "A." The
applicant's request is Exhibit `B."
RECOMMENDATION:
Staff recommends the Community Development Director approve this Insubstantial
SPA Amendment to allow the Aspen Meadows and MAA to hold concurrent events
on July 2, 2002.
APPROVAL:
I hereby approve this Insubstantial Amendment for two concurrent events to be held
at the Music Tent and Harris Hall on July 2, 2002, finding that the review criteria has
been met.

Review Criteria & Staff Findings
Insubstantial SPA Amendment.
The Community Development Director may approve an amendment to an approved SPA
if the proposal meets the following review standards.
1. A change in the use or character of the development.
Staff Finding:
Staff does not believe that the proposal changes the character of the Meadows
SPA. Staff finds this criterion to be met.
2. An increase by greater than three (3) percent in the overall coverage of structures on
the land.
Staff Finding:
The proposed SPA Amendment will not change the land coverage of the
Meadows SPA. Staff finds that this criterion does not apply.
3. Any amendment that substantially increases trip generation rates of the proposed
development, or the demand for public facilities.
Staff Finding:
Staff believes that the Aspen Institute is promoting the Cross Town Shuttle to
help mitigate for the increased traffic demands of the proposed amendment. In
addition, some of the attendees are being housed at the Aspen Institute and will be
shuttled to the Harris Hall by bus. Staff feels that the Applicant has made
sufficient arrangements to mitigate for the traffic impacts of the proposed
amendment. Staff finds this criterion to be met.
4. A reduction by greater than three (3) percent of the approved open space.
Staff Finding:
The amount of open space will not be affected by the proposed amendment. Staff
finds that this criterion does not apply.
S. A reduction by greater than one (1) percent of the off-street parking and loading
space.
Staff Finding:
The applicant is not requesting an amendment to the existing or required number
of parking spaces. Staff finds that this criterion does not apply.
6. A reduction in required pavement widths or rights -of -way for streets and easements.
Staff Finding:
The applicant is not proposing changes to right-of-way widths. Staff finds that
this criterion does not apply.
7. An increase of greater than two (2) percent in the approved gross leasable floor area
of commercial buildings.
Staff Finding:
The applicant is not proposing changes to the gross leasable floor area of
commercial buildings. Staff finds that this criterion does not apply.
8. An increase by greater than one (1) percent in the approved residential density of the
development.
Staff Finding:
The applicant is not proposing a change in the residential density. Staff finds that
this criterion does not apply.
9. Any change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a further variation from the project's
approved use or dimensional requirements.
Staff Finding:
The Applicant is not requesting an amendment to the project's approved
dimensional requirements. Staff believes that the proposed amendment to allow
one day when two public events can occur simultaneously requires a variation
from the original SPA approvals, and the Applicant is so requesting this action
through this insubstantial SPA amendment.

As part of our free community Summer Speaker Series, we are
Planning for an exciting array of dynamic and popular speakers. To
kick off the Series, Thomas L. Friedman will speak on July 2, 2002 at
5:00 p.m. In the past, we've hosted Friedman in Paepcke Auditorium
to a packed house and had to turns away another 50-100 people. This
year, we are hoping to hold the event in Harris Hall so that we can
accommodate more people. Unfortunately, the MAA has a concert
occurring at the same time in the Music Tent: the American Academy
of Conducting Orchestra from 4:00 to 6:00 p.m,
,Under the terms of the Aspen Meadows SPA, we are asking the City,to,
waive the prohibition against simultaneous events in the Tent and
Harris Hall for this event. In the past, this has been deemed an
insubstantial amendment to the SPA.
Although I know that traffic and parking are the main issues that went
into including this condition in the approvals, I strongly feel that the

impacts on the West End neighborhood will be negligible for this
