Smuggler. I hope that the desigo meets the criteria established for our historic house.
As we spoke about, the fence will be in the front of the house located on the south property line.
I have not included any of the information regarding the landscaping plan, as I figured it best to
meet with you in person to discuss the issues.

Preservation Plan
All existing materials on the exterior of the home which are to be retained, will be restored or
kept in their current condition. The existing historic siding is in very good condition. There is
not a need to perform any major restoration of the siding or trim. Any areas of the exterior which
require repair or replacement (should only be the one non-historic window on the west and one
non-historic window on the east), will be done with salvaged material or with replicated material.
The historic windows which are to remain in place will be repaired and put into working order.
All existing parts of the windows will remain and returned to their original location.
All existing exterior hardware will remain. The hardware will be repaired and returned to it's
original location.
The two existing exterior doors will remain. The hinges, knobs, locks, and rosettes will be
repaired and returned to their original locations. The operability of the doors will be repaired so
that the doors provide adequate security and functionality.
Any existing material on the exterior of the home which needs to be replaced, will replicate the
current material
HPC Staff and/or monitor must determine which exterior materials are beyond salvage and must
be replaced.

Our final submission for review of the proposed addition to the Contributing
Historic Structure is enclosed.
In response to the Conceptual Review and Conditions, several adjustments have
been made:

to give a bolder relief pattern.
A 12" indent is introduced to the one-story connection
element where it meets the historic cottage.
In addition, we have determined that foundation below the historic structure to be
very shallow and precarious and have decided to create an engineered concrete
foundation to support the cottage. In so doing, we will be creating a full basement
below. The resulting above-grade impacts of the added basement area will be two
window wells on the east, and some added fenestration on the west.

SUMMARY: 610 W. Smuggler is an approved HPC project that has been under
construction for the past year and is nearing completion. .. The applicant has determined
that an area that was labeled as one of the two required on-site parking spaces will
necessitate removal of a group of aspen trees that both he and the. Parks Department
would prefer to save. As a result, an application has been mad.e to waive the requirement
for the space. One space will be available in the garage and other parking can be on the
street.
Please note that there is mention in the application of a request for a variance on the
height of a fence. This request has. been withdrawn.

Section 26.415.1l0.C. Parking reductions are permitted for desigoated historic properties

zoning. Commercial desigoatedhistoric properties may receive waivers of payment-in-
lieu fees for parking reductions.
1. The parking reduction and waiver of payment-in-liue fees may be approved
upon a finding by the HPC that it will enhance or mitigate an adverse impact
on the historic significance or architectural chara.cter of a designated historic
property, an adjoining designated property or a historic district.
Staff Finding: The attached site plan shows the eight aspen trees that are located in the
area meant to serve as on-site parking. The applicant has proposed to move the parking
space from the aspen grove area to the space tucked up against the back of the garage.

This area is 6'5" wide and 18' long, which is 2'1" narrower than the minimum required
by the code. Staff's position istha.t it is better to waive the requirement for the second
parking space than to try to legalize the proposed substandard spot, which would likely
result in any car parked there encroaching into the public alley. In addition, the waiver of
the dimensional requirements for the space would have to be based on a finding of
hardship, which mayor may not be presented by the existence of the aspen trees.
Staff does recommend' that the HPC waive one parking space. If the Parks Departroent
prefers that the trees not be cut down, there is no place else on the site that would be
appropriate to the architectural character of the historic resource to put the parking. The
desigo guidelines do not refer speCifically to this issue other than to say that the only
location for parking that can be supported in a circumstance like this is off of the alley.
RECOMMENDATION: Staff r\=lcommends HPC grant approval for a waiver of one

SUMMARY: This property was recently part of a historic landmark lot split application.
The outcome of the lot split was to allow this 3,000 square foot lot to be separated off
from the 6,000 square foot property to the east, and to establish a total FAR of 1,340 on
the subject site.
The applicant requests approval to make minor modifications to the house and to
demolish non-historic construction at the back and replace it with a new one story
addition and garage. Rear yard setback variances are requested.

SIGNIFICANT DEVELOPMENT (CONCEPTUAL)
No approval for any development in the "H," Historic Overlay District, or involving
historic landmarks shall be granted unless the Historic Preservation Commission finds
that all of the following standards (Section 26.415.010.C.5) are met:
a. The proposed development is compatible in general design, scale, site plan,
massing and volume with designated historic structures located on the parcel
and with development on adjacent parcels when the subject site is in an "H,"
Historic Overlay District, or is adjacent to an historic landmark. For historic
landmarks where proposed development would extend into front yard, side
yard and rear yard setbacks, extend into the minimum distance between
buildings on the lot, exceed the allowed floor area by up to five hundred (500)

square feet, or exceed the allowed site covered by up to flVe (5) percent, HPC
may grant necessary variances after making a finding that such variation is
more compatible in character with the historic landmark and the
neighborhood than would be development in accord with dimensional
requirements. In no event shall variations pursuant to this Section exceed
those variations allowed under Section 26.520.040(B)(2), for detached
accessory dwelling units, and
Staff Finding: The project involves changing windows on the old house, demolishing
non-historic construction, and making a new addition at the rear of the property.
This project in general is a great illustration of the benefits of historic landmark lot splits.
The original house is roughly 600 square feet, and the addition about 740 square feet.
This relationship between the size of the addition and the historic resource is much more
sympathetic than is the case with the vast majority of projects that come before HPC.
The addition is all one story (except for a small loft over the garage) and is in scale with
the miner's cottage.
The historic building is not being lifted for a basement. There are a few window changes
that require discussion. On the east elevation, an original window is eliminated and a
non-historic horizontal window is to be replaced with a double hung. Staff has no
concerns with the latter action, but does not support eliminating the historic window.
Presumably the request is made because the front room is being made into a master
bedroom, however, the design guidelines discourage eliminating original features.
3.2 Preserve the position, number and arrangement of historic windows in a
building wall.
o Enclosing a historic window opening in a key character-defining facade is
inappropriate, as is adding a new window opening. This is especially important on
primary facades where the historic ratio of solid-to-void is a character-defining
feature.
o Greater flexibility in installing new windows may be considered on rear walls.
o Do not reduce an original opening to accommodate a smaller window or door or
increase it to receive a larger window on primary facades.
Again, staff does not have a concern with changing the horizontal window because an
opening has already been created and the proposed window is more appropriate to the
house. The trim or other detailing of this new window should be slightly different than
on the historic ones.
On the west fa9ade, another non-historic window is proposed to be replaced with a new
double hung. As stated above, this is appropriate because the opening exists and the
double hung is in character with the miner's cottage. This elevation also shows a new
skylight in the kitchen area. The guideline is as follows:

7.3 Minimize the visual impacts of skylights and other rooftop devices.
. Flat skylights that are flush with the roof plane may be considered only in an
obscure location on a historic structure. Locating a skylight or a solar panel on a
front roof plane is not allowed,
. A skylight or solar panel should not interrupt the plane of a historic roof. It should
be positioned below the ridgeline.
The skylight is back far enough on the roof that it won't be visible from the street,
therefore staff could support this alteration.
In terms of the addition to the building, staff finds that it complies with the design
guidelines and is very effective in its use of a one story connecting element and modest,
contemporary architecture. The small garage building will make a positive contribution
to the alleyscape.
Two variances are needed for the project; a 3'7" rear yard setback variance and a 7'3"
combined front and rear yard setback variance. The garage is 5 feet from the alley, which
is permitted, but only when there is no upper floor living space. Staff finds that the
variances are appropriate because they allow the new construction to be pushed back on
the lot, away from the historic house and the minimum setback of 5 feet is maintained.
b. The proposed development reflects and is consistent with the character of
the neighborhood of the parcel proposed for development, and
Staff Finding: The surrounding neighborhood contains a mix of old and new homes, and

PARTIAL DEMOLITION
No approval for partial demolition shall be granted unless the Historic Preservation
Commission finds all of the following standards are met:
A. The partial demolition is required for the renovation, restoration or
rehabilitation of the structure, or the structure does not contribute to the
historic significance of the parcel.
Staff Finding: A one story addition at the back of the building is proposed to be
demolished, It will be replaced by a new flat roofed piece that forms a connection
between the new and old. Staff supports the reconstruction of this piece.
B. The applicant has mitigated, to the greatest extent possible:
(1) Impacts on the historic significance of the structure or structures
located on the parcel by limiting demolition of original or significant features
and additions, and
(2) Impacts on the architectural character or integrity of the structure or
structures located on the parcel by designing new additions that are
compatible in mass and scale with the historic structure.
Staff Finding: No Sanborne maps are available for this block and the building permit
file does not address this addition. From inspection, it does not appear to be historic
construction.
RECOMMENDATION: Staff recommends HPC grant conceptual approval, partial
demolition, and variances with the following conditions:
1. The HPC approves a 3'7" rear yard setback variance and a 7'3" combined front
and rear yard setback variance.
2. The original double hung window on the east fa<;:ade must be retained.
3. The trim on new windows on the historic house must be slightly different than

Additions proposed to the historic cottage include a family room, one-car garage
with partial loft, and a mechanical basement, all to the rear of the existing
dwelling.
The existing dwelling has a height of 14 feet, and the proposed additions, a height
of 18 feet. However, due to the distance of the addition behind the ridge of the
historic cottage, the addition will not be visible when viewed from eye level at the
street.
No changes are proposed to the street-front elevation ofthe historic dwelling.
