HomeMy WebLinkAboutresolution.council.010-24RESOLUTION NO.10 (Series of 2024) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, REAPPOINTING TED D. GARDENSWARTZ AS DEPUTY JUDGE FOR THE MUNICIPAL COURT AND AN ADMINISTRATIVE HEARING OFFICER IN AND FOR THE CITY OF ASPEN. WHEREAS, Ted D. Gardenswartz has served has the Deputy Judge for the Municipal Court in and for the City of Aspen since July 2009; and WHEREAS, the Charter of the City of Aspen, Section 7.2(b) authorizes the City Council to appoint one or more Deputy Judges in the event that the Municipal Judge is unavailable or must recuse himself due to a conflict; and WHEREAS, Section 17.04.040(b) of the Municipal Code provides that additional judges may be appointed by resolution for a term of two years; and WHEREAS, Chapter 26.222 of the Municipal Code authorizes the appointment of one or more Administrative Hearing Officers for the purposes of hearing certain appeals within the Land Use Code by City Council and shall serve for a term of four years; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, That said Ted. D. Gardenswartz be and hereby is reappointed a Deputy Judge oI the Municipal Court of the City of Aspen to preside over court cases as required of him; and That said Ted. D. Gardenswartz be reappointed an Administrative Hearing Officer pursuant to Chapter 26.222 of the Aspen Municipal Code.
