Aspen St. Parcel ID: 273513124015 Zone District: Lodge (L) 809 S. Aspen St. is located at the top of S. Aspen Street and the property falls within the 8040 Greenline review area established in Section 26.435.030 of the Aspen Land Use Code. Due to the location property is above or within 150 feet measured horizontally from the 8040 feet above sea level elevation. Pat Dempsey, represented by Carrie Tirrell, KA Designworks, submitted an application to remodel unit 16 of the Shadow Mountain Townhomes. The exterior scope of work includes the following items: • Replace window on east facade, • Remove existing chimney. Staff has reviewed the scope of work and has determined that no additional site disturbance will occur and there are no impacts on the items address through 8040 Greenline Review. There are no adverse visual impacts, will not require additional grading, will not result in negative impacts to drainage or water quality, all proposed work is compatible with the existing site, and there are no impacts to trees or vegetation. The project qualifies for an 8040 Greenline Exemption as the review criteria can be met: a) does not add more than 10% of the existing floor area, or more than 25% of areas exempt from floor area b) does not require the removal of any tree c) no portion of the project will be any closer to high water line than existing development d) does not fall outside of an existing building envelope e) will cause no increase to the amount of ground coverage within the 100-year flood plain The scope of work identified above is therefore approved. However, if during the building permit process, the scope of work is amended, a new review will be required that may involve a more extensive analysis under the 8040 Greenline Exemption. This approval does not constitute a site-specific development plan and will not be issued a development order. The approval does not convey a vested right and the approved project is subject to any changes to the Land Use Code prior to building permit submittal.
