A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, APPROVING A CHANGE ORDER TO THE CONTRACT
BETWEEN THE CITY OF ASPEN AND STUTSMAN GERBAZ INC.
AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT ON
BEHALF OF THE CITY OF ASPEN, COLORADO,
WHEREAS, there has been submitted to the City Council a change order for
to the original contract for construction of Cozy Point Ranch Phase II Grading and
Drainage Improvements between the City of Aspen and Stutsman Gerbaz Inc., a
true and accurate copy of which is attached hereto as Exhibit "A",
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO,
That the City Council of the City of Aspen hereby approves a change order
for construction of Cozy Point Ranch Phase II Grading and Drainage
Improvements, between the City of Aspen and Stutsman Gerbaz Inc., a copy of
which is annexed hereto and incorporated herein and does hereby authorize the
City Manager to execute said contract on behalf of the City of Aspen.
INTRODUCED, READ AND ADOPTED by the City Council of the City of
Aspen on the 27t' day of August, 2024.

Site construction services for phase 2 grading and drainage
improvements at Cozy Point Ranch.
This change order includes two change orders provided by
Stutsman Gerbaz lumped into one COA submitted change order.
These change orders are attached at the end of this document
and are described as follows:
12" Irrigation Cap Installation: $4,848.00
A previously unlcnow agricultural irrigation system riser pipe was
discovered within a project work area on site. This pipe has not
been used for many years and is not needed and in the way of
planned use for this area. The scope of this work is to follow this
irrigation riser back to the irrigation mainlinno A to properly cap
the irrigation mainline at this location. This work involves
excavation, capping of pipe, and backfill.
Horse Coral Fence Re -build: $34,199.28
As work has progressed into the northern metal horse corals
that were slated to remain, a few actions were determined
needed to address issues in this area. It was determined that this
area needs to be mucked out and re -graded due to inferior base
material and improper slopes for

where existing fence is in the way to properly perform this work.
It was also discovered that the existing metal coral fencing was
rusting in many locations and may be dangerous and have a
limited remaining lifespan. It was determined that the best
approach to resolve these issues is to remove the exiting fence
so grading work can be performed and replace the existing
degrading fence with new horse coral fencing to match horse
fence that is being installed elsewhere on the project. This work
covers the cost of the grading work and re -installation of fence
in this area.
