The Code provides that all land and air space within one hundred feet (100') measured horizontally from the high water line of the Roaring Fork River and tributary streams shall go through a stream margin review prior to the issuance of a building permit. My clients have an existing structure within one hundred feet (100') of the river. Their children are growing and they need to expand their existing residence. The contemplated renovations will all take place away from the river as is indicated on the map and plans being submitted with this application. It is important to note we have an existing structure and my clients, sensitive to the intent of stream margin review, have planned all additions away from the river. Their new construction will not contravene the intent of the stream margin review as set forth in §24-6.3. It is most important my clients receive approval for these expansions; otherwise they will be forced to sell their residence and move to a new house which would clearly be an unwarranted hardship. An examination of stream margin review and the history surrounding it clearly shows the Planning and Zoning Commission has discretion, under the intent of §24-6.3, to grant a building permit for my clients. I believe this application meets the standards of the criteria set forth under the review criteria for stream margin review.
