KAUFMAN BOX 10001 611 WEST MAIN STREET ASPEN, COLORADO 81611 April 7, 1981 Mr. Sunny Vann Aspen/Pitkin Planning Office 130 South Galena Street Aspen, Colorado 81611 Re: Gruenberg Stream Margin Review Dear Sunny, TELEPHONE AREA CODE 303 925-8166 Please consider this letter an application for a stream margin review pursuant to §24-6.3 of the Aspen Municipal Code. The Code provides that all land and air space within one hundred feet (100') measured horizontally from the high water line of the Roaring Fork River and tributary streams shall go through a stream margin review prior to the issuance of a building permit. My clients have an existing structure within one hundred feet (100') of the river. Their children are growing and they need to expand their existing residence. The contemplated renovations will all take place away from the river as is indicated on the map and plans being submitted with this application. It is important to note we have an existing structure and my clients, sensitive to the intent of stream margin review, have planned all additions away from the river. Their new construction will not contravene the intent of the stream margin review as set forth in §24-6.3. It is most important my clients receive approval for these expansions; otherwise they will be forced to sell their residence and move to a new house which would clearly be an unwarranted hardship. An examination of stream margin review and the history surrounding it clearly shows the Planning and Zoning Commission has discretion, under the intent of §24-6.3, to grant a building permit for my clients. I believe this application meets the standards of the criteria set forth under the review criteria for stream margin review. Mr. Sunny Vann April 7, 1981 Page Two We have submitted plans and specifications along with this application that meet the requirements of section (b) of stream margin review. If you have any questions, please feel free to contact me. Very truly yours, t.
