Maroon Creek Bike Path Application- City Referral Comments DATE: June 26, 2003 The City of Aspen Planning Staff reviewed the Maroon Creek Bike Path Application and has the following comments: 1. The Applicant is required to also obtain a stream margin review exemption approval from the City of Aspen for the portion of the trail that is to be constructed within the City Limits due to the fact that it is proposed within 100 feet of the high water line of Maroon Creek. 2. The City Planning Staff agrees with the Applicant that the proposal is consistent with. the City of Aspen Trail's Plan to establish a pedestrian trail connection between Aspen Highland's Village and the Aspen Recreation Center/ Community Campus Area. Moreover, the -City Planning Staff also believes that placing the trail on the western side of Maroon Creek Road will lessen the amount of opportunities for pedestrian/bicycle/ automobile conflicts. 3. The City Planning Staff would suggest that silt fencing be required on the downhill side of the construction in every place where excavation is proposed in an effort to control the erosion of the hillside. Additionally, the City Planning Staff would also suggest that the County Staff obtain more detailed information regarding the methods of soil retainage that are going to be implemented during the construction process. Additionally, the area of disturbance that is identified on the plans does not appear to account for the two (2) overlook areas. City Staff would suggest that the plans be revised to include the overlook areas within the identified area of disturbance. 4. The City Planning Staff also suggests that the Applicant consult with the County Engineer to verify that the proposed changes to the alignment of Maroon Creek Road are acceptable. • • 5. A fence elevation should be included in the application and reviewed to determine if the fence will be tall enough on the western side of the trail to ensure the safety of the trail users. The following submission has attempted to include all of the materials necessary to allow a thorough review of the application. INTRODUCTION The City of Aspen Parks and Recreation Department (hereinafter the "applicant") is requesting approval of a pedestrian/bike trail, known as the Maroon Creek Bike Path, along the west side of Maroon Creek Road in unincorporated Pitkin County. z 82 EOP - `Z o� STA 31 +01.45 N:X E:X) / N c I ROCN CREEK RD r r f o ilEHq 4D o- c a r BOP - % ti STA 10+00.77 / y (N:X E:X) VICINITY MAP Please see the Project Design Drawings enclosed within ATTACHMENT F for an illustration of the trail. The trail will begin at the Aspen Highlands Village and travel approximately 1,440-feet to the Aspen Recreation Center (ARC). For reasons explained below, the trail alignment is located partially within City Limits on open space property owned by Pitkin County, and partially within unincorporated Pitkin County along the Maroon Creek Road right-of-way. It is the portions of the trail located on the Maroon Creek Road right-of-way that are subject to this request for 1041 Hazard Review. PROPOSED DEVELOPMENT The applicant is proposing placement of a 10-foot wide pedestrian/bike trail that will connect the Highlands Base Village to the Aspen Recreation Center and School Campus. The site is located along the west side of Maroon Creek Road north of the Highlands Ski area. The 1041 Hazard Review Site Plan, enclosed within ATTACHMENT F, shows the specific trail alignment. As mentioned above, this alignment crosses over road right-of-way and open space owned by Pitkin County. The completed trail will create a safe pedestrian trail corridor where one does not currently exist. This trail will contribute to a connection for the "seamless" trail system the City of Aspen is striving to accomplish by connecting the residents and visitors of Aspen Highlands Village to the High School/Community Campus area and further on into town. A key link for the community trail system will result from the creation of this trail. The Maroon Creek Bike Path will bring users to the trail system connecting to the High School/Community Campus area, Tiehack Ski area and to the Marolt and Moore open space areas. A further connection is created between the Owl Creek/Highway 82 AABC trail and the Cemetery Lane Trail to the Rio Grande Trail Regional Trail. Increased public recreation opportunities and an alternative transportation option for commuters traveling up and down the Maroon Creek corridor will result. When completed, this trail will be managed and maintained as part of the City of Aspen trail system. The Maroon Creek Bike Path is the result of citizens petitioning the Aspen City Council and Pitkin County Open Space and Trails Board for a trail connection between Highlands and High School/Community Campus area. The applicant has already initiated the public review process and has experienced a high level of support for this proposed trail project. Because of existing environmental factors present along the alignment of the Maroon Creek Bike Path, the City has committed to taking innovative measures to ensure that the environment is minimally impacted. Included as ATTACHMENT A are photographs of the existing conditions along the alignment. The alignment of the trail must cross three steep slopes/escarpments on the west side of Maroon Creek Road. In order to maintain a safe trail environment and to minimize impact on the slopes, pedestrian bridges are proposed to cross the steep sections. The pedestrian bridge spans and abutments will be designed to minimize impact to the steep slopes. Much of the remaining proposed trail alignment will be located on the natural benches along Maroon Creek Road. The trail alignment was placed on the west side of Maroon Creek Road primarily because of the several side -road crossings required if the trail were to be placed on the east side. In addition, the west side alignment offers the opportunity to meander MAROON CREEK BIKE PATH 1041 PAGE 2 HAZARD REVIEW the trail in and out of small stands of aspen and scrub oaks, greatly adding to the trail experience without compromising safety. The trail will provide a safe, quality experience to the trail user. The existing route is a stressful experience that is potentially detrimental to the pedestrian or biker, as it requires the co -mingling of vehicular and non -vehicular traffic on a single roadway. The current situation is not safe to use by school -age children. The new, separate trail alignment will permit the user to avoid this unappealing experience and be able to focus on the spectacular scenic vistas of Maroon Creek and native vegetation this route has to offer. 1041 HAZARD REVIEW AND CONCEPTUAL SUBMISSION The land use code provides a one-step review/approval process for 1041 Hazard Review before a Hearing Officer. 5-20-010(B): APPLICANT'S BACKGROUND INFORMATION: The owner of the project is: The City of Aspen Parks & Recreation Department, Jeff Woods, Manager 130 South Galena Street Aspen, CO 81611 (970)920-5129 See ATTACHMENT B for authorization by The City of Aspen for the following firm to represent it during the land use approval process: Tom Newland, Newland 417 Original Road, Basalt, CO 81621 Project Resources, Inc. (970) 927-4645 (970) 927-8148 fax tomn(cbsopris.net 5-20-010(C) PARCEL DESCRIPTION: The property is located in the northwest quarter of Section 14, Township 10 South, Range 85 West of the 6th Principal Meridian. It consists of approximately 0.67-acres of county road right-of-way and county open space. Enclosed within ATTACHMENT F is an Ownership and Zone District Map. Also enclosed within ATTACHMENT F is a 1041 Hazard Review Site Map that shows a more specific location of the trail with respect to the road right-of-way and county open space property. 5-20-010(D) DISCLOSURE AND PROOF OF OWNERSHIP: This portion of the Maroon Creek Road corridor is a Pitkin County road right-of-way and not a part of the city streets system. Included as ATTACHMENT C is a letter from the Pitkin County Board of Commissioners allowing the City to use portions of its properties for purposes of this project review and approval. 5-20-010(E) LEGAL ACCESS: Access to the property is from Maroon Creek Road. 5-20-010(F) STANDARDS REPORT: The following addresses the sections of the Land Use Code as specified during the pre -application conference (See ATTACHMENT D for a copy of the Pre -Application Conference Summary): Section 3-80: Areas Of Local And State Interest/1041 Environmental Hazard Areas: The following subsections of this section are applicable to the proposed development: MAROON CREEK BIKE PATH 1041 PAGE 3 HAZARD REVIEW 3-80-40 Geologic (Slopes, Rockfall): Most of the open space property owned by Pitkin County and some short portions Maroon Creek Road right-of-way contain areas in excess of 30% or slopes between 15% and 30%. The 1041 Hazard Review Site Map enclosed within ATTACHMENT F shows the specific areas of slopes greater than 30% and slopes of 15% to 30%. In addition, the area where the slope exceeds 30% is also an area of rockfall (see ATTACHMENT A for photographs of this area). Despite the challenging site conditions, the west side alignment for the trail was selected for a variety of reasons. The most important reason for a west trail alignment is the minimization of road/trail crossings that would compromise trail user safety. The west side alignment is sited away from residential properties located adjacent to the east side of the road. Significant slope modification would be necessary for a trail alignment along the east side of Maroon Creek Road. Finally, the trail users experience is much better since the trail alignment can be sited to create a buffer from the road and provide spectacular views to the Maroon Creek corridor. The applicant has developed a site plan that utilizes pedestrian bridge spans over the slopes greater than 30%. This design is presented on the Project Design Drawings enclosed within ATTACHMENT G of this application. This approach substantially reduces the amount of excavation and disturbance required on the steep slopes. The applicant intends to utilize the natural benches that exist on the west side of Maroon Creek Road as much as possible except in the areas that will require pedestrian bridges. These natural benches are located adjacent to slopes in excess of 30% but are themselves relatively flat and are covered with mature, native grasses, shrubs and trees. Following the benches allows the trail to be placed on top of the land rather than cut into a hillside, which would be necessary if the trail alignment was located on the east side of Maroon Creek Road. Minor cutting and filling will be required to smooth out portions of the grade along the proposed alignment. Any land disturbed by the placement of the trail in this area will be revegetated upon completion of the work. SUMMARY OF FINDINGS The following conclusions can be reached from the findings of The Standards Report above: The applicant will utilize pedestrian bridges, as described within the application; to span the areas of steep slopes along the trail alignment. It is anticipated that this project will require several development permits from the County prior to initiation of construction. These permits will likely include an Earthmoving Permit and a Right-of-way Work Permit. The applicant agrees to furnish detailed construction drawings of the bridges, including specific abutment design, to the County Engineer for approval as a part of any development permit application submitted for the project. 2. The applicant will utilize the natural benches along the roadside to eliminate the need for significant excavation and retaining of the slope. The applicant MAROON CREEK BIKE PATH 1041 PAGE 4 HAZARD REVIEW agrees to furnish detailed construction drawings of the trail project to the County Engineer for approval as a part of any development permit application submitted for the project. 3. The trail alignment will also cross through native Gambel Oak, Aspen and Serviceberry vegetation along the vegetated benches alongside Maroon Creek Road. In the process, some Gabel Oak, Aspen and Serviceberry will be removed. The applicant agrees to place multiple new trees in close proximity to the project area to mitigate the loss of the existing vegetation. The applicant agrees to work with the County Wildlife Biologist to develop an appropriate restoration/revegetation plan for the bench areas prior to issuance of any development permit(s) required for the project Thank you for accepting this application.
