Galena Street, P Floor Aspen, Colorado 81611 Attn: Ms. Suzanne Wolff Subject: Tract "A" of Lot 20 -Application for Extension of Vested Rights & 1041 Hazard Review Amendment Dear Commissioners: In April, 2004, the owners received an offer from the City to purchase the subject property. The sale never materialized. Recently, as a courtesy, the owners made an offer to sell it to the Aspen Parks Board for one million dollars less than the actual value recently established by the Pitkin County Assessor. It was deferentially declined. Interest in acquiring this lower site on Shadow Mountain for Open Space has apparently waned in favor of more prominent lands. It appears that preservation of Shadow Mountain for Open Space is no longer a priority since the Little Cloud Subdivision recently receiving approval to extend the driveway to house sites No. 3 & 4, which will result in three additional houses being built above and adjacent to subject property. Thus, the visual impact of a house on Tract "A" becomes marginal. Since the current 1041 Approval expired two weeks ago and the opportunity for the City to purchase this property has passed, I am submitting this application for an Extension of the Vested Rights, granted July 16, 2003, by Determination No. 32-2002, and for an amendment to the building envelope to include slopes in excess of 30% pursuant to Ordinance No. 26-2003. I request that the Board consider the logical outcome of the Little Cloud four house sites when deciding the appropriate location for the house on Tract "A". As presently approved the building envelope for Tract "A" is located only 18' from Little Cloud's Lot 2. Applicant believes that this is too close given that the size of the subject property is 0.9 acres. An illustrative overview of the lots is shown on page 12. EXTENSION OF VESTED RIGHTS: Land use code, Section 4-140-030, allows the Board to approve the extension of vested rights after considering: L 2 ' 1. Applicant's compliance with any conditions requiring performance to the date of application for extension. Applicant's response: There are no known ' requirements that require performance prior to date of this application. 2. Progress made in pursuing the project to date and the expenditures made I by the applicant in pursing the project. Applicant's response: A list of development expenditure in excess of $17, 000 is shown on page 6. 3. The nature and extent of any benefits already received by the County as result of project approval. Applicant's response: The benefits received by the County, City and Public are shown on page 7. ' 4. The needs of the County and the applicant that would be served by approval of the extension. Applicant's response: An approval of this Extension ' Request will allow the owners to fulfill their needs by selling the property to finance their retirement. A purchaser will need the Extension in order to have the assurances that he can build a home without being subject to changes in the Code. ' The County will benefit by having a new home on the property that will increase the County's tax base for generating additional real estate taxes. In additional, the Caretaker Unit, of up to 1, 000 square feet will provide a caretaker/employee housing ' unit located on the edge of Aspen. SLOPES IN EXCESS OF 30%: ' Code Section 33-80-050.C.I.c.ii., provides for a building envelope to be extended into slopes in excess of 30% under certain conditions. The subject property qualifies for an ' expansion of the envelope under both sub -paragraphs b and c. Sub -paragraph b addresses a parcel that contains some areas of less than 30% slopes but the area is not large enough to develop the floor area that is permitted on the parcel by underlying zoning. Sub -paragraph c ' deals with minor slope anomaly when the slope is due to the presence of a minor natural or man-made change in the gradient of a continuous slope. The proposed Expansion Area shows a minor slope anomaly with most of the expansion area having slopes of less than r30%. The expansion area consists of 1,966 sT that adds approximately 25% to the size of the envelope. The average distance of the proposed property line shift is approximately 16 ' feet to the west. The expansion area that is between 30% and 45% grade is highlighted on the amended plat at page 10. (Complete 11" x 17" plat maps are on pages 28 and 29. In addition, two 24" x 36" folded copies are attached). The existing building envelope contains 7,956 s.f that will be utilized in conjunction the expansion into the area over 30%. A building envelope needs space other than the land ' upon which house sits, space for a yard, space for an parking area for service vehicles & guests and space for a driveway to a two or three car garage. A larger envelope provides the architect with more flexibility and freedom in fitting the house on the site along with an ' attractive yard & landscaping without "boxing" the building onto a small site. The distance between the existing building envelope and Little Cloud, Lot No. 2 building envelope is just 18 feet. Were two houses to be built 18' art they may give the appearance of being one I monster house thereby negatively impacting the visual appearance. The spacing between the two envelopes is illustrated on page 11. ' A requirement in the 1041 Approval specifies that the foundation be designed to provide rock fall and avalanche mitigation in addition to mitigation being built on the Little ' Cloud property. By providing flexibility to allow the house to be moved to the west the need for rock fall and avalanche mitigation features to be built into the house will be reduced. ' REAL ESTATE TAXES: The real estate taxes for 2004 were $12,300. Unless the tax rate is reduced in 2005, which appears unlikely, the annual taxes will increase to $28,500. Because of the current zoning of this property there is no escape from these taxes, because agriculture use such as ' livestock grazing on this property is prohibited. The insanity that prevails in government that results in taxation having the power to destroy makes it illogical for the current owners to continue to own this property. Thus, it is necessary that for property be sold and ' developed. CONSIDER THE ETHICAL ISSUE: The history of this property is described in a newspaper article regarding a Forest Service Land Exchange which is enclosed at page 30. A letter relating to the exchange ' written by Stanford Johnson to the Board, dated 10/20/99, is enclosed on page 31. The 1041 Hillside Approval (1991) was in effect during the negotiations for the sale ' of a portion of Lot 20 to the County for a trail. It is important to note that the purpose of the County in making the Open Space purchase was to establish a trail. There was no trail across Lot 20 until after the Open Space Sale. The owners felt that their building envelope ' was protected from any negative interference if a trail and bridge were built because of the building envelope was located on the top and side of the slope. The owners never had a desire to build on this property themselves, but wanted to maintain the desirable hillside envelope as a substitute and reminder of the back -county views they gave up to the Forest Service. Thus, they agreed to allow a trail bridge to be ' built, which they now regret. Subsequently, to the Open Space Sale the County adopted a prohibition against building on slopes over 30%. As a result of the previous Boards failing to acknowledge that 1991 Vested Rights Approval was fully vested, the owners were forced to move the site down to the bottom of the slope, now mostly located outside of the original envelope, which was later approved in 2002. Thus, the proposed house is faced with a potential trail bridge negatively impacting the home due to the current site being located ' next to the trail crossing. As a partial remedy to the building envelope being forced down the slope, I am requesting that the Board agree to delete the Open Space Contract provision that allowed a bridge to be built over the driveway. This driveway will service one house ' and the auto traffic will be insignificant as compared to the trail where it crosses a street. I Thus, a trail crossing on grade is appropriate for crossing a driveway to a single family house. If the ethics of the previous boards are examined regarding the events associated with and subsequent to the Open Space Sales Contract, dated 9/10/92, it should be clear that the County has failed to recognize that this property's 1991 Approval should have been grandfathered from any changes in the County Code since that date. The owners relied on the 1991 hilltop and hillside approved envelope as their building site in negotiating and granting concessions to allow for a Open Space trail bridge to be built. Therefore as a preferred alternative, I ask the Board to remedy the situation and reinstate the 1041 Approval of 1991 as being fully vested. ' Driveway Excavation Permit Fees have been paid to both City and County. Both Engineers have reviewed the proposed excavation plans. A Fee was paid to the Sanitation District for resolving a technical problem with the sewer line into which this property would connect. A recap of expenditures is shown below, which includes engineering, rockfall & avalanche study and drilling a domestic water well. ' Expenditures incurred since approval of 1041 Review in 2002 are as follows: Development Costs: Engineering & Surveying — Trail Cllt & Street End $ 5,350. Excavation Permit Fees 800. ' Drilling of Water Well & Testing 6,000. Sanitation Engineering Fees 1,300. Rockfall & Avalanche Experts 3,800. ' Total $ 17,250 Real Estate Taxes: ' Total R.E. Taxes for 2002, 2003 and 2004 36,300. Total Expenditures ............... $ 53,550. ' B. Nerotiatint! for sale of Tract "A" to City for Open Space. In addition to pursuing the actions necessary to commence construction of a residence on the property, the owners kept the ' door open for the County and/or City to purchase the property for Open Space during the last three years. First, the Owners, at the request of a member of Friends of Shadow Mountain, made an Offer to sell to the City and/or County on 10/31/02. Second, the City made a later offer to purchase the property on 4/22/04. Finally, the owners made a second offer to provide the City with a last opportunity to acquire the property, which was not accepted by the City Open Space Board on 6/19/05. 0 I BENEFITS RECEIVED BY THE COUNTY, CITY &PUBLIC ' Over the last 19 years the owners have voluntarily kept the property as "Open Space" and picked up trash, left by hikers and campers, from the time snow melt to time snow falls. The last ' three years of Real Estate taxes on the property total $ 36,300. The County Code prohibited the property from being used to produce an income or evade the high tax rate associated with undeveloped land; i.e., no livestock allowed. ' Second Street Design. The City is benefiting from a "free" engineered street design at end of Second Street. The owners paid several thousand dollars for the cost of surveying and ' designing a "turn around". The design has been approved by the City Engineer. (The current condition of the street at end of Second Street is shown on page_ f . The engineered street design plat is on page /f . ' Little Cloud Road. Development of Tract "A" has been delayed pending a resolution of a dispute regarding the extension of the Little Cloud Driveway which now has been resolved. A ' building permit has been issued to extend the Little Cloud Driveway to houses No. 3 & 4. A rock fall and avalanche mitigations plan for Little Cloud was necessary in order to facilitate the mitigation for Tract "A". The road design provides for a Bruge Net to be constructed that will ' provide rock fall protection to the subject house. 1 ' 24 YEAR HISTORY & CHRONOLOGY OF LAND USE ACTIVITY ' Hunter Creek Land Purchase. Reeder acquired a block of 15 patented mining claims (106.5 acres which he subdivided into three 35 acre building site) plus an 8.4 acre claim all located in Hunter Creek Valley in 1981. These claims plus the 9.0 acre Favorite Lode, located above Ashcroft, (owned by Stanford Johnson) were traded to the Forest Service. Deeds to Private Lands Presented to Forest Service. Reeder delivered deeds to the privately ' owned lands to the U.S. Forest Service Office as part of his land -exchange with U.S. Forest Service. An Aspen Times newspaper article, dated 6/20/85, regarding the deed presentation is on page jo ' U.S. Forest Service Trade — U.S. Patent to Lot 20 Received. The outcome of the trade was that Reeder gave the equvalent of "100 acres for 1 acre", by giving up four building sites in ' Hunter Creek and a Cabin located above Ashcroft. A photo of the Cabin is on page Tz .Owners received a U.S. Patent to Lot 20 on April 2, 1986, over 19 year ago. ' First 1041 Land Use Application Approved —1991. A 1041 Approval was granted on August 20, 1991, for a building site located on the bench and into the hillside by Resolution PZ-91-45. A copy is on Page 10 . ' Tract "A" created b Subdivision Ex emption xemption Plat to Facilitate Open Space Sale The County purchased a portion of Lot 20 for Open Space on 1/08/93. A Subdivision Exemption Plat was created to subdivide the property resulting in creation of Tract "A" of Lot 20. A copy of the Plat is on Page 26 . ' Application for Extension of the 1991 Vested Rights which was denied. An Application requesting an extension of the 1991 Vested Rights was filed on April 30, 1998. The Extension ' was denied after which a Takings Hearing was requested. Takings Hearing. The 1041 Approval obtained in 1991 provided for the house to be build on ' the upper bench and into the hillside on slopes in excess of 30%. BOCC held a takings hearing at their November 17, 1999 meeting. Since the County regulations had changed prohibition building on slopes over 30% the County no longer would allow the house site to remain in it's t original location. The Board decided that the owner is entitled to apply to the County for approval under the current regulations and that potentially beneficial uses of the property remain. ' Second 1041 Land Use Application Approved -2002. The Hearing Officer granted 1041 Approval for three years on 7/16/02. ' 1041 Approval Amended — Clarified Maximum Floor Area. Hearing Officer made a clarification that the Allowed Floor Area was 9,800 square feet. It was done to clarify the intent of the 1041 Approval on 1/28/03. ' Owners Offered to Sell For Open Space. On 10/31/02, owners made an Offer to Sell the Property at the request of a Member of Friends of Shadow Mountain. 1 1 8 ' City Council Denied Water Service. A requirement of the 1041 approval was to obtain City Water. Owner made Application for water to the City and on June 9, 2003, by Ordinance #26, Series 2003, City declined to grant water service unless the property was Annexed and reduced ' in size to 4,471 s.f. FAR, a 54% reduction. This reduction was unacceptable to owners. 1041 Approval Amended — Approved Water supply from a Well. The Hearing Officer made ' a Determination that allowed water service for the property to come from a Water Well 7/15/03. Owners had a Water Well Drilled. A water well was drilled on the property on 11/07/03, ' which will more than supply the needs of the property. City of Aspen Made Offer to Purchase. An Offer to Purchase the property was made by the ' City on 4/22/04, which Owners did not counter. Owners Offered to Sell to City Parks Board. Approximately 14 months after the City had ' made their offer to buy the property, the owners made a second offer to sell the property to City for one million dollars less than the "Actual Value" as established by the County Assessor. The Board considered and declined the offer at its June 19, 2005 meeting. Johnson, hereinafter "Applicants!', have applied to the Planning and Zoning Commission of Pitkin County, Colorado, hereinafter "Commission", for 1041 Geologic and Wildfire Hazard approval for a single-family residence pursuant to Section 5-400 of the Land Use Code; and WHEREAS, the Applicant's parcel is zoned R-15 and contains approximately 1.21 acres; and WHEREAS, the site is located at 333 S. Prior to issuance. of a building permit, the Aspen Water and Sanitation Districts shall_ review and approve a utility plan which identifies proposed location and design for extensions and connections to City water and sewer lines. If the site is not within the Aspen Districts, a petition for inclusion shall be required. 2. The applicant shall revegetate all areas disturbed by construction within one growing season of construction. A drainage, erosion control and revegetation plan shall be approved by the City and County engineers prior to building permit application. 3. Outside illumination shall comply with Pitkin County Lighting regulations in effect at the time of building permit issuance. 4. All development, with the exception of the access drive improvements, shall be located within the building envelope as designated on the Site Plan. 5. Prior to issuance of a building permit the applicant shall obtain an access permit from the City and County Engineer's Offices. 6. The applicant shall comply with Pitkin County air quality standards in effect at the time of building permit issuance. 7. Floor area shall be limited to a maximum of 16 percent of the lot area. 8. Recommendations regarding drainage of the site shall be adhered to. The consulting engineer recommends the following: a. There is a need for detention of a minor amount of water volume which can be accomplished by adding a dry well if sufficient detention is not retained behind the existing railroad grade. b. The applicant shall consult city engineering (920-5080) for design considerations of development within city public rights -of -way and shall obtain permits for any work or development within public rights -of -way from city streets 1 department ( 9 2 0-513 0) . _ 10. A portion of -the driveway is within the city limits. Therefore, the driveway shall meet applicable city code requirements. 11. The plans indicate a railroad tie retaining wall in the right- of-way. This appears to be an encroachment into the right- of-way by an adjacent property owner. This area shall be improved in conjunction with this project. The City Engineering Department shall review proposed improvements to this area. 12. Road cuts shall be treated with natural materials so as not leave bare earth faces and to prevent sluffing and erosion. Road cuts shall be approved by the City Engineering Department prior to issuance of a building permit. 13. The applicant shall coordinate with the City Engineer on development of the right-of-way at the end of Second Street to provide for displaced parking. The applicant shall work with the adjacent property owner to relocate the dumpster out of the public right-of-way at the end of 2nd Street. 14. Design of the driveway cut, and specifically, the proposed excavation of the Midland railroad grade must be finally approved by the Planning Department, the City and County Engineers, prior to issuance of a building permit. 15. Stone, wood and glass materials shall be utilized in construction of the home. Non reflective roof materials shall be utilized. 16. The house shall be limited to single story at the top of the building envelope, or a maximum height of 16' (to roof peak) at the top of the hill, and shall be designed so that any additional stories are stepped down the slope to minimize grading/site disturbance and visual impacts. 17. In the event that the applicant chooses to access the site from said road, the driveway alignment shall be subject to Planning Staff and County Engineer review and approval prior to issuance of an excavation permit. 1041 HAZARD REVIEW 19. The applicant acknowledges that he has been informed by Pitkin County of the existence of "1041 hazard areas" that might effect the property and any improvements, and the use and occupancy thereof. 20. The following wildfire mitigation measures shall be adhered to: a. All roofs will be kept cleared of debris b. Oak brush shall be thinned for a distance of 30 feet from the home. Thinning shall result in patches of vegetation within 10 foot spacing between the crowns of remaining patches. Dead vegetation within 30 feet of the home shall be removed. All vegetation within 10 feet of the home shall be removed with the exception of low growing grasses and plants. C. Firewood shall be stacked on a contour away from building (s). d. At least one ten pound ABC class fire extinguisher shall be placed in each structure. e. All power and telephone lines shall be underground. f. Roof materials shall be of non-combustible materials such as tile, metal or asphalt. 21. Recommendations made by Dr. Nick Lampiris shall be adhered to. They are as follows: a. Drainage within the adjacent depression shall be made positive so that ponding does not occur during spring runoff or thunderstorm activity. The alternative is to create a retention pond or dry well at that site where water will percolate and evaporate away, without draining into the street system. C. The rear foundation wall shall extend at least four feet above grade, be without windows, and be designed by an engineer to withstand whatever small scale snow sliding that could potentially reach the proposed structure. d. The_applicant shall include a foundation plan which has been certified by a structural engineer prior to issuance of a building permit. Said plan shall incorporate review and mitigation of subsidence on site due to past mining activities. e. It is possible to access `the site from the east, from South Second Street, along a properly designed hillside cut. Retaining walls and snow stabilization techniques shall be employed in the lower alignment, if required by the City and/or County Engineer. f. Nick s Lam iri p or other qualified professional geologist shall be present during the final staking of the structure. GENERAL 22. The applicant shall record a 24 x 36 inch mylar site plan which meets the approval of the Planning Office and County Attorney prior to the issuance of any building permits for the property. 23. All material representations made by the applicant in the application and in meetings shall be adhered to. Dear Chairman: The governing principle controlling the transaction by which Reeder and I exchanged our properties for Government Lot 20 was the City's and County's endorsement of the plan, and the public's desire, to relocate potential development from wilderness areas to urban areas by exchanging privately owned forest lands for equivalent market value property. I agreed to relinquish my 10 acre "Shangri-La" mountain retreat (see photos attached) for a 25% interest in Lot 20. This 25% interest was based upon Lot 20's value as having a spectacular ' hillside view building site equivalent in value to the property I gave up. Stuffing the building envelope down into a viewless hole behind a 20 feet high earthen ' embankment is not acceptable. A real estate broker has shown Lot 20 to prospective buyers who were flatly not interested in the property if the building envelope was to be in the hole. Dour building sites in Hunter Creek Valley, totaling 115 acres owned by Lyle Reeder and my ' 10 acres with a cabin on a pond, were relinquished in the exchange. Reeder's and my investment expectation is to be justly compensated for our unique wilderness lands. That is, by selling the replacement property, i.e. Lot 20 at market value or receiving market value as takings compensation. 1 The previous actions and agreements of Pitkin County, in 1993, in association with the Open Space transaction permanently vested original 1041 rights in the original building envelope as a ' contractual obligation. Thus, the original 1041 Review building envelope approval does not expire, cannot be rescinded or moved. Reeder and I relied upon the integrity of the local governments, in good faith, to respect this consideration and not later attempt to devaluate the value. Without a continuous display of sincere integrity by the BOCC, it is doubtful that other wilderness property owners will cooperate to exchange their properties for urban building sites. I am relying upon the integrity, honesty, and fairness of the ' BOCC to either acknowledge the frilly vested original 1041 Review on Lot 20, or purchase the property by paying fair market value.
