Staff recommends that the County require the applicant to use non -reflective roofing materials, and that the house meet the Residential Design Standards of the City of Aspen. 2. Staff recommends that the County refer this application to the City of Aspen Parks Department regarding the landscaping and vegetation preservation on the development site. 3. Staff recommends that the County require that no parking be allowed in the proposed turnaround. Providing two more parking spaces on site would help ensure that there would be no vehicles parked in the turnaround. 4. Staff recommends that the garage be further recessed back from the front property line to meet the City's Residential Design Standards. 5. Staff recommends that underground utilities be installed in the existing Newfoundland Road. This would preserve the greatest number of significant trees in the project area and will retain the visual and ecological value of the surroundings. Klein, Esq. I. STATEMENT OF INTENT This application is submitted by Herbert S. Klein, Esq., on behalf of Win Win LLC, (the "Applicant") with respect to its property located at Newfoundland Lode Mining Claim M.S. 5190 (the "Property"). The Property has obtained 1041 Hazard review approval pursuant to BOCC Resolution #99-186, a copy of which is attached at Exhibit 1. Now that building plans have been prepared, the Applicant is submitting this application for Scenic Overlay Review and Special Review for an attached Caretaker Dwelling Unit ("CDU"). The Property is located adjacent to the boundary of the City of Aspen and is accessed from Ute Avenue. II. SCENIC OVERLAY REVIEW The application satisfies the provisions of Section 3-60-040. The Property is not located on a ridgeline nor is it visible from Highway 82. The Property is marginally visible from the Smuggler Mountain Road. The review criteria of Section 3-60-040 and the satisfaction of them are detailed as follows: 1. Whether the proposed development has utilized existing topography and natural vegetation, such as ridges and hills to screen buildings to the maximum extent possible. The Property is a steeply sloping hillside with abundant evergreen trees. The building envelope is at the bottom of the slope and mostly screened by trees below and along side the building envelope. The residence will be built into an existing excavated area and will fully mitigate the eyesore that this existing excavation has created. 2. Whether the proposed development has been designed to complement the natural topography of the land, including, whenever possible and appropriate, the utilization of innovative architectural techniques such as • • earth sheltered design, natural materials and coloring, non-reflectability and clustering of structures on the least visible portions of the site. Because the location of the building envelope is within an excavated area, the residence will be largely earth sheltered. The exterior materials are mostly indigenous rock and wood siding. The roof materials are non -reflective and colors will blend into the surrounding forest terrain. Architectural elevations are attached at Exhibit 2. 3. Whether the proposed development's height and bulk has been designed to avoid, to the maximum extent possible, the visibility of buildings from the highway and public viewplanes. The BOCC Resolution granted approvals for a residence of 5930 square feet (including all basement, storage and similar areas), plus a 750 square foot garage. The combination of locating the building envelope at the lowest portion of the Property, placing it within an existing excavated area and designing it to blend in with its natural surroundings, reduces its visibility from the public viewplane of the Smuggler Mountain Road, over one mile away, to the maximum extent possible. 4. The proposed structure shall be placed so it does not break a ridgeline, unless there are no alternate building sites on the lot. The building envelope does not break a ridgeline. 5. Whether the proposed development has avoided the location of uses on the highest ground or most visible portion of the site as viewed from State Highway 82 and public rights -of -way, identified in Section (13)(1) above. As previously described, the location of the building envelope is on the lowest portion of the Property and behind a large row of mature trees. Therefore, it does not visually intrude on the views of the Property from Highway 82 and is only minimally visible from the Smuggler Mountain Road. We note that the entire City of Aspen is visible from the Smuggler Mountain Road. 6. Whether the proposed development has been located outside of the designated Scenic Overlay, or on a suitable site at the greatest distance possible from State Highway 82 and identified ridgelines. The building envelope is located the greatest distance from Highway 82 and the Smuggler Mountain Road as is possible. 7. Whether the proposed development has been landscaped in accordance with the adopted State Highway 82 Corridor landscape guidelines and has newf-scenic-caretkr.app 1 2 preserved natural vegetation, to the maximum extent possible, including the avoidance of development within irrigated meadows. Existing vegetation shall be maintained to the maximum extent possible, while using existing vegetation to screen development. A landscaping plan shall be submitted by the applicant and approved by the Planning and Zoning Commission. The location of the building envelope behind an existing row of mature trees and alongside a heavily wooded hillside, screens views of the area within the building envelope from Highway 82 and the Smuggler Mountain Road. Wildfire control requires the thinning of the dense grove of trees immediately adjacent to and above the structure, however, a substantial number of mature evergreen trees remain. A detailed landscaping plan for the building envelope and immediately adjacent areas is attached at Exhibit 3. 8. Whether the proposed development's exterior lighting has been designed in such a manner that light sources, such as facade and landscape lighting, will not be seen from public rights -of -way as identified in Section (11)(1). In addition, an application shall be consistent with the lighting regulations identified in the Pitkin County Land Use Code. The exterior lighting fully complies with the Pitkin County lighting standards. 9. Landforms and earth moving shall generally not be acceptable as the sole measure of compliance with these regulations. However, they may be utilized in conjunction with other site techniques designed into the development plan. These methods may be acceptable when utilized as one of several methods to complement and enhance development, rather than as the single device for screening development from view from the State Highway 82 Corridor and as mapped. The proposed development does not require the use of landforms or earthmoving to comply with these regulations. 10. Whether the proposed development has been designed so as to avoid, to the maximum extent possible, any Scenic Viewplane identified on the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan. The proposed development does not affect any identified view plane. 11. In the case where 1041 hazard areas may be in conflict with preservation of scenic areas, the Board acknowledges that 1041 issues take precedence over scenic concerns. These issues shall be reviewed on a case -by -case basis. The 1041 hazards affecting the Property are slopes in excess of 30%, minor avalanche newf-scenic-caretkr.app I and wildfire hazards. The building envelope is at the lowest portion of the Property and thus harmonizes scenic quality and steep slope concerns. The wildfire hazard requires the thinning, not clear cutting, of trees adjacent to the building envelope. This thinning can be done without sacrificing the screening that the remaining trees provide. The application is fully consistent with the Scenic Overlay review standards (Section 3-60-040) and Land Use Policy 2-12. II. STANDARDS REPORT - CARETAKER DWELLING UNIT The residence will contain a one bedroom living space of approximately 375 square feet, attached to and within the single family residence on the Property. The caretaker unit is located on grade and its entrance is at the front of the residence, immediately to the west of the front door to the main part of the residence. The Property meets all applicable criteria for an attached CDU. LUC Section 3-150-130 allows the Community Development Director to approve CDU's when all requirements are satisfied. The requirements and specific responses are as follows: A. The CDU must be attached to the principle dwelling and be on a conforming lot in the AFR-10 zone district. Response. The CDU is attached to the principle dwelling. It is in the AFR-10 zone district on a ten acre mining claim and thus conforms with the zone district requirements. 1. The floor area of the CDU may not exceed 700 square feet. Response. The floor area is approximately 375 square feet. 2. The total floor area of the CDU and the principle dwelling may not exceed the allowable floor area. Response. The floor area of the principle dwelling, including the CDU does not exceed the permitted floor area of 5,930 square feet, plus a 750 square foot garage. 3. One off-street parking space must be provided. Response. One off-street parking space exists for the CDU. 4. The required CDU deed restriction must be recorded on the Property. Response. The Applicants will execute and record the CDU restriction. newf-scenic-caretknapp 1 4 • • III. SPECIAL REVIEW CRITERIA - 3-210-010 The special review criteria are as follows: A. The special review use shall consider: 1. The applicable County master plan and County land use policies in Article 2. The applicable master plans and County land use policies favor the provision of caretaker units, especially in areas close to the City of Aspen, like this Ute Avenue neighborhood. 2. Intent of the zone district. The AFR-10 zone district allows caretaker units by special review and this low density residential use is consistent with the intent of the zone district. 3. Character of neighborhood and uses in the vicinity. The land uses in the vicinity of the Property are similar single family residences, and nearby are several higher density condominium projects, an affordable housing project and the Aspen Club. 4. Impacts on the neighborhood. The CDU is within the existing residence and there are no impacts on adjacent land uses. 5. Adequacy of public facilities and services. Existing utilities, roads and public services are sufficient for the CDU and no increases in services will be required by the CDU. 6. Public health, safety and welfare. The CDU will not endanger public health, safety or welfare nor injure the value of adjoining or abutting property. 7. Time Limits. It is requested that there be no requirement for annual or periodic reviews of this Special Review Approval and that it be perpetual. IV. SUBMISSION CONTENTS The Submission Contents pursuant to LUC Section 5-70-020 and 5-80-010 are as follows: 1. The Applicants' representative met with Suzanne Wolff for a Pre -application conference. The Pre -application conference summary is attached at Exhibit 4. 2. Background Information. The Consent to Process attached at Exhibit 5 contains the requisite information on the Applicants. 3. LLC (- applicant") has requested development approval lollowing a staff determination that a previous approval had not been common law vested and that application of current Code standards would result in a taking. The approval sought is to construct a single-family residence following a takings determination by the Pitkin County Board of County Commissioners ("BOCC"). 2. The property is located at the base of Aspen Mountain adjacent to the Hoag Subdivision on Ute Avenue. and is described as the Newfoundland Lode Mining Claim, M.S. 5190. ;. The property contains approximately 10 acres and is zoned AFR-10. 4. The BOCC granted Scenic Foreground Overlay, General Submission and 1041 Hazard Review approval to construct a single family residence on the Newfoundland Lode. pursuant to Resolution No. 91- 87. 6. The BOCC subsequently granted an extension of vested rights pursuant to Resolution No. 94-198. 6. The vested rights expired on October 25, 1997. 7. The County Zoning Officer issued a notice of violation in 1996 for excavation of the building envelope on the Newfoundland Lode without permits. Section 7-20-030(E)(2) of the Land Use Code provides that "no land use approvals or building or other development permits shall be issued with respect to the property where the violation is believed to exist during the period of such violation." Mis outstanding violation has not been remedied. 8. The BOCC heard the Applicant's request at its regularly scheduled meeting of October 27, 1999, at which time evidence and testimony were presented with respect to this application. The Applicant shall submit a 24" by 36" 1041 site plan to the Community Development Department for approval and recording, prior to submission of any building permit applications. The site plan shall also be submitted in digital format for integration into the County's GIS system. The site plan shall comply with the provisions of Section 5-70-040 of the Land Use Code. Prior to issuance of any permits and within a reasonable amount of time, the Applicant shall: A. Pay S 1.560 (8 hours at $185/hour) to the Community Development Department to satisfy the time spent inspecting and responding to the Code violations. B. Submit a financial security in an amount and form acceptable to the County Attorney's Office for remediation of the existing violation. If the site is not developed in accordance with the development approval and the violation remedied within 24 months of the date of this approval, the BOCC may use the security to remediate the violation on the property This does not limit the BOCC from choosing other additional remedies to address this or other violations of the Code. 4. Prior to submittal of any building, permits, the Applicant shall: A. Obtain an access permit from the County Engineer to extend the driveway to the residence and to construct a portion of the required fire turnaround, if necessary. B. Submit documentation that a fire hydrant was installed as part of the excavation for the driveway, as required. If a hydrant is not in place, the Applicant shall install a hydrant prior to issuance of any building permits. C. Demonstrate proof of insurance to protect neighboring properties from potential water tlow and rockfall damage during construction of the residence to the satisfaction of the County Attorney. Prior to issuance of any building permits, the Applicant shall: A. Post avalanche hazard warning signs along the driveway, as approved by the Zoning Officer. B. Submit financial security in a form acceptable to the County Attorney to ensure the successful revegetation of the property pursuant to the approved Revegetation Plan. Land Management shall specify the required amount of the financial security. The financial security shall be held for a minimum of one full growing season after the revegetation is completed, unless Land Management specifies a longer term. C. Submit financial security in a form acceptable to the County Attorney to ensure compliance with the improvements agreement. The County Engineer and Community Development Director shall specify the required amount of the financial security. All areas disturbed by construction shall be revegetated to limit water consumption and additional runoff: within one growing season of project completion. 7. No development activity, including grading, landscaping, and vegetation removal or disturbance shall occur outside the building envelope, with the exception of driveway and utility extension and maintenance and the performance of wildfire mitigation required as part of this approval. No expansion of the approved square footage of the residence shall be permitted in the future. Development on the property is limited to a 5.930 square foot residence, all inclusive, and a 750 square foot garage. The ;Applicant shall comply with the following landscaping, and wildfire defensible pace mitivation standards to the satisfaction of the Colorado State Forest Service, prior to issuance of a C.rtiticate of Occupancy for the residence: A. Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of 45 feet uphill and to the sides of all structures. C. Spacing between clumps of brush and vegetation within the perimeter shall be a minimum of two times the hei,Ytt of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. D. All branches from trees and brush within the perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. E. Tree crown separation within the perimeter shall have a minimum of 10 feet between the edges of the crowns. F. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. G. The density of fuels within a 100 foot perimeter of all structures shall be reduced. H. All deadfall within the 100 foot perimeter shall be removed. 1. Low vegetation shall be maintained within a 10 foot perimeter around all structures. J. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. i l . The Applicant shall comply with the following additional wildfire mitigation standards: A. An exterior sprinkler system shall be installed. B. Roofs shall have a Class A, non-combustible roof system.
