Francis are requesting that the HPC allow the removal of an existing Non-Historic brick chimney and the installation of a new simulated (Cultured) brick chimney that will be more in keeping with the original chimneys removed by the previous owners. Also the owners would like to install 2- 4'-5"xl'-5" awning windows in the new Dining Room. These windows would be of similar trim and color as the existing windows and would be located high on the Dining Room (East) wall. This exterior wall faces the house to the East and will have minimal exposure to the streetscape. The proposed Chimney and windows are shown on drawing sheets A-2.4 and A-3.1. Thank you. 5/8/2006 A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION (HPC) APPROVING AN APPLICATION FOR A SETBACK VARIANCE FOR THE PROPERTY LOCATED AT 716 WEST FRANCIS STREET, LOTS N AND O AND THE WEST 15 FEET OF LOT P, BLOCK 15, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. 8, SERIES OF 2006 PARCEL ID: 2735-124-08-003 WHEREAS, the applicant, 716 West Francis LLC, owner, represented by Rod Dyer, architect, has requested a setback variance for the property located at 716 W. Francis Street, Lots N and O and the west 15 feet of Lot P, Block 15, City and Townsite o f Aspen, Colorado; and WHEREAS, for approval of setback variances, the HPC must review the application, a staff analysis report and the evidence presented at a hearing to determine, per Section 26.415.110.C of the Municipal Code, that the setback variance: a. Is similar to the pattern, features and character of the historic property or district; and/or b. Enhances or mitigates an adverse impact to the historic significance or architectural character ofthe historic property, an adjoining designated historic property or historic district; and WHEREAS, Amy Guthrie, in her staff report dated April 12, 2006, performed an analysis of the application based on the standards, found that the review standards and the "City of Aspen I listoric Preservation Design Guidelines have been met, and recommended approval with conditions; and WHEREAS, at their regular meeting on April 12, 2006, the Historic Preservation Commission considered the application, found the application was consistent with the review standards and "City of Aspen Historic Preservation Design Guidelines" and approved the application by a vote o f 5 to 0. NOW, THEREFORE, BE IT RESOLVED: That HPC hereby grants approval for a 5 foot rear yard setback variance for the second floor living space above the garage at 716 W. Francis Street, Lots N and O and the west 15 feet of Lot P, Block 15, City and Townsite of Aspen, Colorado with the following condition. Within 30 days of the date of this approval, the applicant must pursue an encroachment license from the City of Aspen Engineering Department to address the existing right-of-way improvements in front of the house. Failure of the Engineering Department to issue a license, or revocation of the license at a later date, will not invalidate the variance granted herein. Francis Street, Aspen, Colorado 81611 Dear Amy, Please find, herein and attached, our request for a 5 foot rear yard setback variance for the above referenced property. Mr. Stephen Briggs wishes to remodel the interior of the existing residence to increase the number of bedrooms from three to five and reorganize existing interior spaces in a more convenient manner. The exterior of the structure will not be altered. The existing structure was remodeled to its present configuration in 1992-1993. On March 5, 1993 a change order to the master permit was applied for, and approved, granting an additional 105 square feet of space in the master bathroom above the garage. In doing so the north wall above the garage was placed 5 feet from the rear property line instead of the required 10 feet. This change was approved by the staff Preservationist Kim Johnson and by the Zoning Officer Bill Dreuding and was subsequently built. A certificate of occupancy was issued on May 10, 1993. It appears that no variance was either applied for or granted for this intrusion into the rear yard setback. Mr. Briggs is in the process of purchasing the property from the previous owner and wishes to remove any cloud of non-conformity by requesting this variance. A rehabilitation project, including an addition, was completed in the early 1990's. The property has recently changed hands and it has become apparent that a building permit was issued to build a portion of the house within the rear yard setback even though a variance had not been granted. The new owner would like to correct this error. Staff finds that the proposal meets the review criteria. Approval of a variance is recommended. NOTE: The property has a bear proof trash enclosure in the rear yard setback, which is allowed. Staff requests that the applicant seek an encroachment license from the Engineering Department for the railroad ties and gravel parking in the right-of-way in front of the house. It would likely be preferable to HPC that this area be returned to grass. SETBACK VARIANCE This structure has a garage which is located 5 feet from the rear property line. That is a permitted setback, however living area above the garage is to be pulled back 10 feet from the rear lot line, which it is not. The owner requests a rear yard setback variance of 5 feet to legalize the location ofthe living space above the garage. The criteria for granting setback variances, per Section 26.415.110.C of the Municipal Code are as follows: HPC must make a finding that the setback variance: a. Is similar to the pattern, features and character of the historic property or district; and/or b. Enhances or mitigates an adverse impact to the historic significance or architectural character of the historic property, an adjoining designated historic property or historic district. Staff Finding: This project won an award from HPC in 1993 for achieving a sympathetic addition to a small historic building. HPC has typically supported granting relief to rear yard setbacks in order to push new construction as far as possible away from a historic resource, which relates to criterion "b," above. The variance was overlooked in 1993 and a building permit was issued to construct the house as it exists today. Staff finds that granting a 5 foot rear yard setback variance to legalize the configuration of the house as it currently exists is appropriate. DECISION MAKING OPTIONS: The HPC may: • approve the application, • approve the application with conditions, • disapprove the application, or • continue the application to a date certain to obtain additional information necessary to make a decision to approve or deny. RECOMMENDATION: Staff recommends that HPC grant a 5 foot rear yard setback variance for the second floor living space above the garage at 716 W. Francis Street, Lots N and O and the west 15 feet of Lot P, Block 15, City and Townsite of Aspen, Colorado. The applicant must pursue an encroachment license from the City of Aspen Engineering Department to address the existing right-of-way improvements in front of the house. Francis Street, Aspen, Colorado 81611 Dear Amy, Please find, herein and attached, our request for a 5 foot rear yard setback variance for the above referenced property. Mr. Stephen Briggs wishes to remodel the interior of the existing residence to increase the number of bedrooms from three to five and reorganize existing interior spaces in a more convenient manner. The exterior of the structure will not be altered. The existing structure was remodeled to its present configuration in 1992-1993. On March 5,1993 a change order to the master permit was applied for, and approved, granting an additional 105 square feet of space in the master bathroom above the garage. In doing so the north wall above the garage was placed 5 feet from the rear property line instead of the required 10 feet. This change was approved by the staff Preservationist Kim Johnson and by the Zoning Officer Bill Dreuding and was subsequently built. A certificate of occupancy was issued on May 10, 1993. It appears that no variance was either applied for or granted for this intrusion into the rear yard setback. Mr. Briggs is in the process of purchasing the property from the previous owner and wishes to remove any cloud of non-conformity by requesting this variance. Francis Street Dear Rod; The R-6 zone district requires homes to have a 10 foot rear yard setback, except garages and basements beneath garages, which can be within 5 feet of the rear lot line. It does not appear that the Aspen Historic Preservation Commission granted any rear yard setback variances when they approved the redevelopment of 716 W. Francis Street. It is my understanding that their approval included a garage with a 5 foot rear yard setback, and a master bedroom area above that with a 10 foot setback, as required. In 1993, a building permit was issued that allowed the master bedroom to be enlarged to match the garage footprint, but there is no record of HPC having granted a variance. This is a zoning violation that should be corrected either by removing the non- conforming construction or by receipt of a variance from HPC. We request that your client take one of these actions. '~ Commitment for Title Insurance Fidelity National Title Insurance Company A Stock Company COMMITMENT FOR TITLE INSURANCE FIDELITY NATIONAL TITLE INSURANCE COMPANY, a Corporation, herein called the Company, for a valuable consideration, hereby commits to issue its policy or policies of title insurance, as identified in Schedule A, in favor of the Proposed Insured named in Schedule A, as owner or mortgagee of the estate or interest covered hereby in the land described or referred to in Schedule A, upon payment of the premiums and charges therefor; all subject to the provisions of Schedule A and B and to the Conditions and Stipulations hereof· This Commitment shall be e#ective only when the identity ofthe Proposed Insured and the amount ofthe policy or policies committed for have been inserted in Schedule A hereof by the Company, either at the time of the issuance of this Commitment or by subsequent endorsement. This Commitment is preliminary to the issuance of such policy or policies of title insurance and all liability and obligations hereunder shall cease and terminate within six (6) months after the ejfective date hereof or when the policy or policies committed for shall issue, whichever jirst occurs, provided that the failure to issue such policy or policies is not the fault of the Company. This Commitment shall not be valid or binding until countersigned by an authorized officer or agent. CONDITIONS AND STIPULATIONS 1. The term "mortgage", when used herein, shall include deed oftrust, trust deed or other security instrument. 2. Ifthe Proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such knowledge. If the Proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien or encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 ofthese Conditions and Stipulations. 3. Liability of the Company under this Commitment shall be only to the named Proposed Insured and such parties included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and Conditions and Stipulations and the Exclusions from Coverage of the form of policy or policies committed for in favor of the Proposed Insured which are hereby incorporated by reference and are made a part ofthis Commitment except as expressly modified herein. 4. Any action or actions or rights of action that the Proposed Insured may have or may bring against the Company arising out of die status of the title to the estate or interest or (he status of the mortgage thereon covered by this Commitment must be based on and are subject to the provisions ofthis Commitment. ..
