A RESOLUTION OF THE CITY OF ASPEN, COLORADO, UPHOLDING THE APPEAL oF
STEVEN ST. CLAIR FROM AN ADVERSE DECisION OF THE ASPEN HiSTORIC
PRESERVATION COMMITTEE DE~ING ~ ~pLiC~TION~ FO~ F~AL SiGNff~iC~T
DEVELOPMENT AND VARIANCE APPROVALS FOR T~ PROPER~Y ~OCATED ~T 629
W. SMUGGLER STREET, LOT A AND T~ WEST HALF OF LOTBI BLOCK 2ii CiTY AND
TOWNSITE OF ASPEN.
WHEREAS, the apPlicant Steven St. Clair, requested final development and variances from
the Historic Preservation Commission for an addition to the historic home he owns at 629 West
Smuggler Street. The property is listed on the :Aspen Inventory of Historic Landmark Sites and
Structures; and
WHEREAS, on May 8, 2002, the Historic Preservation Commission denied the application;
and
WHEREAS, Steven Stl Clair filed an appeal to the City Council of the adverse decision by
the Historic Preservation Commission; and
WHEREAS, the City Council after full consideration and deliberation of the record before
it, the oral arguments of the applicant and his counsel, and the Historic Preservation Officer,
concluded that the Historic Preservation Commission did abuse its discretion in denying applicant's
application for final approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNC1L OF THE CITY OF
ASPEN, COLORADO, that the decision of the Historic Preservation Commission denying final
significant development and variance approval is hereby reversed.
