Mayor Pro Tem Richards called the meeting to order at 5:05 p.m. with
Councilmembers Vickery, Markalunas and Paulson present.
CITIZEN PARTICIPATION
There were none
COUNCILMEMBER COMMENTS
1. Councilman Paulson reminded everyone that Wednesday July 16 is "Find
Another Way" day and encouraged everyone to use alternative means to get to
work.
2. Councilman Markalunas noted there was an article in the Denver Post about
electric powered bicycles. This may be a good idea for the city. Councilman
Markalunas commended staff for participation in "Find Another Way" day. City
Manager Margerum said the city has an electric bicycle which is kept charged at
city hall.
3. Councilman Markalunas reported that "Thrash a Thistle Day" was a real
success. Councilman Markalunas said he hopes this will become an annual event.
Councilman Markalunas encouraged citizens to pull up thistles when they see them.
4. Councilman Vickery reminded everyone that members of OTAK are in town
meeting with property owners and tenants along Main and Monarch streets. This is
a good opportunity for citizens to participate in and learn more about the proposed
train.
5. City Manager Margemm said there will be a community celebration of the
grand opening of Rio Grande river park, Monday August 4 from 4 to 7 p.m. with a
barbecue and band. Everyone is invited.
6. Assistant City Manager Randy Ready told Council as part of the "Find
Another Way Day" there will be a celebration in Paepcke park from 7 a.m. to 10
a.m. to celebrate the success in this valley of alternative methods of transportation.
There are lots of prizes for people walking, biking, riding RFTA or roller blading.
There will also be muffins and juice. Ready said the OTAK group will be having a

presentation and open house Friday from noon to 3 p.m. as part of their wrap up
from a week of meetings.
CONSENT CALENDAR
Gideon Kaufman requested Ordinance #28, Series of 1997, be taken off the consent
calendar as there is a mistake in the ordinance. Councilman Markalunas requested
item I, "Cost Reimbursement Agreement with Trustee Townhouses at Aspen
Meadows" be taken off.
Councilman Paulson moved to read Ordinance #25, 26, 27, Series of 1997;
seconded by Councilman Vickery.

ORDINANCE #28, SERIES OF 1997 - Aspen Meadows Extension of Vested
Rights, Lot 1A
Gideon Kaufman, representing the Aspen Institute, told Council they requested
extension of the vested rights for 3 years. The ordinance is written to also extend
the GMQS exemption for 6 months. Kaufman pointed out in the past they have not
requested a GMQS exemption because the project was exempted by Council as an
essential public facility and there is no time limit on that exemption. Amy Amidon,
community development department, told Council this was an error and should not
have been part of the ordinance.
Councilman Markalunas moved to read Ordinance #28, Series of 1997; seconded by
Councilman Vickery. All in favor, motion carried.

AN ORDINANCE OF THE ASPEN CITY COUNCIL TO APPROVE A THREE
YEAR EXTENSION OF THE VESTED RIGHTS GRANTED BY ORDINANCE
NO. 14, SERIES OF 1991, AND EXTENDED BY ORDINANCE NO. 31,
SERIES OF 1994, FOR THE DEVELOPMENT APPROVALS ON LOT 1A OF
THE ASPEN MEADOWS SPECIALLY PLANNED AREA, CITY OF ASPEN,
PITKIN COUNTY, COLORADO was read by the city clerk
Councilman Markalunas moved to adopt Ordinance #28, Series of 1997, deleting
any reference to the 6 month exemption; seconded by Councilman Pattison. Roll
call vote; Councilmembers Markalunas, yes; Vickery, yes; Pattison, yes; Mayor Pro
Tern Richards, yes. Motion carried.
COST REIMBURSEMENT AGREEMENT WITH TRUSTEE
TOWNHOUSES AT ASPEN MEADOWS
Councilman Markalunas said he does not disagree with the reason for the cost
reimbursement. However, this agreement does not call for accmal of interest.
Councilman Markalunas said if this were a private lending institute, there would be
interest paid. Councilman Markalunas said when the city provides this type of
subsidy, he would like the city to establish a policy of charging interest unless there
is some direct public benefit. Council agreed staff should look at a policy regarding
charging interest.
Councilman Markalunas moved to approve the cost reimbursement agreement with
the trustee townhomes at the Aspen Meadows as presented; seconded by
Councilman Pattlson. All in favor, motion carried.
ORDINANCE #23, SERIES OF 1997 - Subdivision Fireside Lodge
Councilman Pattlson moved to continue this to July 28; seconded by Councilman
Markalunas. All in favor, motion carried.
ORDINANCE #24, SERIES OF 1997 - Raw Water Agreement Hines/Highlands

Phil Overeynder, water department, told Council these agreements result from the
treated water agreement with Hines for the Highland base area development. These
raw water agreements are for snowmaking and irrigation.
Mayor Pro Tem Richards opened the public hearing. There were no comments.

Councilman Markalunas moved to adopt Ordinance #24, Series of 1997, on second
reading; seconded by Councilman Paulson. Roll call vote; Councilmembers
Paulson, yes; Vickery, yes; Markalunas, yes; Mayor Pro Tem Richards, yes.
Motion carried.
1996 AUDIT
Kim Higgins, Bondi & Company, told Council the city of Aspen has received a
clean opinion for 1996. Ms. Higgins went through the financial statements and
pointed out that the city is in a very good financial position. Ms. Higgins noted
there has been a drop in long term debt, the net worth of the city went up $10
millions. Ms. Higgins also went through the management letter for the city,
commented on improvements from last year, listed the status of comments from last
year's management letter and noted any areas where procedures could be changed.
The management letter illustrates the market value of the City' s investments, how
the city' s utility rates compare state and nation-wide. There are also some areas for
improvement noted in the letter.
Ms. Higgins complemented the city finance staff for their help and said the process
was much smoother this year.
Councilman Markalunas moved to adjourn at 6:25 p.m.; seconded by Councilman
Paulson. All in favor, motion carried.
