The current site landscape plans indicate multiple site walls which are not attached to the house. The landscape architect is indicating both concrete and exposed steel retaining walls. The walls have relatively low grade to grade retention and would not necessarily require frost protection. The exact wall heights will be determined during excavation based on site conditions such as existing fences and protected tree roots. Per my discussion with Nick Thompson, it seems our HPC recorded approvals, which include the relocated historic cabin, do not specifically address the cabin's roof eave overhang when it comes to the setback. According to HPC, the variation is expressed in terms of setback requirements in the land use code. A 5' setback is required. We placed the building 2' from the west lot line so a setback variance of 3' was grated. The land use code allows an eave to be 18" past that line. From a zoning perspective, there was no need to grant a variance relative to the eave. Therefore, it would seem we have a bit of a disconnect between our HPC approval and how the Building Department views the approval, ultimately resulting in a hardship for the project. Our cabin wall and roof eave already have been designed with a one-hour fire rated assemble, as well as the structure having a full fire suppression system. Additionally, the relocated cabin is sitting further away from the property line than it is currently, improving the condition. Furthermore, HPC prefers to keep the historical assets in their original location on site or at least as close as possible and this played a factor in where the cabin is locAed.
