Dear City of Aspen -Community Development/Building&Engineering Departments:
This letter represents an agreement between the homeowners at 211 Cottonwood Lane (Desiree H &
Samuel T Barney) "Barney"and 213 Cottonwood Lane (Troy C &Christina L Miller) "Miller" for Barney to
excavate into the Miller property/yard immediately to the east of the shared Barney/Miller property for
the construction of a new home. Excavation is anticipated to encroach approximately 5'over the shared
property line and shall be from 0"deep at the 5' projection in Miller property to approximately 5'deep at
the shared property line. Duration of the disturbance/excavated condition is anticipated to be no more
than two months. Barney shall install construction fencing at the edge of the excavation to allow use and
enjoyment of Miller yard by Miller during foundation activities. Upon completion of foundation work,
Barney shall backfill the disturbed area and revegetate to a stabilized soil condition for the duration of
construction,to the satisfaction of Miller. Upon completion of exterior finishes work and during
landscape activities at 211 Cottonwood Lane, Barney shall finish grade the disturbed area,replace grass,
paving, etc.with materials equal to or greater than existing landscape finishes at Miller. Disturbance area
is clouded on the attached Improvement Survey for 211 Cottonwood Lane. Existing conditions to be
documented with photographs prior to commencement of work.
