The proposed lighting is of a type that is similar to the Historic fixture common to the downtown area street lighting. These lights are not downcast, but are recognized as the traditional lighting typology in downtown and, therefore, may be exempted from the lighting code provisions by the Historic Preservation Officer. Because the Library is outside of the Downtown Historic District (the Library parcel borders the District) the Historic Preservation Officer does not have the authority to consider this exemption. The Community Development Director may consider an exemption from the Lighting Code for lighting that demonstrates "community benefit." Staff referred the proposed application to the Planning and Zoning Commission on November 14th. The Planning and Zoning Commission recommended unanimously that staff approve the proposed lighting administratively with no recommended alterations to the proposal. Staff believes the provision of two lights on the Mill Street Plaza of the Pitkin County Library represents a community benefit by identifying the entrance to the library as a public space, an extension of the public areas where this light type is commonplace. In fact, use of this light standard is a preferred alternative to lighting standards differing from the more traditional typology as this might create an aesthetic unfamiliar with other public spaces in town. Staff and the Planning and Zoning Commission recommends the Director approve the two lights for the Mill Street Plaza adjacent to the Pitkin County Library as shown on the applicants plans, with no conditions. Subsection H detail the types of lighting that may be exempted from the lighting code and includes the Director's ability (paragraph 6) to exempt lighting fixtures that have "demonstrable community benefit." STAFF COMMENTS: There are no specific criteria for determining whether an application represents a "community benefit." The Planning and Zoning Commission unanimously recommended that the Community Development Director approve the proposed lighting plan. This lighting typology is used throughout town in public areas, especially in areas of frequent pedestrian activity such as the downtown and Main Street. The traditional design of these fixtures characterize civic spaces while private property typically employs more contemporary applications. The Planning and Zoning Commission found that the use of the proposed lights in such proximity to the public right-of-ways is a community benefit. Because the Mill Street plaza is the primary entrance and public facade of the Pitkin County Library, this space is very much a part of the civic realm and should be developed as such. Staff requests that the Planning and Zoning Commission provide its perspective and recommendation to the Community Development Director with focus on whether this lighting type is appropriate for the site and provides a "community benefit". Mill Street is requesting a review by appeal for the proposed light standards at the main entry plaza. The proposed light standards match the City of Aspen street lights with a single globe fixture. The lights were submitted to your office for review under the City of Aspen lighting ordinance. At that time the Historic Preservation Office took an exception to the light standards. We have since then photographed the standards in the proposed locations. Copies of the photographs have been delivered to your office along with a site plan showing the proposed locations. It is the Library Board's opinion that the light standards are appropriate for the entry plaza. There is one existing light standard at the Mill street corner as well as two light standards on the parking garage roof top plaza. It appears from the photographs that the two new additional light standards would visually tie this area together. Alternate fixtures for the Plaza have been reviewed however the alternate fixtures were not as acceptable. The Board has indicated a preference for the light standards as proposed WP would appreciate a further review of this item by the Planning and Zoning Committee or the Historic Preservation Committee to consider this item further. To begin with, a heat melt system contains harmful chemicals similar to those found in automotive cooling systems, i.e., Glycol. This is because when the system starts leaking to due its age or accidental breaks by maintenance crews, it will contaminate the public land. The owner/applicant must understand that the City or other public service providers have a primary right of access to their utility and by no means have an obligation to restore an extra ordinary road block in their way. The only way I can support installation of a heat melt system (and I say this very reluctantly) is for the applicant to commit unconditionally to the following perpetual obligations: 1. To agree to replace and/or repair the heat melt system as frequently as asked by the City or other public service companies to ensure its leak free and fully functional operation. 2. Install the boiler, pumps, control instrumentation, energy supply service lines, meters, taps and all other equipment on their property and at their cost. 3. Use only EPA safe, non polluting heating fluids in their lines and the heating system. 4. Must apply and obtain a revocable encroachment license and insure the City as an additional party on their property Insurance Policy perpetually. 5. Construction of apron must comply with the Engineering Department's "Reinforced Concrete Crosspan" standards, being in use for the past 3 years. As far as the cars and pedestrians sliding when they negotiate the slope; it is a bad roadway vertical alignment problem and an inappropriate alleyway geometric design and tie-in to the Mill Street intersection. This requires re -construction of at least 100 feet of the alley at that end in order to correct the mistake and its associated problems. I am assuming that these will be on the library's circuits and the City electric staff will not be responsible for installation or maintenance. S/Bob Blaich, Chair Aspen Planning and Zoning C Published in the As City of Aspen Account ion on October 28, 2000 w� r� Pw i Goo RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING LIGHTING EXEMPTION FOR PITKIN COUNTY LIBRARY, 120 MILL STREET, CITY OF ASPEN Parcel No. 2737-073-06853 Resolution 400 - 61 WHEREAS, the applicant, Pitkin County Library, represented by John Wheeler, is requesting an exemption from the City's outdoor lighting provisions to install two "City of Aspen" standard light fixtures to be located in the plaza area in front of the library at 120 N Mill St, City of Aspen; and WHEREAS, pursuant to Section 26.575.150 Lighting, allows the Community Development Director to approve lighting plans conforming with the provisions of said section or refer the lighting plan to the P&Z or the HPC, as deemed appropriate; and WHEREAS, subsection H (6) identifies the types of lighting that may be exempt from the lighting code and includes the Director's ability (paragraph 6) to exempt lighting fixtures that have "demonstrable community benefit."; and WHEREAS, the Planning and Zoning Commission conducted a public meeting on this matter on November 21, 2000 and after reviewing the staff report, the application and the testimony received at the meeting, finds that the proposed lighting standards provide for a community benefit by providing a necessary light source to a public area which is in keeping with lighting commonly found in public spaces and specifically on the nearby right of way. NOW, THEREFORE, BE IT RESOLVED: That the Planning and Zoning Commission recommends that the Community Development Director approve Pitkin County Library's exemption request to install two "City of Aspen" standard light fixtures to be located in the plaza area in front of the library at 120 North Mill Street.
