DEVELOPMENT ORDER
of the
City of Aspen
Community Development Department
This Development Order, hereinafter "Order", is hereby issued pursuant to Section
26.304.070, "Development Orders", and Section 26.308.010, "Vested Property Rights",
of the City of Aspen Municipal Code. This Order allows development of a site specific
development plan pursuant to the provisions of the land use approvals, described herein.
The effective date of this Order shall also be the initiation date of a three-year vested
property right. The vested property right shall expire on the day after the third
anniversary of the effective date of this Order, unless a building permit is approved
pursuant to Section 26.304.075, or unless an exemption, extension, reinstatement, or a
revocation is issued by City Council pursuant to Section 26.308.010. After Expiration of
vested property rights, this Order shall remain in full force and effect, excluding any
growth management allotments granted pursuant to Section 26.470, but shall be subject
to any amendments to the Land Use Code adopted since the effective date of this Order.
This Development Order is associated with the property noted below for the site specific
development plan as described below.

SUMMARY:
The Pitkin County Library has requested to install two outdoor lights on the Mill
Street Plaza (western entrance) that do not conform to the Outdoor Lighting
Standards of the Land Use Code. The proposed lighting is of a type that is similar to
the Historic fixture common to the downtown area street lighting. These lights are
not downcast, but are recognized as the traditional lighting typology in downtown
and, therefore, may be exempted from the lighting code provisions by the Historic
Preservation Officer.
Because the Library is outside of the Downtown Historic District (the Library parcel
borders the District) the Historic Preservation Officer does not have the authority to
consider this exemption. The Community Development Director may consider an
exemption from the Lighting Code for lighting that demonstrates "community
benefit."
Staff referred the proposed application to the Planning and Zoning Commission on
November 14th. The Planning and Zoning Commission recommended unanimously
that staff approve the proposed lighting administratively with no recommended
alterations to the proposal.
Staff believes the provision of two lights on the Mill Street Plaza of the Pitkin
County Library represents a community benefit by identifying the entrance to the
library as a public space, an extension of the public areas where this light type is
commonplace. In fact, use of this light standard is a preferred alternative to lighting
standards differing from the more traditional typology as this might create an
aesthetic unfamiliar with other public spaces in town:
Staff and the Planning and Zoning Commission recommends the Director
approve the two lights for the Mill Street Plaza adjacent to the Pitkin County
Library as shown on the applicants plans, with no conditions.

Section 26.575.150 Lighting, allows for the Community Development Director to
approve lighting plans conforming with the provisions of said section or refer the
lighting plan to the P&Z or the HPC, as deemed appropriate.
Subsection H detail the types of lighting that may be exempted from the lighting
code and includes the Director's ability (paragraph 6) to exempt lighting fixtures that
have "demonstrable community benefit."
STAFF COMMENTS:
There are no specific criteria for determining whether an application represents a
"community benefit." The Planning and Zoning Commission unanimously
recommended that the Community Development Director approve the proposed
lighting plan. This lighting typology is used throughout town in public areas,
especially in areas of frequent pedestrian activity such as the downtown and Main
Street. The traditional design of these fixtures characterize civic spaces while private
property typically employs more contemporary applications. The Planning and
Zoning Commission found that the use of the proposed lights in such proximity to
the public right-of-ways is a community benefit.
Because the Mill Street plaza is the primary entrance and public fayade of the Pitkin
County Library, this space is very much a part of the civic realm and should be
developed as such. In this light, staff believes that the traditional City light standard
would be appropriate for this plaza and is recommending approval of an exemption
from the Lighting Code.
RECOMMENDATION:
Staff recommends the Community Development Director exempt the two lights
proposed for Mill Street Plaza adjacent to the Pitkin County Library (west entrance).

I hereby approve this exemption from the Lighting regulations of the Land Use Code

SUMMARY:
The Pitkin County Library would like to install two outdoor lights on the Mill Street
Plaza (western entrance) that do not conform to the Outdoor Lighting Standards of
the Land Use Code. The proposed lighting would utilize City light standards
common to the downtown area. These standards are not downcast, but are
recognized as the traditional lighting typology in downtown and, therefore, because
of the typology, may be exempted from the lighting code provisions by the Historic
Preservation Officer, when in the Downtown Historic District.
Because the Library is outside of the Downtown Historic District (the Library parcel
borders the District) the Historic Preservation Officer does not have the authority to
consider this particular exemption. The Community Development Director may
consider an exemption from the Lighting Code for lighting that demonstrates
"community benefit." The Director may also refer such a case to the Planning and
Zoning Commission for its recommendation to the Director. In this case, Staff is
requesting such a referred decision from the P&Z.
Staff believes the provision of two City light standards on the Mill Street Plaza
represents a community benefit by identifying the entrance to the Pitkin County
Library as a public space, an extension of the public areas where these light standards
are commonplace. In fact, use of this light standard is a preferred alternative to
lighting standards differing from the more traditional typology as this might create an
aesthetic unfamiliar with other public spaces in town. The Historic Preservation
Officer has raised a contrasting perspective that this light type is normally found
along public rights of way, usually in a road-side planting strip and not usually found
or appropriate for on-site lighting.
Staff requests that the Planning and Zoning Commission provide its perspective
and recommendation to the Community Development Director with focus on
whether this lighting type is appropriate for the site and provides a "community
benefit" .

Staff recommends the Community Development Director exempt the two City light
standards proposed for Mill Street Plaza adjacent to the Pitkin County Library (west
entrance).

Chris -
Putting a heat melt system in public ROW has some advantages and many
disadvantages. To begin with, a heat m~lt system contains harmful chemicals
similar to those found in automotive cooling systems, i.e., Glycol. This is
because when the system starts leaking to due its age or accidental breaks
by maintenance crews, it will contaminate the public land.
The owner/applicant must understand that the City or other public service
prDviders have a primary right of access to their utility and by no means
have an obligation to restore an extra Drdinary road block in their way.
The only way I can support installation of a heat melt system (and I say
this very reluctantly) is for the applicant tD cDmmit unconditionally tD the
following perpetual obligations:
1. To agree to replace and/or repair the heat melt system as frequently as
asked by
the City or other public service companies to ensure its leak free and fully
functional operation.
2, Install the boiler, pumps, control instrumentation, energy supply service
lines,
meters, taps and all other equipment on their property and at their cost
3. Use only EPA safe, non polluting heating fluids in their lines and the
heating system.
4. Must apply and obtain a revocable encroachment license and insure the
City as an
additional party on their property Insurance Policy perpetually.
5. Construction of apron must comply with the Engineering Department's
"Reinforced
Concrete Crosspan" standards, being in use for the past 3 years.
As far as the cars and pedestrians sliding when they negotiate the slope; it
is a bad roadway vertical alignment problem and an inappropriate alleyway
geometric design and tie-in to the Mill Street intersection. This requires
re-constructiDn of at least 100 feet of the alley at that end in Order to
correct the mistake and its associated problems,

We can provide the architect with ordering information, we don't have any
extras that are not committed to another use: Please be sure they know there
is a significant time lag betwE;len ordering and delivery (six weeks). They
can contact Ron Christian at 920-5148 to get the cost and ordering
information. I am assuming that these will be on the library's circuits and
the City electric staff will not be responsible for installation or
maintenance. I am also assuming they want the single light fixtures and not
the double headed--which is a whole different deal. Are these correct
assumptions? Let me know. Thanks.
