Brad Osborn, General Manager of Stefan Kaelin, applicant, is requesting a Temporary
Use Permit to erect two 10'xlO' tents to cover a ski deck for a promotional event
November 22, 2000 to December 5, 2000.
The Community Development Director may approve Temporary Use Permits not
exceeding seven days. A written request may be submitted by the applicant for an
additional seven days. Staffreconunends the Director approve the Temporary Use to
erect two 10'xlO' tents cover a ski deck for a promotional event November 22, 2000 to
December 5, 2000 with the following conditions:
1. The event will not extend into the public right-of-way on Durant Street.
2. The applicant will comply with the City of Aspen Sign Code, which
includes a prohibition of banners, pennants, balloons and streamers for
events that are non-commercial.
3. The applicant will comply of the City of Aspen Lighting Code, if
applicable.
4. The applicant will submit a written request to the Community
Development Department by no later than November 24, 2000 (no less
than three days prior to the expiration) for an extension oftime to
December 5, 2000. If the conditions of approval are not met the
Conununity Development Director has the right to deny the extension.
5. The operations must terminate on December 5,2000. The applicant may
use a day on either side ofthis time frame to set-up I take-down the
temporary structure. The Community Development Director is unable
to grant an extension ofthe Temporary Use beyond December 5, 2000.
6. Any violation of the conditions of approval will result in the revocation of
this permit, and may result in a citation in to Municipal Court and fines of
up to $1000 per day for each day the property is in violation.

26.96.030 Criteria Applicable to all Temporary Uses
When considering a development application for a temporary use, City Council shall
consider, among other pertinent factors, the following criteria as they, or any of them,
relate thereto.
A. The location, size, design, operating characteristics, and visual impacts
of the proposed use.
Staff Findinq:
The temporary tents, which are 1 O'x1 0' each, will cover a ski deck. The tents will fit in
the open space on the property at 516 East Durant. Staff does not foresee any problems
with the operating characteristics or visual impacts of the tent as long as the public right-
of-way is not encroached upon for the even.
B. The compatibility of the proposed temporary use with the character,
density and use structures and uses in the immediate vicinity,
Staff Findinq:
The uses in the immediate vicinity are commercial uses. The event will most likely not
impactthe character or density in the immediate area as the use is consistent with other
commercial uses.
C. The impacts of the proposed use on pedestrian and vehicular traffic and
traffic patterns, municipal services, noise levels, and neighborhood
character.
Staff Findinq:
The tent and ski deck will probably not impact vehicular traffic as the participants will
already be in the area. Staff does have concerns about pedestrian traffic because the
event it taking place so close to the public right-of-way. The applicant must carefully
monitor this. Staff does not anticipate any impact on municipal services, noise levels or
neighborhood character.
D. The duration of the proposed temporary use and whether a temporary
use has previously been approved for the structure, parcel, property or
location as proposed in the application.
Staff Findinq:
The applicant is requesting a Staff level approval for a seven-day temporary use and a
seven-day extension. There have been no other temporary uses approved for this
parcel or business.
E. The purposes and intent of the zone district in which the temporary use is
proposed.
Staff Findinq:
The Commercial Core is the most intensive zone district in the City.
F. The relation of the temporary use to conditions and character changes
which may have occurred in the area and zone district in which the use is
proposed.
Staff Findinq:
There are no changes that would prohibit the tents and event.

Staff Findinq:
The proposal will have no impact on the general public health, safety or welfare.

Thanks for your help Sara.
lBeginning Thursday, November 23,2000 we would like to have a
promotion, which includes having 210x10 portable tents in front of
our store, We wlll be using the Ski Doctors (John Clendenin) Ski
Deck for this promotion. We would like to leave the tents up for 2
weeks to cover the deck. We will not need to use the sidewalk. The
tents will fit on the bricks in front of the building at the shop on
Durant.
