SUMMARY:
On behalf of the City of Aspen Parks and Recreation Department (Applicant), Ben
Ludlow has applied for an Insubstantial Amendment to the Aspen Ice Garden, located
at 233 W. Hyman Avenue.
The applicant wishes to construct a trellis over the existing entrance to the
Aspen Ice Garden as is depicted in the attached elevation and site plan
drawings.
A PUD Amendment must be approved to alter the site specific development plan of
the Aspen Ice Garden because it is zoned "Public". In the Public Zone District, all
dimensional requirements are established through a Planned Unit Development. The
Aspen Ice Garden's existing conditions serves as it's Planned Unit Development.
Staff supports the proposed amendment because it is a minor change to the character
of the building. The proposed trellis will not encroach further into the public right-of-
way than the existing building already does. Staff finds that the proposed amendment
meets the criteria for an insubstantial amendment pursuant to section 26.445.100 of
the City of Aspen Land Use Code.
Community Development staff recommends approval of the requested Insubstantial
Amendment to the Aspen Ice Garden site specific development plan to allow for the
construction of a trellis over the main entrance as proposed.

COMMUNITY DEVELOPMENT DIRECTOR DECISION
The Community Development Director finds the Insubstantial Planned Unit Development
Amendment to the Aspen Ice Garden to be consistent with the review criteria and hereby
approves the amendment to the Aspen Ice Garden as proposed.
