HomeMy WebLinkAboutFile Documents.506 E Main St.0054.2019 (36).ACBK Memorandum To: Jessica Garrow, Community Development Director From: Stephen Kanipe Date: January 29, 2019 Re: CREMP payment waiver for snow melt systems at Galena Plaza project ________________________________________________________________________ This memorandum will formally amend the document of record dated July 31, 2015 regarding snowmelt systems and CREMP payment options at the Galena Plaza project (attached). Aspen Municipal Code section 8.46.020, adoption of the 2015 Edition of the International Energy Conservation Code contains Appendix CA specific to the Commercial Renewable Energy Mitigation Program (CREMP). Section 101 contains exceptions for “areas critical for access and emergency egress as approved by the building official including item B; Accessible routes as defined by IBC sections 1104.1 and 1104.2 to be limited to 48 inches in width. The 48 inch width is exempted and referenced in the letter of July 31, 2015. The connecting pedestrian routes in the Rio Grande Plaza serve the Library, the Pitkin County Jail, the Courthouse, the Rio Grande office building, Tasters and currently, the Rio Grande parking structure. The new city civic building will become part of this integral public interface. The snow melt is installed, inspected and approved but not energized. The current agreement requires the mitigation payment be received before the system operates as designed. The building official has authority to waive CREMP payments in areas critical to public safety. Given the public facing nature of these areas, the CREMP payments outlined in the final bullet point of the July 31, 2015 agreement is hereby deleted and no payment will be due when the systems are energized.
