Hopkins Avenue- Minor Development and Variance- Public Hearing DATE: September 25,2002 SUMMARY: The subject property contains two 19th century miner's cottages, both of which were moved to this site in the early 1990's, restored, and then sold as condominium units. The easternmost house, 134 14 W. Hopkins has recently been purchased. The new owner needs to undertake some repair work to the foundation and, at the same time, wishes to add a lightwell to allow the use of the basement as a bedroom. Because the property is already developed to the maximum allowable floor area, a modest FAR bonus is requested to complete the project. APPLICANT: CWA Development, represented by Phyllis J. Bronson and Jesse L. Boyce. 0 PARCEL ID: 2735-124-19-002. ADDRESS: 134 !4 W. Hopkins Avenue, Wyckoff Carley Condominiums, Unit L, Block 59, City and Townsite of Aspen, Colorado. ZONING: R-6 (Medium Density Residential). MINOR DEVELOPMENT The procedure for a Minor Development Review is as follows. Staff reviews the submittal materials and prepares a report that analyzes the project's conformance with the design guidelines and other applicable Land Use Code Sections. This report is transmitted to the HPC with relevant information on the proposed project and a recommendation to continue, approve, disapprove or approve with conditions and the reasons for the recommendation. The HPC will review the application, the staff analysis report and the evidence presented at the hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines. The HPC may approve, disapprove, approve with conditions, or continue the application to obtain additional information necessary to make a decision to approve or deny. If the application is approved, the HPC shall issue a Certificate of Appropriateness and the Community Development Director shall issue a Development Order. The HPC 0 decision shall be final unless appealed by the applicant or a landowner within three 1 hundred (300) feet of the subject property in accordance with the procedures set forth in Chapter 26.316. Staff Response: The proposal is to add a lightwell on the west side of the miner's cottage, recessed from the front of the structure. The size of the well is determined by the UBC requirements for light and egress. Staff has no concerns with regard to the design guidelines. If the Building Department requires that there be some protection around the lightwell, it should be a flat, moveable grate, rather than a railing. As described in the summary, two miner's cottages were moved on to this site over a decade ago. They share the floor area that would normally be permitted for a single family house. Both of the cottages have been nicely restored and do not have additions which overwhelm their historic character. There is no additional floor area available to the property other than a potential HPC bonus. The applicants' request an FAR bonus of up to 50 square feet, just enough to cover the lightwell. The following standards apply to an FAR bonus. per Section 26.415.110.E: 1. In selected circumstances the HPC may grant up to five hundred (500) additional square feet of allowable floor area for projects involving designated historic properties. To be considered for the bonus, it must be demonstrated that: a. The design of the project meets &11 applicable design guidelines; and b. The historic building is the key element of the property and the addition is incorporated in a manner that maintains the visual integrity of the historic building and/or c. The work restores the existing portion of the building to its historic appearance; and/or d. The new construction is reflective of the proportional patterns found in the historic building's form, materials or openings; and/or e. The construction materials are of the highest quality; and/or f. An appropriate transition defines the old and new portions of the building; and/or g. The project retains a historic outbuilding; and/or h. Notable historic site and landscape features are retained. 2. Granting of additional allowable floor area is not a matter of right but is contingent upon the sole discretion of the HPC and the Commission's assessments of the merits of the proposed project and its ability to demonstrate exemplary historic preservation practices. Projects that demonstrate multiple elements described above will have a greater likelihood of being awarded additional floor area. The lightwell has no impacts on the historic character of the building, does not add any bulk to the site, and allows the safe use of the existing basement for living area. The relevant design guidelines are met and the project is a good example of historic preservation practices. Staff recommends that the bonus be approved. 2 RECOMMENDATION: Staff recommends that Minor Development and a 50 square foot FAR bonus be approved for 134 M W. Hopkins Avenue, Wyckoff Carley Condominiums, Unit L, Block 59, City and Townsite of Aspen, Colorado with the following conditions: l. HPC hereby grants an FAR bonus of up to 50 square feet in order to allow a lightwell that meets UBC requirements for light and egress from the basement of this house. 2. A cut sheet of the proposed window in the lightwell must be provided for review by the HPC staff and monitor as part of the building permit application. 3. If protection is required for the lightwell, it must be through the use of a grate, not a railing. 4. No elements are to be added to the historic house that did not previously exist, other than what is approved by HPC. No existing exterior materials other than what has been specifically approved herein may be removed without the approval of staff and monitor. 5. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor. 6. The conditions of approval will be required to be printed on the cover sheet ofthe building permit plan set and all other prints made for the purpose of construction. 7. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit. Written description of the proposal 0 Existing Conditions A faulty seal along a 20 foot section of the West facing foundation wall has caused considerable water damage on the drywall interior of the downstairs bedroom, especially at electrical fixtures on the wall. Additionally, in the case of an emergency, the downstairs bedroom has only one avenue of escape - up the existing stairwell into the main living room above. In the event of an emergency, such as a fire, this is one of the most likely places for the fire, and thus the worst avenue of escape. Proposal We propose to excavate and reseal an approximately 18 foot section on the exterior of the West facing foundation wall to allow repair and resealing of the foundation on the outside, and the repair of any damaged wiring or electrical fixtures, and drywall in the bedroom. Concurrently we propose to install a safety egress / window well into the downstairs bedroom for our son, who will be living there. 0 This window well is not to exceed 50 ff of an FAR bonus. The proposed exterior dimensions of the window well are 4 feet out from the house wall x 8 feet along the wall, with a depth of 42 inches. The unit will be constructed of 6" x 6" treated wooden logs. A sliding window will be installed in the existing foundation wall to provide a safety egress. The basement bedroom is about 387 M in extent. Due to the narrow gap between the two condominium units, soil from the excavation will have to be temporarily stored in a container on West Hopkins. The entire project is to last no more than ten (10) days. In the space between units K & L there are three small aspen trees, two ofwhich are dead. We are seeking advice from Aaron Reid of the Aspen City Parks Department on any mitigation procedures 8. HOPKINS AVENUE, WYCKOFF/CARLEY CONDOMINIUMS, UNIT L, BLOCK 59, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. -, SERIES OF 2002 Parcel ID #: 2735-124-19-002 WHEREAS, the applicants, CWA Development, represented by Phyllis J. Bronson and Jesse L. Boyce, have requested Minor Development approval and a floor area bonus for a lightwell at 134 !4 W. Hopkins Avenue, Wyckoff Carley Condominiums, Unit L, Block 59, City and Townsite ofAspen, Colorado; and WHEREAS, Section 26.415.070 of the Aspen Municipal Code states that no building or structure shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a designated historic property or district until plans or sufficient information have been submitted to the Community Development Director and approved in accordance with the procedures established for their review. An application for a building permit cannot be submitted without a Development Order; and WHEREAS, the procedure for a Minor Development Review is as follows. Staff reviews the submittal materials and prepares a report that analyzes the project's conformance with the design guidelines and other applicable Land Use Code Sections. This report is transmitted to the HPC with relevant information on the proposed project and a recommendation to continue, approve, disapprove or approve with conditions and the reasons for the recommendation. The HPC reviews the application, the staff analysis report and the evidence presented at the hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines. The HPC may approve, disapprove, approve with conditions, or continue the application to obtain additional information necessary to make a decision to approve or deny; and WHEREAS, in order for HPC to grant an FAR bonus, according to Section 26.415.110.E of the Municipal Code, HPC must find that: 1. In selected circumstances the HPC may grant up to five hundred (500) additional square feet of allowable floor area for projects involving designated historic properties. To be considered for the bonus, it must be demonstrated that: a. The design of the project meets ill applicable design guidelines; and b. The historic building is the key element of the property and the addition is incorporated in a manner that maintains the visual integrity of the historic building and/or c. The work restores the existing portion of the building to its historic appearance; and/or d. The new construction is reflective of the proportional patterns found in the historic building's form, materials or openings; and/or e. The construction materials are o f the highest quality; and/or f. An appropriate transition defines the old and new portions of the building; and/or g. The project retains a historic outbuilding; and/or h. Notable historic site and landscape features are retained; and WHEREAS, Amy Guthrie, in her staff report dated September 25,2002 performed an analysis of the application based on the standards, and recommended the application be approved with conditions; and WHEREAS, at a regular meeting held on September 25,2002, the Historic Preservation Commission considered the application, found the application to meet the standards and approved the application, with conditions, by a vote of_ to _. THEREFORE, BE IT RESOLVED: That the HPC approves Minor Development and an FAR bonus for 134 !4 W. Hopkins Avenue, Wyckoff Carley Condominiums, Unit L, Block 59, City and Townsite of Aspen, Colorado with the following conditions: l. HPC hereby grants an FAR bonus of up to 50 square feet in order to allow a lightwell that meets UBC requirements for light and egress from the basement of this house. 2. A cut sheet of the proposed window in the lightwell must be provided for review by the HPC staff and monitor as part of the building permit application. 3. If protection is required for the lightwell, it must be through the use of a grate, not a railing. 4. No elements are to be added to the historic house that did not previously exist, other than what is approved by HPC. No existing exterior materials other than what has been specifically approved herein may be removed without the approval of staff and monitor. 5. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor. 6. The conditions of approval will be required to be printed on the cover sheet of the building permit plan set and all other prints made for the purpose of construction. 7. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part o f the building permit application indicating that all conditions of approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit.
