Grueter, Pitkin County, CO RESOLUTION #057 (SERIES OF 2025) A RESOLUTION OF THE CITY OF ASPEN CITY COUNCIL APPROVING A MINOR SUBDIVISION AMENDMENT TO REMOVE CONDITION #2 OF THE RECORDED SUBDIVISION EXEMPTION DOCUMENTS (RECEPTION #194908) PRESERVING THE BLUE SPRUCE TREE, Parcel ID No: 2735-124-25-007 WHEREAS, the Community Development Department received an application for 506 W. Hallam Street from Nicholas & Kimberly Hayman, and Dexter West, LLC (Applicant), requesting a Minor. Subdivision Amendment, pursuant to Land Use Code Chapter 26.480.090.C; and, WHEREAS, pursuant to Chapter 26.480.090.0 of the Land Use Code, City Council may grant a Subdivision Minor Amendment for issues raised during the original review or issues that could not have been reasonably anticipated during the review; and, WHEREAS, all code citation references are to the City of Aspen Land Use Code in effect on the Jay the application was deemed complete — March 25, 2025, as applicable to this Project, and, WHEREAS, the Aspen Fire Protection District has determined that the tree, without mitigation, presents a life safety and property hazard; and, WHEREAS, Aspen SAVATREE has determined that the overall risk rating for the Blue Spruce Tree is Moderates and, WHEREAS, the Parks and Recreation Director has granted the requested permit based upon criteria identified in the Wildfire Mitigation Policy; and, WHEREAS, the Parks and Recreation Director has issued a wildfire -related tree removal permit with conditions of approval$ and, WHEREAS, the Parks and Recreation Director has conditioned the wildfire -related tree removal permit upon City Council's approval to amend the subdivision exemption regarding the tree in a manner satisfactory to all beneficiaries; and, il has reviewed and considered the application under the applicable WHEREAS, the City Counc provisions of the Municipal Code as identified herein, has reviewed and considered the recommendation of the Community Development Director; and, WHEREAS, the City Council approves the Minor Subdivision Amendment, by a five to zero (5- 0) vote, removing the condition preserving the Blue Spruce Tree; and, WHEREAS, the City Council Finds that this resolution furthers and is necessary for the promotion of public health, safety and welfare. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO THAT: Section 1: Minor Subdivision Amendment Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the City Council hereby grants removal of Condition #2 of the recorded Subdivision Exemption (Reception #194908). 506 W Hallam Street City Council Resolution #057, Series 2025 Page 1 of 2 Section 2: Referral Departments The applicant shall obtain all permits required and shall adhere to all regulations as required by the City of Aspen Parks Department and all other applicable City Departments. Section 3: Material Representations All material representations and commitments made by the Applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before the Community Development Department and the City Council, are hereby incorporated in such development approvals and the same shall be complied with as if fully set forth herein, unless amended by other specific conditions or an authorized authority. Section 4: Existing Litigation This Resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 5: Severability If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
