ERV intakes are less than 10'
from property line (2015 IMC
401.4). This building site is
constrained by the historic
district on the front façade, the
alley parking in back, narrow
setbacks on each side, and an
exterior exit stair in the middle;
all of which practically prevent a
fully code compliant location for
the eight intakes. The current
neighbors do not have
hazardous exhausts nearby and
any future development will not
be able to locate hazardous
exhausts within 10’ of their
property line or the intakes in
question. The intakes are
serving as whole house
ventilation, which is a City of
Aspen above code program to
provide ventilation that would
normally be provided by
operable windows, which are
allowed to be located 5’ from the
property line. As such, the
location of these intakes does
not pose a hazard and is a
reasonable accommodation of
the constraints of this site so
they may remain as located 5’
from side lot property lines.

Include sheet A6.14 and revise it
to show the actual proposed
design. Show it connecting 4
stories, which requires a 2 hour
fire rating. Show the horizontal
portion and provide a listed
horizontal shaft assembly.
Revise the vertical shaft
assemblies to separate the shaft
from the rest of the building
construction on all four sides.
