SUBJECT & SITE OF APPROVAL:
The Community Development Department is issuing this Administrative Determination to accept
an estimation of pre-development topography prepared by a registered land surveyor for the
property located at 725 Cemetery Lane. A Historic Topography study (Exhibit A) has been'
prepared by Hans Brocker,PLS#35088, of Pinnacle Design;which has been reviewed by the City
of Aspen Engineering Department and deemed acceptable.
SUMMARY:
The application proposes that the existing grade on the property was manipulated during its initial
development to accommodate an auto court that is on grade with Cemetery Lane. The excavated
fill was then dispersed around the property,creating new topography—some of which are at grades
of greater than 20%. This leads to two issues: 1) a reduction of net lot area, and 2) existing grades
. that may create a disadvantage when measuring height. The application includes a site
improvement survey that depicts existing conditions and a historic topography study that explain
the impact of these manipulated grades and offer a proposed determination of pre-development
topography.
STAFF EVALUATION:
Staff from the City Community Development and Engineering Departments reviewed the
materials provided by the applicant. Based on the information provided by the applicant, staff has
determined that site features that were counted as part of the steep slope calculations in the
improvement survey were likely the result of man-made development. The Historic Topography

study provided is likely consistent with the site's original topography. The Engineering
Department agrees that the proposed interpolated slope is a reasonable interpretation of pre-
development topography and has provided the following analysis:
"Based on the land use application for interpolated grade, the Engineering
Department agrees to the proposed survey.The application provided evidence
that the grade was manipulated to accommodate the auto court based on the
following: historic grade survey, exhibit A (to the application), which shows
the how grades on this property logically tied into neighboring properties
before development of this site, the slope analysis survey, exhibit C (to the
application), which shows uncharacteristic grading of the neighborhood, and
the existing site condition photos, exhibits M-U, which show the cut areas to
create the auto court."
DECISION:
In accordance with the procedures, standards, and limitations of Title 26, this Administrative
Determination, and pursuant to Code Section 26.575.020 (and more specifically the Notes for
Table 26.575.020-1), acknowledges and accepts the attached pre-development topography for the
subject property.
