Dear Ms. Muhigirwa:
As discussed with Nick Thompson, Plan Examiner, and Denis Murray, Plan Examination Manager,
with the City of Aspen Building Department of Community Development on August 1, 2023 and
confirmed in email on August 2, 2023, there are two conditions relating to Plan Review Comments
that we were requested to address via a letter for your review and consideration.
We had two plan review comments regarding the accessibility to bathrooms from the Restaurants
(201-1) and (202-1) and to the Kitchen (200-0)from the same restaurant and bar. As discussed with
Nick and Denis, these are considered technically infeasible and we proposed alternates as
described below.
- Accessible access to bathrooms from Restaurants 201-1 and 202-1. This level has four single
occupant restrooms, one of which is accessible. It is technically infeasible to convert Restroom
225 to meet ADA Guidelines because it is between a stair and another ADA Restroom with no
room for expansion. It is technically infeasible to convert Restrooms 222 and 224 to meet ADA
Guidelines because of existing structural bearing walls and stairs needed for egress. There is
one wall that is framing and as discussed that is shared with the kitchen which is not getting
renovated in this scope of work. It was discussed that there are two existing Accessible
Restrooms 321 and 322 on the upper level that are accessible to restaurant patrons through the
elevator.
- Access to Kitchen 200-0 from the Restaurants 201-1 and 202-1. There is currently no
accessible access between Restaurants 201-1 and 202-1 and Kitchen 200.0. It is technically
infeasible to provide accessible access on the interior of the building between these spaces due
to the existing stairs tightness of space and the length of ramp that would be needed for this
change in elevation without expanding the building envelope. It was discussed that the corridor
wall adjacent to Retail 200-2 could be moved to allow an exterior door from adjacent to the
elevator to the kitchen corridor could be added. Door 200e has been added here with front
approach push side and front approach pullside clearances as depicted below.
